BOARD OF LICENSE COMMISSIONERS
ALCOHOLIC RULES AND REGULATIONS FOR PACKAGE STORES

1. These Rules and Regulations shall apply to all package stores which are licensed for the sale of alcoholic beverages to be consumed off the premises. 2. The hours during which such licensees may sell alcoholic beverages shall be those set forth in the license, and if not set forth in the license, the hours shall be those generally fixed by vote of the Board of License Commissioners, subject to the General Laws of the Commonwealth. No alcoholic beverages may be sold except during such hours. 3. Any licensee intending to close his place of business must notify the Board in writing before such closing and he shall state in his notice the reason and length of such closing. 4. No licensee shall incur bills for his licensed establishment under any corporate or trade name other than that under which he is licensed. 5. Corporate managers in licensed establishments may not be changed until the Board has approved such change. 6. Assignment of stock in corporation licensed locations for the purpose of safeguarding the assignee on loans, etc., gives no right to such assignee to conduct the business of the licensee; therefore, licensees must notify the Board immediately when the assignee forecloses under such assignment of stock. 7. Licensees shall immediately notify the Board of any proceedings brought against them or brought by themselves under the Bankruptcy Laws. 8. Licensees shall immediately notify the Board of any court proceedings which may affect the status of this license. 9. All alcoholic beverages sold must be in sealed containers and consumed off the premises.

10.The licensed premises shall be subject to inspection by the Weymouth Police Department and duly authorized agents of the Board of License Commissioners. 11. No physical expansion of the premises shall be made unless a plan is submitted and approved by the Board of License Commissioners and the Alcoholic Beverages Control Commission. 12. No licensee shall make any distinction, discrimination or restriction on account of race, color, religious creed, national origin, sex or ancestry relative to the treatment of any person. 13. All licenses and building certificates shall be displayed on the premises in a conspicuous place where they may be easily seen and read. 14. The Board of License Commissioners reserves the right to change or add to the terms and conditions of any license, after notice to the licensee and a hearing thereon. 15. POLICY FOR THE SALE OF KEGS: 1. All sales of beer kegs shall be banded in the following manner: a. Place a metal numbered band on the handle/neck of all kegs and on all taps. b. Place the name, address, date of birth and band number in a journal, after confirming proper age from positive identification. The journal will be made available at all times, for inspection by a police officer. c. The deposit on each keg will be $50.00 and on each tap will also be $50.00, case or credit. Credit will be in the form of a credit card; no checks, I.O.U. or word of mouth...a material line of credit. d. The period for returns of kegs shall be no more than 60 days. e. Any keg or tap that is returned either with the band removed or missing will forfeit the deposit. If a keg or kegs and a tap is purchased than all parts must be returned together in order to have the deposit returned. f. All kegs and taps will be returned to where they were purchased. The tags will be removed and retained by the business for 90 days to be able to confirm all forfeitures and/or for evidence in any court procedures. g. The cost of the bands will be placed on the consumer. h. Any forfeitures will be retained by the package store. 16. A LICENSE IS SUBJECT TO SUSPENSION, REVOCATION OR CANCELLATION FOR BREACH OF ANY OF ITS CONDITIONS, OR OF THESE REGULATIONS, OR OF ANY LAW OF THE COMMONWEALTH.
