This Market is for the benefit of both producers and consumers. It provides producers with a direct market outlet at which they can sell at prices normally higher than wholesale, and consumers with an opportunity to buy fresher food at prices normally lower than retail. This is a Certified Farmers’ Market operating in accordance with regulations published in the California Code of Regulations Title 3, Chapter 3, Group 4, Article 6.5 on Direct Marketing beginning with section 1392. 1. All growers/vendors must be approved by the Market Manager. 2. The Market Manger reserves the right to refuse any grower/vendor. Reasons for refusal include, but are not limited to, lack of available space, violation of Market rules, lack of proper certification or licensing, failure to provide identification and/or property leases, and failure to communicate with the Market Manager. Photographs are taken of all vendors. 3. No rude, profane or abusive language, smoking or drinking or alcohol will be permitted. 4. All products must be of the grower/vendors production. Resale of products is forbidden. 5. Organically grown products must comply with section 26569.11 of the California Health & Safety Code and a sign must be posted stating this fact. 6. Certified Producers must display their “Embossed” current certificate at all times. Nursery licenses must be display where cut flowers and plants are sold. 7. Scales must have current seal from the Department of Weights and Measures. 8. Prepackaged items must be labeled with your name, address, Zip Code and the eight or volume of product in the container. (i.e., Net Weight 4 oz). 9. With the Mangers permission, Certified Producers may only sell for one other Producers (of the same or adjoining county) who is also a Certified Producer. This Certified Producer must be present to sell for his or her neighbor. The products of each Certified Producer must be clearly identified. A producer who wants to sell for another producer must have at least 50% of their own product available for sale and must have a Notarized letter from the other producer stating that permission is given to sell. 10. Each grower/vendor must prepare and sigh an inventory load list for each day. There is room on this load list for any messages you may want to give the office.

11. Commodities brought to the market are to be sold at Assigned Stalls—not transferred to other stalls or locations. No grower/vendor may move to another stall number without permission of the Market Manager. Stalls may not be sublet or inherited. 12. Commodities must be displayed neatly with price signs visible to customers. 13. Growers/vendor’s must call the day before the stall assignments. Market hours are: Monday to Friday 9:00 am to 4:00 pm, and Saturdays, 5:00 am to 5 pm. Set up is one hour before opening. Growers/Vendors who fail to arrive at opening time will have their stalls reassigned to another grower/vendor. Each grower/vendor is responsible for keeping their assigned area clean. Failure to keep a stall clean will result in suspension from the market. 14. Public Health Regulations apply in the Market. All growers/vendors shall provide a trash container for customers. 15. All salespersons hired by the grower must fill out an Employment Statement signed by the grower for whom they are working. 16. All stalls, faucets, etc. are the property of the City and County of San Francisco. No modifications may be made without the permission of the Market Manager. No nails, tacks, staples or writing is allowed on the walls. All temporary awnings are to be adequately anchored to prevent accidents. 17. No sales, of meat, fowl or tofu is allowed. 18. No producer may sell for another producer if the producer is already selling at the market.
I agree to defend, HOLD HARMLESS, and indemnify the City and County of San Francisco and its officers and employees from and against any and all claims for damages and any and all liability for damages and any and all loss, provided such claim, liability of loss arises in whole or in part from, or was caused in whole or in part by, my act or omission or that of my employee or agent, and I also agree irrespective of whether such claim, damages or loss also arose from where caused by a negligent act or negligent omission on the part of the City and County of San Francisco, or any of its officer or employees. I have read the foregoing and I agree to conform to the regulation contained therein.
