Section 6. Permits Issuance , Renewal, Suspension & Revocation 1. Any establishment listed in Section 6A, Permit Fees & Expiration Schedule must be permitted in accordance with the applicable regulations. No application will be accepted without the $50.00 Application Fee. 2. Applications will be reviewed for completeness and the requirements of the applicable regulations. Each applicant shall be notified in writing within 30 calendar days of submittal of the approval or denial of their application. 3. Permits issued by the Malden Board of Health are not transferable to another person or address for any reason. 4. Any establishments listed on the Board of Health Schedule of Fees operating without issuance of a valid permit will be closed immediately and fined $100.00. This fine must be paid and application made and approved before a valid permit will be issued. 5. Failure to renew Board of Health permits prior to expiration will be cause for issuance of $100.00 fine. Any permits not renewed within 30 days of expiration will automatically be suspended pending a hearing at a regularly scheduled Board of Health meeting. 6. Permit holders who fail to comply with a correction order authorized by the applicable regulation and issued by the Board of Health or it's agents within the time specified in that order shall be cause for the issuance of a citation for $50.00 or other action as authorized by state or local regulations for each violation. Each day the violation is not corrected after the correction date shall constitute a separate violation and fine. 7. No permit holder with outstanding fines will be allowed to renew the permit until such a time as the fines are paid. 8. This regulation will be enforced through the use of Non-Criminal Citations as provided by M.G.L.c. 40, Section 21D and all applicable state and local regulations.
