SUBJECT:           LAFCO Representative & Possible Resolution 2004-6

RECOMMENDATION:

Consider procedures to help fill a vacancy on the Local Agency Formation Commission (LAFCO) related
to representation of Independent Special Districts by:

    1. Determine if any FCGMA Board members are interested in filling a vacancy on the Local Agency
       Formation Commission (LAFCO) to represent the Independent Special Districts.
    2. Consider adoption of a Resolution (2004-6) to be signed by the Chair nominating a
       representative.

DISCUSSION:

A Special District Selection Committee made up of representatives from the 29 independent special
districts within Ventura County has adopted a set of Rules and Regulations (R & R’s) concerning how
LAFCO vacancies are filled. These R & R’s provide that when a LAFCO Board member leaves or
completes their term of office, the Alternate automatically steps in to fill the vacancy for a new 4-year
term, and an election for a new Alternate must be held.

LAFCO is soliciting nominations to fill an upcoming opening for another Alternate for a term starting
January 1, 2005. The nominating process and election will be conducted by mail. If a nomination is
made by the FCGMA, a Resolution must be passed and submitted to LAFCO along with the candidates
name and 1-page resume to officially meet the required conditions. The deadline for such nominations is
October 1, 2004. Regular LAFCO meetings are held at 9:00 A.M. on the third Wednesday of each
month, except August and December.

The FCGMA is a “Special District”; therefore the FCGMA Board may designate one sitting Board
member to fill this impending vacancy, or may elect not to participate in this process at all.
