PNIEL FARM EXPROPRIATED BY THE STATE

The Pniel Farm 281 in the Northern Cape Province has become the first property
to be expropriated by the State in line with Section 42E of the Restitution of Land
Rights Act, no. 22 of 1994 as amended. The farm which was owned by the
Evangelical Lutheran Church in South Africa is now vested in the State. An
amount of R28 400 000.00 has been paid into the Church’s bank account. The
amount constitutes 80% of the total amount of R35.5 million which will be paid to
the Church as compensation for the land.


The expropriation follows the approval by the Minister for Agriculture and Land
Affairs Lulama Xingwana after negotiations between the state and the church
reached a stalemate. The expropriation came into effect on 26 January 2006,
and the State will take possession of the farm on 15 March 2007. The farm was
expropriated for the purposes of restoring the property to the claimants as
restitution of their land rights in terms of section 2 of the Restitution Act.

In line with section 9(1) of the Expropriation Act, the Church must submit a
written statement to the Minister within 60 days indicating whether or not it
accepts the compensation offered for the land. Within the 60 days’ period, the
Church must also provide details of any contracts of lease or sale; any builder’s
lien; or any other right to which the property is subject.


The claim for the Pniel Estate which is situated near Barkley West, 20km to the
north of Kimberley was received from the Bloem family; the United Griquas
Development; the Community and Workers on the Pniel farm; and the Pniel
Community trust. The property measures 25 200 hectares.
