11    AMENDMENT OF TARIFFS OF CHARGES
      FOR ENVIRONMENTAL HEALTH
      SERVICES


     1      STRATEGIC THRUST

     Service Delivery Excellence and Good Governance.


     2      OBJECTIVE

     To obtain approval for the amendment of the Tariff of Charges for Environmental
     Health Services.


     3      SUMMARY

     There is a need to revise the Tariffs of Charges where necessary on an annual basis so as
     to prevent a situation arising where the Council subsidises users unnecessarily and also to
     ensure a uniform City-wide tariff structure for the City of Johannesburg.

         3.1 PROBLEM STATEMENT

            The Council’s Tariffs of Charges for the impoundment of Animals are fragmented and
            outdated . In terms of a contract between Council and the Society for the Prevention
            of Cruelty to Animals ( SPCA ) the Municipal animal pounds situated in
            Johannesburg, Midrand, Sandton, Randburg and Roodepoort are being conducted
            by the said Society on behalf of Council. The following Tariffs of Charges for the
            impoundment of the different categories of animals were mutually agreed upon by
            the SPCA and the Environmental Health Unit of the City who is responsible to
            administer the above contract:

     It should be noted that the above charges are for the account of the SPCA in terms of
     the contract with Council, to ensure that they are adequately compensated for
     expenses incurred with the impoundment of animals.

     Vacant properties – In terms of the Council’s new By laws ( Emergency Services
     and Public Health) property owners are requested by statutory notice as and when
     necessary to clear their properties of long grass, undergrowth and dumped materials,
     failing which the council clear such properties at the cost of the owner. This implies
     that such properties have to be inspected and re-inspected until satisfactory cleaned
     without the Council redeeming any funds for the additional inspections that have to
     be carried out by Environmental Health. A Tariff Charge of R500.00 is therefore
     recommended for each case where a property is referred to a contractor for the
     cleaning thereof at the cost of the owner. The erection of “no dumping” signs on
     properties not protected by owners to prevent illegal dumping from taking place is
     also costing regions a considerable amount without any of the costs being redeemed.
     A Tariff charge of R1 500.00 is recommended for this purpose.

     3.2        PROCESS

     Thought was given to the following aspects when the Tariffs of Charges were revised
     and/or decided upon:

     (1)       Users and consumers of municipal services should be treated equitable in
     the application of the Tariffs of Charges.

     (2)      The amount individual users or consumers pay for services should
     generally be in proportion to their use of that service.

     (3)      Tariffs of Charges must reflect the costs reasonably associated with
     rendering the service, and

     (4)      Tariffs of Charges must be set at levels that facilitate the financial
     sustainability of the service.

     (5)       Guidelines from finance to increase Tariffs of Charges by not more than 5%
     -existing Tariffs are therefore increased on average by 5%, rounded off to the nearest
     R5.00.

     3.3       PROPOSED TARIFFS OF CHARGES

     The following table reflects the recommended increase in Tariffs of Charges for
     Environmental Health Services:

4      POLICY IMPLICATIONS

The proposals contained in this report are in line with the City of Johannesburg’s policies on
equity and that the amount consumers pay, should generally be in proportion to their use of
the services in question.


5      LEGAL AND CONSTITUTIONAL IMPLICATIONS

This report has been finalised in conjunction with Legal Services to ensure compliance with
all relevant Legislation It must, nonetheless, be pointed out that in terms of Section 28 (6) of
the Local Government: Municipal Finance Management Act, 2003 (Act 56 of 2003) the new
tariffs as proposed, once determined in respect of the 2005/2006 Financial Year, may not be
further increased during the said financial year, except when required in terms of a financial
recovery plan as contemplated in the Act. For that reason it is of the utmost importance to
ensure that the proposed increases comply with the budgeted needs of the Council in
respect of 2005/2006 Financial year.

6           FINANCIAL IMPLICATIONS

The proposed Tariff of Charges in the table above will replace all charges throughout the
City for similar services as from 1 July 2005. The Tariff of Charges related to the
impoundment of animals will be for the account of the SPCA in terms of the standing
contract between the said Society and the City.


7           COMMUNICATIONS IMPLICATIONS

The relevant information regarding the amended tariffs will be communicated to all role
players in the manner prescribed by law.


8           OTHER DEPARTMENTS/BODIES CONSULTED

The Regional Directors, Regional Managers: Health and Environmental Health Managers
within all the Regions of the City were consulted and their comments considered and
incorporated into the report where necessary. In addition , this report was finalised in
conjunction with Legal Services

9           RECOMMENDATIONS

IT IS RECOMMENDED

[       1    That, in terms of Sections 11(3)(i) and 75A(1) and (2) of the Local
             Government: Municipal Systems Act, 2000 (Act 32 of 2000) as amended, read
             with Sections 10G(7)(a)(ii) and (b)(ii) of the Local Government Transition Act,
             1993 (Act 209 of 1993) as amended, the City of Johannesburg amends its
             Tariff of Charges for Environmental Health Services as set out in Annexure
             “A” with effect from 1 July 2005.

    2       That in terms of Sections 21, 21A(1) and 75(3)(a), (b) and(c) of the Local
            Government: Municipal Systems Act, 2000 (Act 32 of 2000) as amended, read
            with Section 10G(7)(c) of the Local Government Transition Act, 1993 (Act 209 of
            2003) and Sections 22(a)(i) and (ii) of the Local Government: Municipal Finance
            Management Act, 2003 (Act 56 of 2003) as amended, the City of Johannesburg:

            (1) displays a copy of the resolution and notice in the manner prescribed;

            (2) seeks to covey to the local community by means of radio broadcast
                covering the area of the City, the information contemplated in Section
                75A(3)(c) of the Local Government: Municipal Systems Act, 2000 (Act 32 of
                2000) as amended; and

     (3) publishes the notice in the manner prescribed and invites the local
         community to submit written comments or representations in respect of the
         amended tariff of Charges

  3   That, if no objections are received the amended Tariff of Charges be published
      in the Provincial Gazette and be effective from 1 July 2005.




  4   That a copy of the notice referred to in Paragraph 2(3) above be sent forthwith
      to the MEC for Local Government in terms of Section 75A(4) of the Local
      Government: Municipal Systems Act, 2000 (Act 32 of 2000) as amended, read
      with Section 10G (7(e) of the Local Government Transition Act, 1993 (Act 209 of
      1993) as amended.


 5    That a copy of the finally approved amended Tariff of Charges be sent forthwith
      to the National and Provincial Treasury in terms of Section 24(3) of the Local
      Government: Municipal Finance Management Act, 2003 (Act 56 of 2003). ]
