LRWF welcomes Charles Bell, General Counsel to the California Republican Party
“All the Answers to All the Questions You Have About the Republican Party, Politics and the Law” Charles H. Bell, Jr. is senior partner of Bell, McAndrews & Hiltachk, LLP of Sacramento and Santa Monica, specializing in federal, state and local election law. He is the General Counsel to the California Republican Party (which he has represented for all but five years since 1980), is currently chairman of California Lawyers for McCain-Palin and a member of Senator McCain’s 50-member National Legal Advisory Committee. Mr. Bell has practiced political and election law exclusively since 1980. A fascinating speaker and one of the leading experts on the California Political Reform Act and federal and state election law, Mr. Bell was founding Chairman of the California Political Attorneys Association. He has provided legal advice and representation to candidates and officeholders including Governor Arnold Schwarzenegger, former Governor Pete Wilson, former Attorney General Dan Lungren, former Secretary of State Bill Jones, and former Governor George Deukmejian. He has represented all Republican governors and candidates for governor since 1982. In addition, Bell has represented the California Republican Party before the U.S. Supreme Court in two cases, California Democratic Party v. Jones (2000) and McConnell v. Federal Election Commission (2003).
President’s Message...
The Election is almost upon us and Republican Women in Contra Costa County are in high gear! Lamorinda, Blackhawk, San Ramon, Ygnacio Valley, and East Contra Costa RWF have organized an effort to man the Contra Costa County Republican Party Headquarters in Walnut Creek Monday through Friday until the election from 10 am to 4 pm each day. I would like to thank Jennifer Gartung, Becky Kolberg, Diana Rentz and Gretchen Medel representing each of these clubs for their enthusiastic support for “Operation Headquarters”. And a great big thank you to all of you who have signed up to work a shift at Republican Headquarters. We could not have done this without all of you wonderful Republican women! On September 20 and 21, Lamorinda RWF had a booth at the Lafayette Art and Wine Festival. We registered 50 plus Republicans and handed out a ton of campaign literature, bumper stickers, yard signs, etc. for the various Republican candidates in Contra Costa County and John McCain. The enthusiasm of many Festival attendees for the John and Sarah ticket was overwhelming. Our thanks to Greg Poulos, Chairman of the Contra Costa County Republican Central Committee for bringing more campaign materials to our booth on Sunday morning and to Jeff Elfont, Chairman of the John McCain Campaign in Contra Costa County who provided us with 150 more bumper stickers on Sunday after we ran out for the third time. And a great big “thank you” to our member Tracy Lloyd who pulled all of this together with a beautiful display of buttons, glasses, etc. and all of her volunteers – Deanna List, Marian Shanahan, Jacquie Cloidt, Jan Raines, Mary Chatton Brown, Kandi Kaufman, Lorraine Kaufman and Jackie Godsill. We are hoping for a good turnout and we have volunteers signed up to help out. This is the first time we have been allowed to do this at the Pleasant Hill Art and Jazz Festival. November 22 and 23 are the dates for the Northern California Federation of Republican Women Convention in Foster City. Patsy Ronat and I will be presenting our program entitled “Anatomy of a Garage Sale” during the Convention. Excellent speakers, good food, our Club will pay your $40.00 Registration Fee -- and we will car pool over and even more important, we will support our own Liz Froelich who is the President of the Northern Division, California Federation of Republican Women. Legislation Update

Here is the voter guide from our Republican Women Federated in Sacramento, and as always, vote your own conscience. See you at the polls on November 4!!!!! Proposition 1 Safe, Reliable High-Speed Passenger Train Bond Act for the 21st Century (AKA High Speed Rail) Proposition 1 is on hold do to legal troubles. The Proposition is not in the voter guide at this time and may or may not be on ballot as Proposition 1a. California Republican Party Opposes Proposition 2 –CFRW Opposes California Republican Party Opposes Treatment of Farm Animals Analysis by Angela Thompson: Proposition 2 literally threatens the safety of California’s egg industry. If Prop 2 passes, it will set back years of research and legislation which developed the current safety standards on the housing of California chickens. Proposition 3 –CFRW Opposes California Republican Party Opposes Children's Hospital Bond Act Analysis by Amy Lyons: Authorizes $980,000,000 in general obligation bonds for construction, expansion, remodeling, renovation, furnishing, and equipping of eligible children’s hospitals, including University of California general acute care hospitals. An almost identical initiative, Proposition 61, which authorized the sale of $750 million in general obligation bonds to fund children’s hospitals, passed in 2004. Unspent funds from Proposition 61 are still available, as only $403 million has been awarded to eligible hospitals Proposition 4–CFRW Supports California Republican Party Supports Waiting Period and Parental Notification before Termination of Minor’s Pregnancy Analysis by Camille Giglio: Sarah’s Law is a constitutional amendment. Sarah’s Law requires a doctor to notify a parent, or, in case of parental abuse, another adult family member of an unemancipated minor 48 hours before performing an abortion on her. It also requires a doctor to obtain the personal consent of a minor before performing the abortion and allows for court intervention if a minor is being coerced to have an abortion. California’s parental consent law, Health and Safety Code Section 12345, (passed by the California Legislature and signed by the Governor in 1987) was upheld by the California Supreme Court in 1996, but that decision was reversed in 1997, thus blocking the implementation of California’s parental consent law. Sarah’s Law is a constitutional amendment, so that its implementation cannot be blocked by California state courts. Proposition 5 –CFRW Opposes California Republican Party Opposes Nonviolent Offenders. Sentencing, Parole and Rehabilitation Analysis by Margaret Brown: It is impossible to distill every aspect of it into a discussion brief enough for our purposes. However, the most important aspects are as follows: It expands and increases funding and oversight for individualized treatment and rehabilitation programs for nonviolent drug offenders and parolees. It reduces criminal consequences of nonviolent drug offenses by mandating three-tiered probation with treatment and by providing for case dismissal and/or sealing of records after probation. It limits somewhat the court’s authority in dealing with offenders who violate probation or parole. It shortens parole for most drug offenses, including sales, and for nonviolent property crimes. It creates new divisions, boards, commissions, and reporting requirements regarding drug treatment and rehabilitation. It changes certain marijuana misdemeanors to infractions. Estimates of costs/savings vary so widely as to be almost meaningless, given the magnitude of the proposal. Costs could run over $1 billion dollars for setting up the various treatment and rehabilitation programs. These costs should be less after the initial start-up. Savings are estimated to be in the $1 billion dollar range, primarily due to the reduction of prison population and costs of incarceration. Proposition 6–CFRW Supports California Republican Party Supports Criminal Penalties and Laws. Public Safety Funding. Analysis by Gwat Bhattacharjie: This initiative would require new state spending on various criminal justice programs and increased costs for prison and parole operations. Funding would come from the General Fund, reallocating funds currently spent on Education, Health and Human Services etc. It would try juveniles 14 years and older convicted of “gang related” felonies as adults, penalize recipients of public housing with eviction if they do not submit or pass annual criminal background checks, increase penalties for several crimes – violating gang injunctions, using or possessing to sell meth, carrying loaded or concealed firearms by certain felons, eliminate bail for illegal aliens charged with violent or gang related felonies, change evidence rules to allow certain hearsay statements as evidence when witnesses are unavailable. (It requires a ¾ vote to amend, and only a majority vote to add.) (Continued on Page 5)

Proposition 7 Renewable Energy. – CFRW analysis currently pending. California Republican Party Opposes Proposition 8–CFRW Supports California Republican Party Supports Limits on Marriage (AKA Protect Marriage) Analysis by Camille Giglio: Amends the California Constitution to provide that only marriage between a man and a woman is valid or recognized in California. The measure would have no fiscal effect on state or local governments. This is because there would be no change to the manner in which marriages are currently recognized by the state. Proposition 9 –CFRW Supports California Republican Party Supports Criminal Justice System. Victims’ Rights. Parole Analysis by Margaret Brown: This measure changes some of the provisions of a previously passed proposition in several major areas relating to victim’s rights, and it also addresses changes in parole consideration for lifers. (1) It requires restitution in every case, without exception, where the victim has suffered a loss and the restitution must be made before any other fines or penalties are assessed. (2) The right to notification has been expanded. Under Proposition 9, those rights would be expanded to notify victims of all criminal proceedings, including the right to notice of a criminal’s release after arrest but before a trial. Victims would also be permitted to discuss charges with prosecutors and participate in other parts of the criminal justice process. The limit on the number of the victim’s family who could attend or testify at hearings would be removed, and a representative of the victim could attend and testify even in the victim’s absence. (3) This measure would place restrictions on the early release of criminals. It requires that prison and jail overcrowding not be a consideration in release and that the full term be served, except that constitutionally authorized “credits” (earned for good behavior or participation in certain programs) would still be accrued to reduce a sentence. In the matter of parole consideration, Proposition 9 would extend the time between parole hearings to between 3 and 15 years (instead of the current 1 and 5 years), but inmates would be able to request that the hearing date be moved up. On a somewhat unrelated subject, the definition of “safe, secure, and peaceful” schools would be expanded to include junior colleges and colleges. Proposition 10 –CFRW Opposes California Republican Party Opposes Bonds Alternative Fuel Vehicles and Renewable Energy Analysis by Edelweiss Geary: This initiative authorizes $5 Billion in bonds paid from the state’s General Fund, allocated approximately as follows: • 58% in cash payments of between $2K and $50K to purchasers of certain high fuel economy and alternative fuel vehicles • 20% in incentives for research, development and production of renewable energy technology • 11% in incentives for research and development of alternative fuel vehicle technology • 5% in incentives for purchase of renewable energy technology • 4% in grants to eight cities for education about these technologies • 3% in grants to colleges to train students in these technologies. Fiscal Impact: • State costs of about $9.8 billion over 30 years to pay both the principal $5B in addition to the interest ($4.8B) costs on the bond • Potential state costs of up to about $10M annually, through about 2018-19 for state agency administrative costs not funded by the measure. Proposition 11–CFRW Supports California Republican Party Takes No Position. Redistricting, Constitutional Amendment Analysis by Joan Clendenin: This reform takes away from politicians the power to draw their own districts and places the responsibility in the hands of a 14-person citizens commission comprised of five Democrats, 5 Republicans and 4 “independents.” The initiative also requires that district lines respect the geographic integrity of cities, counties, neighborhoods, and of communities of interest. Proposition 12–CFRW Supports California Republican Party Supports Veterans’ Bond Act of 2008 Analysis by Joan Clendenin: This measure authorizes the Department of Veterans Affairs to sell $900,000,000.00 in General Obligation Bonds and allows the Cal Vet Home Loan Program to continue to fund the purchase of homes, farms and mobile homes for California Veterans who served at least one day of active duty prior to 1977 and applied for the loan within 30 years.

Congress Tries To Fix What It Broke

Regulation: As the financial crisis spreads, denials on Capitol Hill grow more shrill. Blame an aloof President Bush, greedy Wall Street, risky capitalism — anybody but those in Congress who wrote the banking rules. Such denials won't hold against the angry facts banging on their doors. The only question is whether the guilty party can keep up the barricade until Election Day. A visibly annoyed House Speaker Nancy Pelosi rejected suggestions that Democrats share blame for the meltdown. 'No,' she snapped at reporters who dared ask. Stick to our narrative, she scolded: The bursting of the housing bubble was another story of market failure and deregulation. 'The American people are not protected from the risk-taking and the greed of these financial institutions,' she said, while calling for investigations of the industry. Only, the risk-taking was her idea — and the idea of all the other Democrats, along with a handful of Republicans, who over the past 30 years have demonized lenders as racist and passed regulation after regulation pressuring them to make more loans to unqualified borrowers in the name of diversity. They were the ones who screamed — 'REDLINING!’ — and sent banks scurrying for cover in low-income neighborhoods, where they have been forced to lower long-held industry standards for judging creditworthiness to make the subprime loans. If they don't comply, they are threatened with stiff penalties under the Community Reinvestment Act, or CRA, a law that forces banks to make home loans to people with poor credit risks. No fewer than four federal banking regulatory agencies are responsible for enforcing the law. They subject lenders to racial litmus tests and issue regular report cards, the industry's dreaded 'CRA rating.' The more branches that lenders put in poor neighborhoods, and the more loans they make there, the better their rating. Those lenders with low ratings can not only be fined, but also blocked from mergers and other business transactions needed to expand.
The regulation grew to monstrous proportions during the Clinton administration, obsessed as it was with multiculturalism. Amendments to the CRA in the mid-1990s dramatically raised the amount of home loans to otherwise unqualified low-income borrowers. The revisions also allowed for the first time the securitization of CRA-regulated loans containing subprime mortgages. The changes came as radical 'housing rights' groups led by ACORN lobbied for such loans. ACORN at the time was represented by a young public-interest lawyer in Chicago by the name of Barack Obama. HUD, in turn, pressured Fannie Mae and Freddie Mac to purchase more subprime mortgages, and Fannie and Freddie, in turn, donated to the campaigns of leading Democrats like Barney Frank and Pelosi who throttled investigations into fraud at the agencies. Soon, investment banks such as Bear Stearns were aggressively hawking the securities as ‘guaranteed.’ Wall Street's pitch was that MBSs were as safe as Treasuries, but with a higher yield. But they weren't safe. Everyone in the subprime business — from brokers to lenders to banks to investment houses — absolved themselves of responsibility for ensuring the high-risk loans were good.

The mortgage lenders didn't care, because they were going to sell the loans to other banks. The banks didn't care, because they were going to repackage the loans as MBSs. The investors and traders didn't care, because the MBSs were backed by Fannie and Freddie and their implicit government guarantees. In other words, nobody up and down the line — from the branch office on main street to the high-rise on Wall Street — analyzed the risk of such ill-advised loans. But why should they? Everybody was just doing what the regulators in Washington wanted them to do. So everybody won until everybody lost, including the minorities the government originally mandated the banks to serve. The original culprits in all this were the social engineers who compelled banks to make the bad loans. The private sector has no business conducting social experiments on behalf of government. Its business is making profit. Period. So it did what it naturally does and turned the subprime social mandate into a lucrative industry. Of course, it was a Ponzi scheme, because they weren't allowed to play by their rules. The government changed the rules for risk. In order to put low-income minorities into home loans, they were ordered to suspend lending standards that had served the banking industry well for centuries. No one wants to talk about it, so they just scapegoat Wall Street. Even John McCain has joined the Democrat chorus on this. The FBI is now investigating 24 large mortgage lenders for alleged abuses. But who will investigate the pols and the lobbyists and the community agitators who made the bad decisions that ultimately forced businesses to make their bad decisions?

Sarah Palin Is Qualified

Editorial Wall Street Journal September 10, 2008; Page A14 One rap on Sarah Palin's qualifications to be Vice President is that she governs one of our least populated states, with a budget of "only" $12 billion and 16,000 full-time state employees. On the other hand, it turns out that the Governor's office in Alaska is one of the country's most powerful. For more than two decades Thad Beyle, a political scientist at the University of North Carolina, has maintained an index of "institutional powers" in state offices. He rates governorships on potential length of service, budgetary and appointment authority, veto power and other factors. Mr. Beyle's findings for 2008 rate Alaska at 4.1 on a scale of 5. The national average is 3.5. Only four other states -- Maryland, New Jersey, New York, and West Virginia -- concentrate as much power in the Governor's office as Alaska does, and only one state (Massachusetts) concentrates more. California may be the nation's most populous state, but its Governor rates as below-average (3.2) in executive authority. This may account in part for Arnold Schwarzenegger's poor legislative track record. The lowest rating goes to Vermont (2.5), where the Governor (remember Howard Dean) is a figurehead compared to Mrs. Palin. In Alaska, the Governor has line-item veto power over the budget and can only be overridden by a three-quarters majority of the Legislature. In 1992, the year Arkansas Governor Bill Clinton was elected President, his state budget was $2 billion and among the smallest in the country. Compared to that, Sarah Palin is an executive giant.

In 2007, Lamorinda Republican Women members participated in the first grade reading program at Sequoia Elementary School in Pleasant Hill. For an hour a week, our ladies worked with these children on reading and punctuation skills.
