Chap: 108 And be it &c That every Person intending to depart or Leave this Province or territories thereof, shall publish his or her intention in writting affixed to the doore of the County-Court, where hee or shee inhabits, 30 days befor his or her departure, and shall have a pass under the County-Seal. And if any master of ship or vessell . or others, shall presume to Convey or transport any person out of this province, or territories therof, without such pass, shall pay all the damages that shall happen therby. Confirmed by chapter 154, 1684; chapter 175, 1685; chapter 186, 1688; and chapter 191, 1690. Abrogated in 1693, but accepted in Petition of Right, June 1, 1693, as chapter 55. CHAPTER 109. LAW ABOUT FAMILY INTESTATE SHARE OF ESTATE. Chap: 109 And be it &c: That Whatsoever Estate any person hath in this Province and territories therof att the time of his death, Unless it appear that an equal provision be made elsewhere shall be thus disposed of, That is to Say, One third to the wife of the party deceased, One third to the Children equally, & the other third as hee pleaseth, And in Case his wife be deceased before him, two thirds shall go ta the children equally & the other 3d be disposed of, as hee shall think fit, his debts being first payd.
