OCDF Waiver of Liability
Participation in any travel program sponsored or arranged by Our Chinese Daughters Foundation, Inc. (OCDF, OCDF China Tours, OCDF Adoption) is at your own risk. Our Chinese Daughters Foundation, Inc. assumes no liability for accidents, injuries, or illnesses associated with participation in this program. Travel to China always carries with it an element of risk and it shall be the responsibility of the participants to behave and conduct themselves in a safe manner. OCDF will act prudently on behalf of participants in scheduling events and contracting for services from China International Travel Service (CITS). However, OCDF must inform you of the risks and responsibilities associated with travel to and from and throughout China. I/we ____________________________________________________ and

_____________________________________________________________ parent(s)/adult participant(s) understand and accept that participation in an OCDF sponsored tour in China is on a voluntary basis for myself/ourselves and my/our child(ren) ____________________________________________ _____________________________________________________________ (name(s) of child(ren)). I/we carry health insurance for myself/ourselves and my/our child(ren) and accept full responsibility for costs associated with any illness or emergency treatment(s) which may result from participating in our tour to/within China. I/we do hereby waive from any liability the parties associated with the conduct of my/our tour program including employees/principals of Our Chinese Daughters Foundation, employees of China International Travel Service, independent contractors working on behalf of OCDF/CITS, and other representatives of Our Chinese Daughters Foundation in China and in the US. Signatures: Parent 1 (Adult traveler) ________________________________ Date ____________ Parent 2 ______________________________________________ Date ____________ Tour Name and/or Travel Dates: ________________________________________ ____________ I have read and accept the below information/policies of OCDF (Signature)

Your OCDF Group Tour Program Cost Includes: Airport pick-up and transfers, hotel as per tour program itinerary, meals as listed on the itinerary an daily western buffet breakfast, sightseeing and entrance fees, bilingual guides/escorts (Premium tours have escorts with Red Cross First Aid and CPR training), domestic transportation by either air/train/bus as per itinerary, evening special dinners and entertainment as per itinerary, domestic travel insurance provided by CITS, and gratuities based on tour program (luggage handlers and bellmen, tour bus drivers, guides and Chinese escort). All cultural programs for children and adults are included with special workbooks for the children keyed to each city/day and sight as well as special games. Children receive daily keepsakes for their OCDF-designed silk memory box. All participants receive t-shirt. Not Included in the Cost of Your Group Tour Program: Round-trip airfare from your home to/from China (see our travel partners at www.travnet.net for low-cost airfares & airline information), Chinese Visa processing fee, passport* application fee, travel insurance (medical and trip cancellation/interruption insurance), and your personal expenses (such as family gifts, laundry, medical expenses**, additional beverages, etc.). Programs indicated as OPTIONAL on your itinerary are at your expense. If you do not have a passport for yourself or your child that will be valid for at least six months after your travel to China, we advise you get one now rather than later. Do not delay! Chinese Consulates will not place visas into such passports. **We encourage participants to obtain medical evacuation insurance such as Medex or a plan through Travel Guard. Trip cancellation insurance is a wise decision when traveling to China, it enables you to protect your travel investment. See the insurance section of Travel Information on www.ocdf.org/tours as we have several options from which to select.

Waiver of Liability: All participants in any travel program arranged through OCDF must sign and submit to OCDF a copy of the Waiver of Liability provided. CITS maintains travel insurance for only those programs/itinerary arranged and contracted for by OCDF. Supplemental programs/tours or events not arranged by OCDF/CITS are not included in this policy. Theft of personal property from your hotel room or while traveling is not included in the CITS insurance package. It is a medical-related insurance not a personal property policy. For All Tour Programs (Group, Independent, and Customized): Deposit Requirements, Itinerary Changes and Cancellation Policy: Registration is required for all persons participating in any travel arranged by OCDF. A nonrefundable deposit of $500.00 per participant is required of all families at the time of registration who are participating in group tours, customized group tours, and individual travel exceeding 5 days in length. Registration for group tours (OCDF and Customized) is due at least 3-6 months prior to the travel dates with balance payment due 3 months prior to the travel dates unless otherwise contracted for through OCDF. Deposits are non-refundable with subsequent payments available for full refund until one month (30 days) prior to departure for the group tour program with the exception of Yangtze River Camp Cruise (no refunds available after 90 days prior to cruise program for the cruise portion of the package). Cancellations and changes to the itinerary within 30 days of program departure date (from USA) for the travel program will result in partial refund as fees must be paid to airlines and for other travel services already contracted for by CITS in China. Any change in itinerary and ticketing made by the client after the trip registration period (see deadline date for full payment) will require an additional $50.00 service fee in addition to any fees levied by OCDF for late payment, the airlines, or CITS for their reticketing service. We recommend that you obtain trip cancellation insurance through Medex as a means of protecting your deposit and travel costs in case of family emergency or conditions in China that may prohibit travel. Airline conciliations are dependent upon the individual carrier and the type of ticket purchased. OCDF makes no international airline reservations and assumes no responsibility for issuing refunds on client cancellation of international airline reservations or failure of the international airline to perform contracted services. Chinese Visas: We ask that you apply for your Chinese visa approx. 2 months prior to your tour program but not earlier than 90 days prior to departure. Contact www.mychinadocs.com to arrange your Chinese visa for travel purposes. OCDF no longer issues letter’s of invitation for travel to China since they are not required by the Chinese Embassy/Consulate in the US to obtain a visa. Be sure that your passports are valid for a period of 6 months after the date of travel when applying for your Chinese visa. Your itinerary can be printed from the www.ocdf.org/tours tour itineraries section of the website. Adoption City & Orphanage Visits Arrangements are additional to the travel program (with the exception of our Reunion Tour Programs and Explore-A-Province Tours): We use our staff at CITS to plan for you your itinerary including travel to the city, airport/train transfers, hotel accommodations, meals, local guides/interpreters, airport tax, domestic travel insurance. You will be billed the actual costs for your travel program and a normal ticketing service fee from CITS. OCDF charges a nominal fee of $50.00 to make adoption city arrangements for you. Gratuities for travel personnel and gifts for the orphanage are additional. CITS recommends that your daily gratuity for a driver be $2.00 per day per participant and the daily gratuity for your guide/interpreter be $3.00 per day per participant. Should your guide serve extensively as an interpreter you may consider providing an additional tip at your own discretion. Drivers and guides do not receive salary from the travel service except for a minimal daily stipend. Participant Responsibilities: Medical or other unexpected expenses during the trip are the responsibility of the participant. We advise all families to obtain Medex insurance coverage for medical evacuation services or another responsible provider such as Travel Guard (see insurance in the Travel Information section of this website). Use of a Chinese medical facility requires prepayment prior to the physician seeing/treating the patient, even in emergency situations. Travel to China can be difficult for those with disabilities or requiring special medical attention/services. We ask that you consult your physician prior to the tour program and obtain necessary immunization and medications. Persons requiring medicine to

be refrigerated should take caution that this may not be possible at all times in China and therefore should select the appropriate tour program to accommodate such needs. Please Note: Travel in China is demanding and rigorous for persons of all ages. Provisions are not made in China for persons with disabilities requiring wheel chairs, lifts, or similar assistance. OCDF must inform potential participants of factors facing them in China including health/safety risks. Should you require assistance in walking, climbing, or carrying of your luggage, we suggest you arrange for a personal assistant or family member to accompany you on the tour or ask OCDF to make arrangements for someone to assist you while in China. Please do not expect group members or tour leaders to provide daily assistance of this kind. Persons on restricted diets or with food allergies are asked to consider that we at OCDF and CITS are not able to control the contents of foods prepared in China in terms of food additives, oils, specific sauces, and the like. While we will make every attempt to provide a wide range of food options for all participants, we can not be responsible for individuals with uncommon allergies, dietary habits, or dislike of Chinese food. Travel to China will require the consumption of local food products and meals prepared by hotels and restaurants operating independent of OCDF and CITS. While CITS will contract for services in clean and reliable locations, decisions concerning which foods are or are not safe to consume will be each participant’s responsibility. Parents with children who are “picky eaters” should introduce a wide variety of Chinese foods to the child prior to the tour program. Should this not prove successful, families can opt to supplement meals with hotel room service off the western menu at their own expense. CITS - Our Travel Partner: To be certain we obtain the best possible services in China for our highly customized tour programs, we contract with China’s leading travel service provider: China International Travel Service (Joint-Venture Partner to American Express Travel Services in China and member of ISTA). We have our own Program Directors and Travel Planners at CITS with 17-20 years of travel experience and 6-8 years experience with OCDF and our adoption/orphanage visits to insure they are handled professionally. Whenever possible we personally select our local guides to insure you the best guide services in China – we have certain favorites in each city and have trained over 60 guides nation-wide to serve our clients. Sometimes a location has not been visited previously by one of our clients and we must rely on the recommendation/selection of local guide by the local CITS office. Tourist Shops and Commissions: OCDF China Tours makes every attempt to not include “tourist” shopping locations with two exceptions (we visit the carpet weaving factory in Beijing and the jade carving factory in Xian). We arrange with the travel service and guides in advance to not include the 3-4 stops per day required of other tours in China. The shopping we include is selected because of the quality of the products or the techniques being demonstrated for instructional purposes to the children. You are never under any obligation to purchase anything and should verify the authenticity of any item you select for purchase. As a result of not stopping at the commission shops from which the driver and guide would gain their salary, we include in the cost of your OCDF group tour program the gratuity for our bus drivers and local/national guides. Customized and Individual travelers are asked to provide a gratuity should your quotation indicate that tips/gratuities are not included. Drivers and guides in China are normally required by their tour companies to stop at commission shops in order for the travel company to gain income. Under new regulations in China, commissions for purchases at such shops may not be given to drivers and guides directly by the shop but go to the travel service and be given as taxable salary to the employee by the travel service. OCDF wishes to be sure that service personnel are paid for their time/work for us, especially since we do not engage in commission shopping. Qualified Professionals: OCDF assures you that your tour program leaders and local guides are qualified and meet licensing requirements in China. From 2002 on the Chinese government requires all guides entering tourist attractions to be licensed professionals. OCDF – Our Chinese Daughters Foundation is a non-profit Foundation in support of families with children adopted from China. We provide these annual cultural programs and travel opportunities in China because we understand the needs of adoptive families and we believe that our children must form a positive identity about being Chinese, understand the context of Chinese culture and society, and be prepared to understand what being adopted from China means – in all it’s beauty and complexity. OCDF

information is available from our website at: www.ocdf.org or through our quarterly newsletter and other publications. We provide grants to adoptive family groups who provide cultural programs for families with children from China. Please join our mailing list by contacting lynn@ocdf.org. Our organization is a registered business in the State of Illinois and our organization operates as a non-profit Foundation as it has for since December, 1995. We are registered as an IRS 501c3. Tours operated through OCDF are not tax deductible under the IRS tax guidelines unless you participate in a volunteer opportunity. OCDF Operating Expenses: A very small portion of your tour cost covers the annual expenses of the Foundation for materials in support of the tour programs, advertising/marketing expenses, t-shirts, children’s workbooks and the development of instructional materials, preparation of tour programs, and normal operating costs for the Beijing office and tour-related staff. If you have any questions about this, please don’t hesitate to ask us! Dr. Jane Liedtke is not a paid employee of Our Chinese Daughters Foundation yet donates countless hours of her time and service to these tour programs and program planning.
