1. INSTITUTIONAL MESSAGE FOR THE BEGINNING OF THE NEW YEAR
I am pleased to address you, hoping that you had happy and joyful holidays in the company of your distinguished families. I hope that 2003 will be full of success for you, your family, and all the members of your National Chapters, to whom I hope you retransmit this communication.. In the name of all AIDA Directors, I should also like to iterate our interest to cooperate in all institutional matters that you deem pertinent, in order to contribute to the study and disclosure of Insurance Law in your country and the world. Therefore, we remain yours for any needed cooperation and support for the implementation of said goal, which is AIDA’s and the National Chapter’s purpose.

2. EDITING AIDA-MAIL: DESIGNATION OF A PERSON RESPONSIBLE FOR PERIDOICALLY SENDING INFORMATION MATERIAL

As we pointed it out in Communication No. 3, we are gathering information from different National Chapters in order to shortly edit a new issue of AIDA-MAIL. Therefore, your collaboration is very important, reason why we invite you again to sent the General Secretariat information that you consider useful, for example, news regarding legislation changes; new insurance jurisprudence or doctrines; changes in the National Chapter’s directors; academic essays, congresses, forums, seminars, colloquiums, or rounds done by the National Chapter’s; announcement of new of future Congresses, etc. It should be pointed out that digital images or pictures regarding different institutional or academic activities may also be sent. Only with your collaboration and the prompt sending of information, will it be possible to edit different issues of AIDA-MAIL, which exists to internationally promote the different activities carried out by your country, that with no doubt deserves ample diffusion. Therefore, if you find it pertinent, a person of each National Chapter could be responsible of periodically sending the corresponding information to AIDA’S General Secretariat (M. MENDELOWITZ E.MAIL: mmendelowitz@blg.co.uk). If this is the case, we would be glad if you could name the responsible person and his/her e-mail address and/or fax, so that we may contact him/her. We thank you in advance for your valuable cooperation, which is fundamental for AIDA-MAIL’s success.

3. PROMPT PAYMENT OF ANNUAL SUBSCRIPTION FEE
As we had the opportunity to express it in Communication No. 3, it is highly important that all National Chapters promptly pay their annual subscription fee, which is due on January. For any inquiry or doubt regarding this issue, the Association’s Treasurer, Dr. Milagros Sanz, may be reached at the following e-mail address: seaida@terra.es The National Chapters that have financial difficulties to pay this fee, can request a reduction or, if justified, a waiver. In both cases, it is necessary to contact said Treasurer and the Presidential Council, which will examine every request in detail. What is important is that National Chapters promptly inform this situation, because otherwise the Presidential Council will have to adopt the corresponding statutory decisions, which include the National Chapter’s exclusion from the Association. Therefore, we invite you to take note of prompt payment so that the Association can keep running.

4. VIII IBERIAN-LATINAMERICAN INSURANCE LAW CILAAIDA CONGRESS: RIO DE JANEIRO, APRIL 30 – MAY 2, 2003

For its signification and important subjects, once again we promote the invitation set out by the organizers of the VIII IBERIAN-LATINAMERICAN INSURANCE LAW CILA-AIDA CONGRESS, which will be held with RIO DE JANEIRO’S special hospitality from APRIL 30 – MAY 2, 2003. This Congress will host the Presidential Council’s meeting, as well as the ones for the different Working Parties. The President and Vicepresident of AIDA’S Brazilian Chapter, Drs. Luis Felipe PELLON and Sergio Ruy Barroso DE MELLO, have indicted their interest in receiving as many member of the AIDA National Chapters as possible. For this, they have developed an excellent academic and social program. Moreover, simultaneous translation for English and Spanish is confirmed. The event organizers have extended the registration term up to February 28We are know reproducing Communication No. 1, as well as the Congress’s program:
COMMUNICATION NO. 1 "The VIII IBERIAN-LATIN AMERICAN INSURANCE LAW CONGRESS is coming soon. This is an international event that takes place every two years in a Latin language. This time, the Brazilian Chapter will be hosting and organizing the Congress at Rio de Janeiro from April 30 through May 2/2003. The presence of Members of the Presidential Council, the International Working Parties, and the legal board of FIDES and MERCOSEGUROS is confirmed. In this communication we would like to highlight that anyone that is interested in submitting articles or works on any of the six subjects of the Congress can participate. They will be included in the Congress’ memoirs for them to be presented by the author to the study groups. The documents can have a maximum extension of 10 pages, A4, single space, in Word format. They should be sent by March 1/2003 to the Brazilian Chapter by e-mail and diskette. It is essential to attach a summary of its content; maximum extension of 2 pages, in order to be read by the Group Coordinator. Apart from the International Conferences that will be presented by specialists from different countries, the Congress gives the chance to the interested parties to participate in a more effective way with their own legal thinking. Therefore, please take a look at the VIII CILA Congress program, pick a subject, and begin working on it, because you do not want to miss this opportunity. D) RULES FOR LECTURES

Each lecture will have a Chairman, who will be responsible for controlling the time of exposure and temper the debates. The lectures will take no longer than 45 minutes, and the debates 15 minutes. For controlling the time, the Chairman will be helped by receptionists, that will carry scoreboards showing the lasting time of each presentation (10, 5 and 1 minute). The questions should be written down and addressed to the Chairman, who will choose the most related to the theme to be answered by the speaker. We suggest the lectures to be presented through multimedia tools (data show), to make it more interesting for the audience. Please send your presentation in advance to the Congress Organization Committee, for equipment compatibility tests. Working Parties Each group will have a Coordinator, encharged of controlling the time of exposure and temper the debates. The reporters (who wrote the reports about the themes) will also take part

on the group. Each report will take no longer than 10 minutes, and the group meeting maximum 2 hours. The exibition time will be controlled by receptionists, that will carry scoreboards showing the lasting time from 5 to 1 minute. Because of time limitation, there will be a maximum of 5 reports for each Working Party. In case we have more than 5 reports, the Coordinator will have 15 minutes to make comments on the remaining works, and then choose the ones to be exposed by their authors. These reports should be chosen by their relation to the main theme, originality and practical contribution in solving the problems arisen. After the presentation of all reports, the Coordinator may start the debates, allowing the questions to be made, the more informal and dynamic as possible. The Coordinator should also avoid bypassing the main theme and the excess of participation, thus watching out for the Congress Rules. The reports should be presented in no more than 10 pages, size A4, in Winword format (simple space), and should be sent to the Brazilian Chapter of AIDA by or mailed, in this case, together with a disket. It is essential that all the reports come with a summary of maximum 2 pages, in order to be read by the Coordinator.

5. SETTING OF THE HOST FOR AIDA’S PRESIDENTIAL COUNCIL’S MEETING: SECOND SEMESTER 2003
Given that the VIII IBERIAN-LATINAMERICAN INSURANCE LAW CILAAIDA CONGRESS will host a Presidential Council meeting (April 30), and that this AIDA body must set a place to host its second 2003 meeting, we invite all National Chapters to inform us of its academic and institutional activities programmed for this year’s second semester. It is very important to know with enough time if any National Chapter wishes to hold a Congress, Colloquium or Round during 2003’s second half, and if it wants to be the host for the Presidential Council’s meeting. The interested Chapters please contact AIDA’S President or the General Secretariat. 6. MOTOR INSURANCE WORKING PARTY REPORT Because we consider it of interest to AIDA’S National Chapters, we are reproducing the complete report rendered by Dr. Armando ZIMOLO, President of the Motor Insurance Working Party, that contains the different activities they developed in their recent reunion in Budapest, which has held during the successful VII Insurance Law Colloquium, organized by AIDA’s Hungarian Chapter.

The 7 th AIDA lnsurance Colloquium, which took place in Budapest last November 28 and 30, hosted a meeting of the Motor lnsurance Group of the Hungarian Chapter, to which I invited those members of the International Motor lnsurance Working Group who had not been able to attend the meeting in New York. Considering the brief lapse of time separating the international congress and the Budapest colloquium, it was inappropriate to call an official meeting of the Working Group. At the Budapest meeting I illustrated the basic study on the "Normative and Management Characteristics of Motor Third Party liability lnsurance in the Word" as well as the two related reports on "Trends of compensation for Non-Pecuniary Losses in various European Countries" and "The Protection of the victim". The meeting successively focused on the features of the Guarantee Funds in various countries. The situation in Austria was analysed by the vice chairman of the Motor lnsurance Working Group Dieter Pscheidel; in France by the Secrétaire Général Adjoint du Fond de garantie Frank Lewis; in Hungary by Kocsis Káimán of Magyar Biztosítók Szövetsége; and in ltaly by myself. I also illustrated the chapter that in the basic report on the "Normative and Management Characteristics of Motor Party Liability lnsurance" specificaly dealt with this subject at an international level. As to the future activity of the International Working Group, the chairmanship has agreed that it will focus on an a widest as possible international comparison - along the lines of the "Normative and Management characteristics of Motor Third Party Liability lnsurance" - on the protection measures granted to the victims of road traffic accidents, with an analysis of the trends of compensation for bodily injuries and of the legal features aimed at protecting the weaker parties (children, pedestrians, cyclists), at implementing prevention measures and at combating insurance fraud. Thomas Hurmer of Austria will define, following the indications that myself and the vice chairmen Dieter Pscheidl and Jan Misana will provide him, a draft questionnaire that will be distributed at an international level by my Office in Rome by the end of January. lf we leave two months for the answers, we may expect to have at the next MIWG meeting a first report on the international comparison with the inclusion of nonEU countries as well. We decided in the course at New York that all Working Groups, including ours, will convene a meeting within the framework of the 8 th Cila Congress in Rio de Janeiro from next 3 to 5 May; our Group should meet May 2. For 2003, we have received an invitation to meet in mid-September (between September 16 and 20) in Romania once again, this time in Bucharest. The Paris meeting next autumn has been rescheduled for mid-February 2004. The basic study has now been concluded and after a final revision will be printed so as to be sent to all AIDA Chapters, to watchdogs and to lnsurance associations that-have taken part in the study. In New York and in Budapest, I invited - letters will be written to all - that information be sent, regarding all the legislative or market changes that take place in various countries, to my Office in Rome, which will then proceed to publish the information in the MIWG Bulletin twice a year. These changes will be included in the basic study, which will be updated and presented at the Buenos Aires Word Congress in 2006, when we will also present the final version of the international comparison on the protection of traffic accident victims, according to the criteria mentioned above.
