8-1-1: CEMETERY ESTABLISHED: The City has been maintaining Hillcrest Cemetery, and the said name of Hillcrest Cemetery is hereby formally adopted as the official name of said cemetery and the same shall, subject to any changes, additions or modifications, comprise the area described on the Official Cemetery Map on file in the office of the City Superintendent and made a part hereof by reference thereto. (Ord. 500, 1-6-44; 1987 Code) 8-1-2: SUBDIVISIONS AND PLATTING APPROVED; BURIAL: The Mayor and Council are hereby authorized to have such portions of the cemetery as they decide upon platted and subdivided as may be necessary or desirable, and the Mayor and Council are authorized to make and adopt rules and regulations for the care, maintenance and operations of the cemetery and for the opening and closing of graves and fixing prices thereof and the sale of burial permits. 8-1-3 A.

8-1-5 All burial permits shall be in the form prescribed by the Mayor and Council and obtainable from the Clerk. All such permits shall be executed by the Mayor and attested by the Clerk under the Seal of the City, and said permits when issued shall be subject to all rules and regulations for the care, maintenance and operation of the cemetery. Said burial permits or certificates when issued, paid for and delivered may be recorded in the office of the County Recorder. All applications for purchase of burial permits or burial certificates shall be made to the Clerk who shall give the person applying therefor, upon the payment of the amount established by resolution of the City Council, a certificate of burial. Any person being a permit holder or owner in said cemetery desiring to make any interment therein, shall apply to the Clerk and upon payment of the Sexton's fees, the Clerk shall deliver to the applicant a certificate to the Sexton or person in charge stating the name of the deceased, the number of the lot and block in which the deceased is or is to be interred, the cause and manner of death, the sex and national origin and wherever practical such other data as may be desirable to obtain from time to time. Provided, however, that if such permit owner of the cemetery shall have acquired such grave, lot or lots otherwise than by purchase from the City, such permit owner shall furnish to the Clerk a certificate of title or other evidence of ownership of such grave, lot or lots. No person shall be issued a permit or have a right to make an interment in the cemetery without first making application and receiving a certificate from the Clerk for the burial as in this Section provided, and the Sexton or other person or employee having charge of opening and closing graves is hereby prohibited from opening any grave or permitting an interment in said cemetery without such permit from the Clerk. 8-1-5: CEMETERY FUND: For the purpose of establishing a fund for the care, upkeep, maintenance and improvement of the cemetery, there is hereby established a fund to be known as the "Cemetery Fund" which shall be separate from all other funds of the City, said Fund to have established as apart thereof all monies, bonds or other securities now owned or held by the City for Hillcrest Cemetery, and there shall be added thereto from time to time as the same comes into the hands of the proper City official, all bequests and donations made to said Fund as well as all

funds received from the sale of lots or fractions of lots or blocks. Such Fund to be continued and added to until it has reached the principal amount of at least one hundred thousand dollars ($100,000.00). As monies, securities or other income comes into said Fund, if not already invested in interest or income-producing securities, permitted by cities to acquire and hold, then the Mayor and Council shall, from time to time, invest the same in capital improvement projects of the City, United States government bonds or bonds of the State or municipalities of the State or such other securities as the laws of the State permit cities from time to time to invest such Fund in. Transfers to the City to finance capital improvement projects shall be made by resolution of the Mayor and Council and shall be repaid with interest not later than four (4) years from the date of transfer. Interest shall be paid by the City to the Cemetery Fund at the same rate at which the bank holding the Cemetery Fund account would pay on an investment of one hundred thousand dollars ($100,000.00) for one year determined at the time of transfer. It is the express policy hereby that the income from such Fund, until the principal has reached the amount of one hundred thousand dollars ($100,000.00) to be added from time to time to the principal Fund and not spent, but under no consideration is the principal in said Fund at any time to be spent, but the Mayor and Council may in their discretion, utilize income coming to said Fund to enhance the Fund or to assist in paying maintenance, operation and improvement charges. The securities in said Fund shall be placed with the City Treasurer who shall furnish bond in the sum commensurate with the amount of said Fund in addition to all other monies that may come into his hands as said officer. It is hereby provided that the fees paid to the Clerk for opening and closing graves shall not go into or become a part of the Cemetery Fund but shall be by him deposited in the General Fund of the City to compensate the City so far as it may go in the annual maintenance, upkeep and operation of the Cemetery. (Ord. 976, 12-19-88) EMPLOYEES: The Mayor shall appoint and the Council shall confirm the appointment of Cemetery employees as shall be deemed necessary to employ in the care, maintenance and operation of the Cemetery and the Mayor and Council shall from time to time fix the compensation of such employees and prescribe their duties in such rules and regulations as the Council may adopt. (Ord. 1025,7-11-94) 8-1-7: STONE SETTING: No headstones or footstones shall be required for graves at the Hillcrest Cemetery. Should an individual wish to install headstones or footstones at the Hillcrest Cemetery, then the installation will be done in compliance with these regulations: 8-1-6:

1. Headstones shall be installed under the supervision of the Sexton in uniform manner and in line with existing stones. 2. All headstones and footstones shall be set between the hours of eight o'clock (8:00) A.M. and five o'clock (5:00) P.M., Monday through Friday, a regular City work day. 3. Headstones shall be placed upon a concrete base meeting the following specifications: a. Re-enforced concrete as approved by the Sexton. No concrete shall be poured prior to the Sexton's approval. No pre-poured bases will be allowed in the Sixth Addition. b. A single grave marker stone base must be four inches (4") thick, forty inches (40") wide and thirty inches (30") in depth. In the Sixth Addition, no less than an eight inch (8") apron is required. c. Double grave marker stone base must be a minimum of four inches (4") thick, eighty inches (80") wide, and thirty inches (30") in depth. In the Sixth Addition, no less than an eight inch (8") apron is required. An expansion joint is required when two (2) headstones abut. d. Planter holes are prohibited except on the ends of concrete bases. e. All construction of placement is to be removed by the installer and any damage to the Cemetery property, including grass, is to be repaired by the installer. f. Ashes may be buried under headstones, or where headstones shall be placed. Ashes may be buried at the foot of the grave also. B. Footstones: 1. Footstones shall be installed under the supervision of the Sexton and in a uniform manner and in line with existing stones. 2. Footstones shall be placed upon a stone base meeting the following specifications:

8-1-7 a. The stone base shall be re-enforced concrete as approved by the Sexton. No concrete shall be poured prior to the Sexton's approval. b. Planter holes are prohibited. c. Footstones' bases shall be flush with the ground, four inches (4") thick, and a maximum of forty inches (40") wide. The footstones may be no more than one-eighth of an inch (1/8") above the stone base. An eight inch (8") apron is required in all additions.

1. No plants shall be planted by individuals without the approval of the Sexton. 2. No planting is allowed in the Sixth Addition. 3. No trees or shrubbery will be permitted to grow higher than three feet (3'). 4. Only one plant or shrub on either side of a headstone will be allowed. 5. The City will not be responsible for plants, shrubs, or trees which die from any cause i.e., lack of water, chemicals or infestations. 6. Penalties: It shall be a misdemeanor punishable by a fine not to exceed one hundred dollars ($100.00) to violate any of the stone setting or planting regulations of the City. (Res. 393, 2-26-90) 8-1-8: A. TRESPASSING; PROHIBITED ACTS: It is hereby declared to be unlawful for any person to enter the enclosed portions of the cemetery except at the regular entrance gate or gates provided therefor or to tamper with any lock on any such gate or trespass in said cemetery at any time during prohibited hours or at any time when said gate is locked. The Superintendent or person in charge of the cemetery shall keep posted at the main entrance gate or gates a notice of the hours when the cemetery is open to visitors and anyone other than an employee or person officially entitled or authorized to enter said cemetery shall not be therein during any time prohibited on the notices so posted at said entrance gate or gates. It shall be unlawful for any person to mar, damage or injure any headstone, monument or marker in the cemetery or in any way to deface or commit depredation or destruction of property therein or injury to shrubs, plants and flowers. It shall be unlawful for any person except those in charge of the cemetery or authorized so to do to gather or take away any flowers from any grave or from any place in the cemetery grounds. It shall be unlawful for any person to write upon or in any manner deface or injure any monument, marker or gravestone. It shall be unlawful for any person by loud and boisterous, rude or angry conduct to disturb the peace in the cemetery grounds. It shall be unlawful for any person to drink alcoholic liquor in the cemetery or throw bottles or other rubbish therein. It shall be unlawful for any person not authorized so to do to drive any automobile, truck or other vehicle any place in the cemetery except on the driveways and roads therein.
