Dear Mr. Fenstermaker,

In accordance with R.M.C 502 and Regulation for Trial by Military Commissions 9-5, I have been tasked by the Chief Defense Counsel, Colonel Peter Masciola, USAF, to review your suspension as a qualified member of the civilian defense pool. I will be making recommendations regarding your future status with the pool to the Chief Defense Counsel once the review is complete. To refresh your recollection, on 29 August 2008 Colonel Steven David suspended you from the pool of qualified civilian defense counsel. You did not formally respond to this suspension. I would cordially invite you to provide any statement or response you may wish to have included in my review. Moreover, if you desire reinstatement to the pool of qualified civilian defense counsel, kindly resubmit an application. I direct your attention to Regulation for Trial by Military Commissions 9-5(c)(1) which outlines the application procedure. Additionally, please include a statement regarding the 29 August 2008 suspension with your application. All information will be forwarded to the Chief Defense Counsel for his review and final action. I ask that your response be returned to me by December 5, 2009. If you have questions, or if I can assist you in any way, please feel free to contact me at the contacts for me listed below.
