Adoption Donation amount: ___________________________ I as the Adopter, agree to the following conditions: 1. To give the dog proper food, water, shade and shelter at all times and veterinary treatment when necessary, including proper shots (DHLP-P shots annually and Rabies shots every three years). My treatment of the dog will be humane and loving for the rest of its life. I agree to be legally and financially responsible for the dog henceforth. I understand that CNPR places dogs only as family pets and that legal action may be taken against me if I adopt a dog for any other purpose (e.g. used as a guard dog). 2. 3. To license Dog in accordance with the laws and ordinances and to abide by the leash laws and ordinances of the municipality, county and state in which I live. 4. To ensure that Dog wears a collar and identification tags at all times. 5. To keep Dog as a house pet, to be exercised in a fenced yard or on a leash and not be allowed to roam the streets. 6. To not allow Dog to ride in the open bed of an open vehicle. I will not leave the dog unattended while it is wearing a choke-chain. 7. Not to sell, trade, or dispose of Dog in any way. If I cannot keep Dog or choose to no longer keep dog, I will return Dog to Critters in Need Pet Rescue. CNPR reserves the right to refund none or only a portion of my adoption donation, if any (at CNPR's option). Refunds: 100% during first calendar week, 50% during second calendar week. If there has been a week of Foster to Adopt, it will count as one week. _________ initials 8. If the dog becomes lost, I will notify Critters in Need Pet Rescue and follow instructions for recovering the dog. _________ initials 9. That Dog shall not be used for any medical or experimental purposes; shall not be kept chained or tied; and shall not be trained or used as an attack or guard dog. 11. That Critters in Need Pet Rescue reserves the right to approve or disapprove of training methods, trainers and training facilities. CNPR strongly recommends the use of positive reinforcement and negative punishment training methods. Negative punishment consists of stopping an undesired behavior by removing a pleasant thing or situation. CNPR strongly discourages the use of negative reinforcement and positive punishment techniques. Techniques that are expressively prohibited include and are not limited to alpha rolls, harsh "leash pops," suspending a dog (known as "hanging") for a few seconds on the end of a “check chain” and lead, forcing down with a lead, hitting or kicking dog, grabbing jowls/scruff, kneeing dog in chest for jumping, rubbing dog's noise in feces, bark-activated shock collar, dominance down, loud sounds produced by objects thrown near the dog and electric shocks produced by electric collars. If training methods are deemed unsafe, inhumane or traumatic to Dog, Critters in Need Pet Rescue may retake custody of Dog without refunding adoption donation, if any, and without recourse by me. _________ initials 12. That Critters in Need Pet Rescue reserves the right to examine and make inquiry about Dog at any time to ascertain that the above conditions are being met. Initial follow-up contact by CNPR will take place within three days of adoption, either by email, phone call or visit. If I fail to keep Dog in accordance with the terms of this Agreement, CNPR may retake custody of Dog without refunding adoption donation, and without recourse by me. Any litigation costs will be paid by myself, as well as any costs necessary to rehabilitate the dog. 13. That if Dog is not spayed or neutered before its adoption, that I will have Dog spayed or neutered as soon as possible as it is deemed safe to do so by a veterinarian. 14. That all information contained on the adoption application is true and correct. If any information contained on the adoption application is untrue, I expressly agree that

Critters in Need Pet Rescue may retake custody of Dog without refunding adoption donation, if any, and without recourse by me. 15. That the breach by myself of this Agreement would damage Critters in Need Pet Rescue in a way that could not be adequately compensated by monetary damages. The parties therefore agree that the breach or threatened breach by me of this Agreement may appropriately be restrained by an injunctive order for me to return Dog to Critters in Need Pet Rescue, granted by a court of appropriate jurisdiction. I further agrees that the actual damages that might be sustained by Critters in Need Pet Rescue by reason of the breach by Adopter of this Agreement are uncertain and would be difficult of ascertainment, and that, in addition to the injunctive relief agreed to above, the sum of $800 would be reasonable compensation for such monetary damages and attorney's fees. I hereby promise to pay, and Critters in Need Pet Rescue hereby agrees to accept, such sum as liquidated damages, and not as a penalty, in the event of such breach. 16. Though every effort has been made to ensure that this dog is a healthy, loving, pet, Critters in Need Pet Rescue cannot be liable for any injuries that the dog could inflict on any person after adoption, nor any illnesses that result after adoption. That this Agreement shall be governed and construed in accordance with the laws of the State of California; and that any disputes between the parties to this Agreement concerning the subject matter of this Agreement shall be submitted for resolution to the courts of Orange County, CA.

HOLD HARMLESS CRITTERS IN NEED PET RESCUE (AND ITS OFFICERS, BOARD OF DIRECTORS AND MEMBERS) SHALL NOT BE LIABLE TO ADOPTER ON ANY THEORY OF LEGAL LIABILITY INCLUDING THE SOLE OR CONCURRENT NEGLIGENCE OF CRITTERS IN NEED PET RESCUE (AND ITS OFFICERS, BOARD OF DIRECTORS AND MEMBERS), FOR ANY INJURY, DEATH OR DAMAGE DIRECTLY OR INDIRECTLY CAUSED BY DOG. ADOPTER DOES HEREBY RELEASE CRITTERS IN NEED PET RESCUE (AND ITS OFFICERS, BOARD OF DIRECTORS AND MEMBERS) FROM ANY AND ALL LIABILITY, CLAIMS, SUITS, DEMANDS, OR CAUSES OF ACTION WHICH MAY ARISE OUT OF OR BE BROUGHT AGAINST CRITTERS IN NEED PET RESCUE (AND/OR ITS OFFICERS, BOARD OF DIRECTORS AND MEMBERS) BY VIRTUE OF THE RELEASE OF DOG TO ADOPTER. IT IS THE EXPRESSED INTENTION OF ADOPTER AND CRITTERS IN NEED PET RESCUE THAT THE RELEASE PROVIDED FOR IN THIS PARAGRAPH IS DESIGNED AND INTENDED TO PROTECT CRITTERS IN NEED PET RESCUE (AND ITS OFFICERS, BOARD OF DIRECTORS AND MEMBERS) FROM THE CONSEQUENCES OF ANY ATTACK, BEHAVIOR OR OTHER ACTION BY DOG, AND FROM THE CONSEQUENCES OF ANY ACT OR OMISSION OR NEGLIGENCE ON THE PART OF CRITTERS IN NEED PET RESCUE (AND ITS OFFICERS, BOARD OF DIRECTORS AND MEMBERS) IN OBTAINING CUSTODY OF DOG, IN PROVIDING CARE FOR DOG, OR IN FAILING TO PROVIDE TIMELY OR ADEQUATE WARNING TO ANY PERSON CONCERNING DOG. INDEMNIFICATION ADOPTER EXPRESSLY AGREES TO DEFEND, PAY, INDEMNIFY AND HOLD HARMLESS CRITTERS IN NEED PET RESCUE (AND ITS OFFICERS, BOARD OF DIRECTORS AND MEMBERS) FROM ALL SUITS, ACTIONS, LOSSES, DAMAGES, CLAIMS, OR LIABILITY OF ANY CHARACTER, TYPE OR DESCRIPTION, INCLUDING WITHOUT LIMITING THE GENERALITY OF THE FOREGOING ALL EXPENSES OF LITIGATION, COURT COSTS, AND ATTORNEY'S FEES FOR INJURY OR DEATH TO ANY PERSON, OR INJURY TO ANY PROPERTY, RECEIVED OR SUSTAINED BY ANY PERSON OR PERSONS OR PROPERTY, ARISING OUT OF OR OCCASIONED BY, DIRECTLY OR INDIRECTLY, THE RELEASE OF DOG TO ADOPTER. IT IS THE EXPRESSED INTENTION OF ADOPTER, AND CRITTERS IN NEED PET RESCUE THAT THE INDEMNITY PROVIDED FOR IN THIS PARAGRAPH IS DESIGNED AND INTENDED TO PROTECT CRITTERS IN NEED PET RESCUE (AND ITS OFFICERS, BOARD OF DIRECTORS AND MEMBERS) FROM THE CONSEQUENCES OF ANY ATTACK, BEHAVIOR OR OTHER ACTION BY DOG, AND FROM THE CONSEQUENCES OF ANY ACT OR OMISSION OR NEGLIGENCE ON THE PART OF CNPR OR CRITTERS IN NEED PET RESCUE IN OBTAINING CUSTODY OF DOG, IN PROVIDING CARE FOR DOG, OR IN FAILING TO PROVIDE TIMELY OR ADEQUATE WARNING TO ANY PERSON CONCERNING DOG. NO WARRANTIES OR REPRESENTATIONS ADOPTER UNDERSTANDS THAT CRITTERS IN NEED PET RESCUE MAKE NO WARRANTIES (EXPRESS OR IMPLIED) OR REPRESENTATIONS AS TO THE HEALTH, FITNESS, DEMEANOR OR WELL-BEING OF DOG. ADOPTER ACCEPTS DOG "AS IS." BECAUSE OF THIS, ADOPTER UNDERSTANDS THAT CRITTERS IN NEED PET RESCUE (AND ITS OFFICERS, BOARD OF DIRECTORS AND MEMBERS) ACCEPT NO RESPONSIBILITY IF DOG SHOULD DIE AFTER BEING RELEASED TO ADOPTER OR SHOULD BITE, SCRATCH, INJURE, OR CAUSE THE DEATH OF ANY PERSON OR ANIMAL OR CAUSE DAMAGE TO PROPERTY AFTER BEING RELEASED INTO ADOPTER'S CUSTODY. ADOPTER WILL BE INFORMED BY CRITTERS IN NEED PET RESCUE OF ANY SPECIAL NEEDS OR HEALTH ISSUES KNOWN AT THE TIME OF ADOPTION.

Under no circumstances will I relinquish the dog to any third party without the expressed written consent of Critters in Need Pet Rescue under the penalty of civil prosecution. New owners will be required to undergo the same adoption process and approval. Also, I agree to contact CNPR immediately should it become necessary to find a new home for the dog regardless of the circumstances. _________ initials I have read and understand the above conditions to the adoption contract and agree to them in their entirety.
