                                         TERMS AND CONDITIONS

In making this application, the undersigned (“Applicant”) agrees to the following terms and
conditions (the “Terms and Conditions”):

1.      Applicant represents and warrants that all information provided in support of this
commercial tenant application and in response to any future requests by _________________
[Instructions: Insert the Landlord’s name] (“Landlord”) for the purpose of determining
whether Applicant is fit to be a tenant at Landlord’s premises. Applicant authorizes Landlord to
fully investigate all references and information provided by Applicant.

2.     Where Applicant is a corporation, association or limited liability company, Applicant’s
guarantor (the Guarantor”) agrees to these Terms and Conditions and personally guarantees
Applicant’s performance under the Lease. The guarantee is a material part of this application.

3.      Applicant authorizes: (a) Landlord to fully investigate all references and information
provided, as well as the credit of both Applicant the Guarantor, if applicable; and (b) those with
information about Applicant’s or Guarantor’s credit to disclose all such information to Landlord.
Applicant releases and discharges Landlord and those who provide such information from any
claims, causes of action, or damages that allegedly result.

4.     Applicant consents to allow Landlord to contact previous landlords to obtain Applicant’s
tenancy information. Applicant releases and discharges Landlord and those who provide such
information from any claims, causes of action, or damages that allegedly result.

5.      These Terms and Conditions constitute the entire agreement between the parties hereto
with respect to the specific subject matter hereof and supersedes all prior agreements or
understandings of any kind with respect to the specific subject matter hereof. In the event that
any provision or part of these Terms and Conditions is deemed void or invalid by a court of
competent jurisdiction, the remaining provisions or parts shall be and remain in full force and
effect. Any and all additions, deletions, or modification to these Terms and Conditions must be
in writing and signed by the parties or it shall have no effect and shall be void. These Terms and
Conditions shall be binding upon and shall inure to the benefit of the respective successors,
licensees and/or assigns of the parties hereto. Notwithstanding the foregoing, Applicant agrees
to notify Landlord, via certified mail, within __________ (___) [Instructions: Insert the

agents.

6.     These Terms and Conditions shall be governed in accordance with the laws of the State
