									                           EMPLOYMENT AGREEMENT
                     FOR INTERIM SUPERINTENDENT SERVICES


                        LUTHER BURBANK SCHOOL DISTRICT
                                     AND
                              RICHARD RODRIGUEZ


This Employment Agreement is made by and between the Governing Board of and
on behalf of the Luther Burbank School District of Santa Clara County, California,
(hereinafter “District”) and Richard Rodriguez (hereinafter “Interim Superintendent”), and
is effective as of the 1st day of May 2014.

District hereby employs Richard Rodriguez as Interim Superintendent of Luther
Burbank School District subject to the terms and conditions described below:

       1. Term
       District hereby employs Interim Superintendent for a temporary period beginning
       on the 1st day of May 2014 and terminated as indicated below.

       The term of the Interim Superintendent shall cease and shall be mutually
       terminated at the end of the workday immediately preceding the first workday of
       the permanent superintendent or upon termination of this agreement as set forth in
       Paragraph 5 below.

       2. Compensation
       Interim Superintendent shall be compensated the daily rate of Seven Hundred twenty-
       five dollars ($725.00), for each day of Interim Superintendent services actually rendered
       to the District, less ordinary withholding. Inasmuch as Interim Superintendent is a STRS
       retiree, this agreement and the amount of earnable compensation shall be subject to STRS
       rules.

       3. Superintendent and Board Responsibilities
       The Interim Superintendent shall be the chief executive officer of the governing
       board. The Interim Superintendent shall perform the duties as prescribed by law
       and Board Policy. The Interim Superintendent shall have charge of, and
       responsibility and accountability for, the organization and administration of the
       District, under the direction of the Board of Trustees. He shall serve as the Chief
       Executive Officer and Secretary of the Board, in charge of the educational, personnel,
       logistical and financial matters and all other systems that support administrative
       and operations.

       4. Expense Reimbursement/Travel Allowance
       Interim Superintendent shall be reimbursed for all expenses authorized by the
       District Board of Trustees that are incurred on behalf of the District, upon proper
       submission and approval of expense receipts and reports. During the term of this
       Agreement, the District shall provide the Interim Superintendent an automobile
       allowance of two hundred and fifty dollars ($250.00) per month. The Interim
       Superintendent shall insure, maintain, and pay all operating costs of his automobile at his
       own expense.



       5. Termination
       This Agreement may be terminated at any time with or without cause upon written
       notice to Interim Superintendent by the President of the District Board of Trustees.

       6. General Provisions

              a. Governing Law: This Agreement, and the rights and obligations of the
              parties, shall be governed by and construed in accordance with the laws of
              the State of California.

              b. Entire Agreement: This Agreement contains the entire agreement and
              understanding between the parties. There are no oral understandings, terms
              or conditions, and neither party has relied upon any representation, express
              or implied, not contained in this Agreement. This Agreement may be
              modified only by an amendment in writing that has been signed by both
              parties.

              c. Severability: If any provision of this Agreement is held to be invalid or
              unenforceable by a court of competent jurisdiction, the remaining provisions
              of the Agreement shall continue in full force and effect.

ACCEPTANCE OF OFFER
I hereby accept the above offer of employment and agree to comply with the terms and
conditions thereof, and to fulfill all of the duties of Interim Superintendent and Secretary to
the Governing Board of the Luther Burbank School District during the term specified in the
forgoing employment contract.
