Consumer Protection: Marketing and Advertising
in a New Regulatory Era

This full day conference will feature presentations on consumer protection from
government officials, legal experts, as well as retailers with day to day involvement in
marketing and promotions. Attendees will leave the event with a clear understanding
of the impact these changes will have on consumer relations and what policies they
need to put in place to ensure compliance.

The day will outline and discuss:
The Unfair Commercial Practices Directive (UCPD)
• The UCPD will come into effect April 2008 replacing key parts of the Consumer Protection Act and the Trade
  Descriptions Act. It aims to protect consumers and will introduce a general duty not to trade unfairly. Breaching
  these new regulations can mean both criminal and civil sanctions.
• Speakers in this session will set out the new UK regulations when implementing the Directive and provide
  guidance on reviewing internal policies to ensure compliance.

Advertising, Pricing and Promotions
• The new prices ‘code’ offers retailers guidance on how to price and promote goods.
• The speakers will explain the guidance and how to draft terms and conditions as well as identify the
  opportunities the new ‘code’ presents.

Retail Enforcement Pilot
• The Better Regulation Executive is rolling out the Retail Enforcement Pilot to a range of authorities nationwide
  during 2007/08. This aims to lead to better co-ordination and fewer burdens of inspections whilst enforcing
  consumer and employee protection.
• The speaker in this session will talk through the impact of the pilot for retailers.

• The regulatory Enforcement and Sanctions Bill establishes the Local Better Regulation Office (LBRO) and
  introduces administrative penalties. It is anticipated that the Bill will come into force summer 2008.
• This session will feature presentations outlining the work of the LBRO, how the primary authority principle
  will operate, what it means for retailers and what the regulatory penalties are for non-compliance.

Challenges for Retailers
• The final session will feature a discussion led by retailers who will share their experiences and views on how
  these regulatory changes will impact on businesses, what the main priorities need to be and how they might
  respond. It will offer an insight on how retailers are changing their policies and also offer discussion points for
  best practice.
