        Minutes of the Meeting of the Todd County Board of Commissioners held on
                                       April 16, 2013
                                            Call to Order
The Todd County Board of Commissioners met in the Commissioner’s Board Room in the City of Long
Prairie, MN on the 16th day of April, 2013 at 9:00 AM. The meeting was called to order by Chairperson
Neumann. The meeting was opened with the Pledge of Allegiance. All members present.
                                        Approval of Agenda
On motion by Kneisl and second by Blessing, the following motion was introduced and adopted by
unanimous vote: To approve the agenda with the following additions:
       1.      Add - Public Works Resolution for State Transportation Fund
       2.      Add - Temporary Part Time Temporary Hire in Auditor Treasurer Office
                                          Routine Business
On motion by Blessing and second by Kircher, the following motion was introduced and adopted by
unanimous vote. To approve the April 2, 2013 Minutes as read.

On motion by Blessing and second by Kneisl, the following motion was introduced and adopted by
unanimous vote: To approve Commissioner Warrant numbers 34035 thru 34161 in the amount of
$175,620.72 for payment on April 19, 2013.

On motion by Kircher and second by Kneisl, the following motion was introduced and adopted by
unanimous vote: To approve a 6 month On & Off Sale 3.2 Malt Liquor license for T. Rose Inc,
dba/Linwood Resort from May 1, 2013 thru October 31, 2013

On motion by Blessing and second by Erickson, the following motion was introduced and adopted by
unanimous vote: To approve a 4 month On Sale 3.2 Malt Liquor license for the Staples Softball
Association, from May1, 2013 thru August 31, 2013.

On motion by Kircher and second by Kneisl, the following motion was introduced and adopted by
unanimous vote: To approve designation the Week of May 19 - 25, 2013 as Emergency Medical Services
Week.
                                     Todd County Public Works
On motion by Kircher and second by Blessing, the following resolution was introduced and adopted by
unanimous vote:
        REQUEST FOR THE STATE OF MINNESOTA TO TAKE RESPONSIBILITY AND
                 FUND ALL LOCAL TRANSPORTATION INFRASTRUCTURE
WHEREAS, Minnesota Counties have had to rely increasingly on the property tax to maintain roads and
bridges on their State Aid and County System; and
WHEREAS, the annual funding gap for counties has resulted in deferring basic maintenance, delaying
expansion projects with resulting safety concerns, mounting congestion, and missed economic growth for
businesses and commuters; and

WHEREAS, the rural road networks in the state should be adequate to bring goods to market; and
WHEREAS, transportation funding comes primarily from user fees and are constitutionally dedicated to
transportation purposes; and
WHEREAS, the proposed local wheelage fee and local option sales tax for transportation would put the
burden on local county boards to implement a much needed increase in transportation funding; and
WHEREAS, a comprehensive transportation solution provided the State should include funding for all
roads, bridges and transit, and address the varying needs in different parts of the state.
NOW, THEREFORE BE IT RESOLVED, that the Todd County Board of Commissioners request the
State of Minnesota to take responsibility and properly fund county transportation infrastructure.
                                      Todd County Transfer Station
Recognition was given to Gary Schnell for the years of services of 11 years and 4 months of employment
at the Solid Waste Department.

On motion by Kneisl and second by Erickson, the following resolution was introduced and adopted by
unanimous vote: To allow the Solid Waste Department to hire a tempory (summer)employee to assist
with transfer station operations and Waive the 90 day period before advertising to hire to replace Gary
Schnell's Position.

On motion by Kneisl and second by Kircher, the following motion was introduced and adopted by
unanimous vote: To approve contract extending Household Hazardous Waste Services between Crow
Wing and Todd County. (Contract on file in the Administration Office).
                                  Todd County Child Protection Team
On motion by Blessing and second by Erickson, the following resolution was introduced and adopted by
unanimous vote:
                           CHILD ABUSE PREVENTION PROCLAMATION
 WHEREAS, child abuse prevention is a community problem and finding solutions depends on
involvement among people throughout the community;
WHEREAS, the effects of child abuse are felt by whole communities and need to be addressed by the
entire community;
WHEREAS, effective child abuse prevention succeeds because of partnerships created between parents,
practitioners, schools, faith communities, health care organizations, law enforcement agencies, and the
business community;
WHEREAS, family-serving, youth focused prevention programs offer positive alternatives for young
people and encourage parents and youth to develop strong ties to their communities;
WHEREAS, all citizens need to be more aware of child abuse and neglect and its prevention within the
community, and be involved in supporting parents to raise their children in a safe, nurturing society;
NOW, THEREFORE, WE, The Todd County Board of Commissioners, hereby proclaim April as Child
Abuse Prevention Month in the County of Todd and call upon all citizens, community agencies, religious
organizations, medical facilities, and businesses to increase their participation in efforts to prevent child
abuse.
The Blue Ribbon Award was presented to the Todd County Protection Team for their excellent service.

                                             Hands of Hope
On a motion by Kneisl and second by Kircher, the following resolution was introduced and adopted by
unanimous vote:
                    NATIONAL CRIME VICTIM’S RIGHTS WEEK PROCLAMATION
WHEREAS, A just society acknowledges crime’s impact on individuals, families, and communities by
ensuring that rights, resources, and services are available to help rebuild lives, and;
WHEREAS, Hands of Hope Resource Center serviced 144 victims of General Crime in the year 2012,
ranging from burglaries, theft, motor vehicle theft, terroristic threats and harassment, vandalism, arson,
robbery, and homicide, and;
WHEREAS, Victim’s rights are a critical foundation for our system of justice in America, and;
WHEREAS, Too many victims are still not able to realize the hope and promise of their rights,
protections and services, and
WHEREAS, America recognizes that we make our homes, neighborhoods, and communities safer and
stronger by serving victims of crime and ensuring justice for all, and;
WHEREAS, our nation must strive to protect, expand, and observe crime victims’ rights so that there
truly is justice for victims, and;
NOW, THEREFORE BE IT RESOLVED, that Todd County and the Board of Commissioners proclaim
the week of April 21-27, 2013, to be National Crime Victims’ Rights week that we continue to reach for
justice and compassion for crime victims as individuals, as communities, and as a nation dedicated to
justice for all.
                                          Sheriff’s Department
On a motion by Kneisl and second by Blessing, the following resolution was introduced and adopted by
unanimous vote:
                                2013 BOAT AND WATER GRANT
WHEREAS, Todd County Sheriff Peter J. Mikkelson, has submitted the 2013 Boat and Water Safety
Grant to the Todd County Board of Commissioners, and;
WHEREAS, in this Safety Grant it awards the amount of $8,641.00 to the Todd County for Boat and
Water Safety, and
THEREFORE BE IT RESOLVED, the Todd County Board of Commissioners accept the 2013 Boat and
Water Safety Grant and authorize Sheriff Peter J. Mikkelson to carry out the conditions of the grant.
                                        Todd County Ditch & Ag
On a motion by Kneisl and second by Kircher, the following resolution was introduced and adopted by
unanimous vote:
    COUNTY DITCH 7 – APPROVE FINDINGS REGARDING 1915 EXTENSION PETITION
WHEREAS, the establishment of CD7 was approved in July 1905, CD26 was approved in April 1915,
and CD35 was approved in June 1916. Both CD26 and CD35 use CD7 as their outlet, and;
WHEREAS, while doing records modernization, a petition was found dated December 6, 1915 that stated
the ditch had become obstructed by a large amount of sedimentation that was caused by the construction
of CD26 in 1915. The petition requested the ditch to be cleaned from the intersection of CD26 and to
extend the original ditch for a combined distance of 4,800 feet, and;

WHEREAS, an Engineer was appointed to provide a survey and profile. The Engineer’s report was filed
for the Repair & Extension of CD7. May of 1916 a public hearing was held to determine the necessity of
such repairs. We have no documentation regarding the outcome of the May 1916 hearing, and;
WHEREAS, there is no official approval by the Ditch Authority. There is no Viewer’s Report giving
benefits to the extension area. There is an Engineer’s report that has charges of $62.00 for two days for
the Engineer and one day for two men believed to be laborers. Two days would not be enough time to dig
4,800 feet of ditch but would probably have been enough time to clean out sedimentation at the junction
of CD7 and CD26. The design does not match the meandering course of the stream which looks like a
natural waterway. There are no recorded assessments to CD7, CD26, or CD35 after the initial assessment
for building the original ditches.
NOW, THEREFORE BE IT RESOLVED, the Todd County Ditch Authority approves the findings of the
CDI and recognizes the location of the original ditch from the petition in July 1905 as the official and
correct location of County Ditch 7, and the Extension Petition from December 1915 will be considered
“Unapproved”.
                                     Renovation Committee Update
Contegrity Group and Studio E were present to report on the progress on the renovation of the Annexes.
An update was given on the new location of the elevator to be moved to the east side of the building.
Commissioners agreed with new location. The Renovation Budget Report was given by Earl and Travis
Fuechtmann from Contregrity Group. Budget addendums will be sent out for new bids on concrete and
excavation. Project completion is expected at late summer or early fall.
                                           Auditor-Treasurer
On motion by Kneisl and second by Kircher, the following resolution was introduced and adopted by
unanimous vote:
           A RESOLUTION TO REVISE NO. 4 OF THE CREDIT CARD POLICY 2010.011
WHEREAS, The Credit card policy 2010.011-County Credit Cards states that Public Health, Social
Services and the Sheriff’s Departments shall have credit cards issued to the department; and these cards
will still be stored and checked out from the Auditor-Treasurer’s Office.; and
WHEREAS, after meeting with the staff from these Departments, we have decided for accounting
purposes and creating a better path to pay the Credit Card bill on time, the cards will be checked out from
the Sheriff’s, Social Services and Public Health Departments and the policy revised.
NOW, THEREFORE BE IT RESOLVED, that No.4. of the Credit card policy 2010.011-County Credit
Cards, will read as follows: Public Health, Social Services and the Sheriff’s Departments shall have
cards, stored and made available for the employees to use and check out in the appropriate Departments
with a $500 purchase limit. All other Departments can check out a $500 purchase limit card for use from
the Auditor-Treasurers Department. Anything over the $500 purchase per day will have to check out a
card from the Administration Office or the Department Head if they have one.

On motion by Blessing and second by Erickson, the following resolution was introduced and adopted by
unanimous vote:
             APPROVAL OF THE TRAILS ASSISTANCE PROGRAM FUNDING
                           FOR FISCAL YEARS 2013 THROUGH 2017

WHEREAS, The Todd County Trails Association provides snowmobile trails to meet Todd County’s
winter recreational needs, and;
WHEREAS, the State of Minnesota offers funding of such trails through its Trails Assistance Program,
and;
WHEREAS, Todd County will act as legal sponsor for an application for the DNR Snowmobile Trails
Assistance program, and;
WHEREAS, Todd County may enter into an agreement with the State of Minnesota for the specific grant
program, and;
WHEREAS, Todd County will comply with all applicable laws and regulations as stated in the
agreement, and;
WHEREAS, The County Auditor-Treasurer will act as a fiscal agent on behalf of Todd County and;
NOW, THEREFORE BE IT RESOLVED, that the Todd County Board of Commissioners, Long Prairie,
Minnesota do here approve the application and proposal of the Todd County Trails Association for a Five
(5) year period, fiscal years 2013 through 2018, and authorizes the County Board Chair and Auditor-
Treasurer to sign all necessary forms and agreements to participate in the program.

The Health & Human Resources 2013 Amended Budget request was tabled until the next
Commissioner’s Meeting when more information is available.

On motion by Kneisl and second by Blessing the following motion was introduced and adopted by
unanimous vote: To approve the temporary hire, of a maximum of 20 hours a week for the Auditor-
Treasurers office at an hourly rate of $13.506 (step 1 of grade 16).

First Sergeant Jake Kuhne, from Reserve Unit of Civil Affairs reported on last year’s training in Todd
County and an update for future events.
                                        Commissioner’s Report
Mark Blessing announced there will be a Township Meeting in Browerville Thursday 4/18/2013 at 12:30
pm.

Randy Neumann announced that there will be a District Meeting April 29, 2013 at Todd Field at 7:00 pm
in the Departure Facility.

Gentlemen:

The Todd County Board of Commissioners is asking you to pursue Grant Funds to restore Hanford Lake. It
would be a tremendous asset to Todd County, JD 2, Osakis Lake, and ultimately, the Sauk River and beyond.
We are aware of the coming regulations regarding the TMDL of streams and this would help improve water
quality entering the Mississippi.

Because the Douglas County NRCS has Grant money available to entice property owners to allow the Hanford
Lake restoration, we know the NRCS is limited by law as to how much they can pay to enroll landowners.

The SRWD has a fantastic history of preserving our water quality, and our Board has always been supportive of
your work. Teaming up with the NRCS to sweeten the pot will help to make this happen.

Additionally, Legacy Funds are more likely to be awarded when successful water projects such as this are
completed. Our Board unanimously requests your support of this fine project.

                  RESOLUTION FOR A SPECIAL PUBLIC LAND AUCTION OF A
                  TAX-FORFEITED PARCEL IN THE CITY OF BROWERVILLE

WHEREAS: Parcel 30-0018300, being the West 31 feet, 9 inches of the East 57 feet, 5 inches of Lots 1,
2 & 3 of Block 13 in Original Townsite of Browerville, has forfeited to the State for nonpayment of taxes.
This parcel has been reappraised and classified as provided by M.S. 282.01, and will be offered for sale
by the Todd County Auditor/Treasurer at a public auction. Said land auction will commence at 10:00
A.M. on the 30th day of May 2013. The Todd County Auditor/Treasurer is hereby directed to publish a
notice of a special land auction as provided by law.

BE IT RESOLVED, that the terms of sale are as follows:
 All property is sold for cash only, full payment is due on the date of sale;
 A charge of $25.00 will be made for each State Deed issued;
 A charge of $46.00 will be made to record the State Deed;
 State Deed Tax on the amount of purchase will be collected (0.0033 x purchase price); and
 a 3% Assurance Fund charge will be made (as per Minnesota Statutes 284.28, Subd. 8).

BE IT FURTHER RESOLVED, that Parcel 30-0018300 will be offered for sale subject to liens,
existing roads, easements and leases, if any, and any special assessments canceled at forfeiture may be
reassessed by the municipalities after the sale.

BE IT FURTHER RESOLVED, that the right is reserved by Todd County, in the interest of the public,
to cancel this sale at any time prior to its sale.

          (MCIT) IS A JOINT POWERS ENTITY MADE UP OF COUNTIES AND ASSOCIATED PUBLIC ENTITIES THAT POOL

EFFECTS OF WORKERS’ COMPENSATION CLAIMS

    The frequency and severity of work-related injuries and illnesses is used to develop each member’s
    experience modification (MOD) factor. This unique factor then becomes part of the formula to
    determine a member’s annual workers’ compensation contribution. Another factor affecting the
    formula is the amount of payroll in each of the member’s employee class codes. A MOD factor of 1.0
    does not change contribution and reflects expected claim development. A factor greater than 1.0
    can increase the contribution, whereas a factor less than 1.0 can decrease contribution.

                          The program offers access to professional counselors for support and advice on

SUCCESSFUL TODAY, SUSTAINABLE FOR TOMORROW

 During 2012, members reaped the benefits of participation in MCIT. There were
 the obvious benchmarks of success, such as the announcement of another
 significant return of fund balance to members and the downward trend in
 property, casualty and workers’ compensation rates. Less obvious, but equally
 important, were the proactive efforts of members to seek out and implement risk
 management and loss control advice to control exposures better and MCIT’s
 ability to respond to these needs.

 Working together, the board, staff, service providers and members demonstrated
 they aspire to a standard of performance that ensures the ongoing financial
 success of MCIT.

WHEREAS, The Todd County Board comprises the Health and Human Services Committee and
approves the actions of the HHS Committee at a following regular County Board meeting , and;

WHEREAS, there are opportunities for time and cost efficiencies to change to one HHS Committee
meeting per month, and;

WHEREAS, claims or other HHS business matters may be brought to a regular County Board meeting
when meeting dates provide for improved timeliness, and;

2013 Todd County has printed the HHS minutes and we have discovered that there has not been anything
budgeted for printing costs. The approx. cost per month is $600the first six months and $300 after July 1, 2013 if
the HHS board meets only once a month.
