Driving Policy
This Cell Phone Use While Driving Policy restricts employee use of cell phones while
driving a vehicle, especially if the cell phone or vehicle is provided by the company. A
growing number of jurisdictions are outlawing the use of cell phones while driving and
this policy may help limit a company’s liability in connection with traffic accidents or
traffic citations resulting from employee cell phone use while driving. This policy is ideal
for small businesses that want to restrict employee cell phone use while operating a
motor vehicle.
                      CELL PHONE USE WHILE DRIVING POLICY

We at __________________________ [Instructions: Insert the Company’s name] (hereinafter
referred to as the “Company”) have established this Cell Phone Use While Driving Policy to
provide formal guidance to employees regarding Company’s position with respect to employees
use of a cell phone while driving.

1.      The Company deeply values the safety and well-being of its employees and is committed
to eliminating unnecessary risks behind the wheel. Due to the increasing number of accidents
resulting from the use of cellular telephones and mobile electronic devices (each a “Device”)
while driving, Company employees may not use any Device for any purpose, including, without
limitation, answering or making phone calls, engaging in phone conversations, reading or
responding to emails, instant messages or text messages, listening to voice messages, using
applications, using GPS navigation, using social media, playing games, or browsing the internet,
while operating a motor vehicle (“Vehicle”), regardless of whether the Vehicle is in motion or
stopped at a traffic light or stop sign, under any of the following situations, regardless of whether
the Device is used hands-free:

                 When employee is operating a Vehicle owned, leased or rented by the Company.
                 When the employee is operating a Vehicle in connection with Company business.
                 When the employee is operating a Vehicle during Company work hours.
                 When the Vehicle is on Company property.
                 When the Device is owned, leased or rented by Company.
                 When the employee is using the Device to conduct Company business.
                 When federal, state, or local rules and regulations prohibit use of the Device.

Should the employees need to use the Device while operating the motor vehicle, the employee
must pull off to the side of the road and safely stop the vehicle before using the Device.

2.     Frequent violation of this policy will be grounds for discipline, up to and including
termination from Company.

3.      All employees agree to indemnify and hold Company harmless for any harm caused by or
related to their use of a Device while operating a Vehicle.
