					RESPONSE TO THE A.S.A RULING ON TETLEY GREEN TEA TV ADVERTISING – 3 JUNE 2009

Although we are glad that the Advertising Standards Authority has ruled that our ad
did not breach the Advertising Standards Code by implying that green tea is a
replacement for exercise, we are disappointed by their final adjudication.

Only four viewers from over 45 million complained about the TV ad, showing that
almost everyone had no issue with our message that drinking green tea can be good
for health as it contains antioxidants.

We ensured that we did not present green tea as a replacement for exercise, but
simply as part of a healthy lifestyle. Indeed, for much of the ad, the words “as part of
a healthy diet and lifestyle” appear on screen, supporting our position that diet and
exercise are equally important.

We were surprised that the ASA felt the need to investigate the ad beyond the
complaints of the viewers, and given the amount of scientific evidence suggesting
that green tea can be good for health, we challenge their conclusions and are
disappointed by their final adjudication.

Gordon Hayburn, Director of Compliance at Tetley says, “The European Food Safety
Authority (EFSA) Scientific Panel on Health and Nutrition Claims is currently
reviewing very detailed scientific dossiers on the health benefits of anti-oxidants in a
wide range of foods and it is inappropriate for the ASA to comment on health
benefits at this time.

“It is also important to note that almost every health professional acknowledges the
importance of antioxidants in the diet and that those from tea, in addition to those
from fruit and vegetables, can all play an important part of a healthy diet.

“In addition we feel that the ASA are straying into the area of food law enforcement
which is not within their remit nor area of expertise.

“This is too important an issue to ignore and, as a responsible business, we want to
assure our consumers of our continued attention to producing safe, high quality
products that are both great tasting and good for you.”
