7. Describe the control measures that will be implemented to achieve water quality standards and effluent limits. If proposing to utilize a treatment process, provide a detailed description of the treatment process, including, but not limited to: Water quality analyses demonstrating the effluent quality before and after treatment; waste stream volumes and planned method of disposal; aquatic life toxicity data for any chemicals being used in the treatment process; description of how the chemicals will be handled at the facility and the potential for any impacts to waters of the state in the event of a spill; and diagrams of the facility indicating the water treatment path. For all category I discharges (on-channel discharges, not requiring stormwater runoff containment), provide a plan for monitoring all identified constriction points and applicable channel stability monitoring points. For any constriction points which are being mitigated in association with BLM requirements, this requirement does not apply. 12. If proposing to utilize containment as part of a water management plan for this proposed facility, attach a water balance describing all inputs and outputs to the containment units. Also, complete Table 3 (reservoir information) and Table 4 (reservoir bonding details). If proposing discharge into any type of Category II containment unit, the water balance must demonstrate ability to contain all estimated discharge, in addition to stormwater runoff equivalent to a 50 year, 24 hour precipitation event. 13. Attach the results of a water analysis from each of the targeted coal seams, for all water quality parameters listed below. The representative sample(s) must be collected from within a 20 mile radius of the proposed facility, from the same coal seams being proposed for development at the proposed facility. The water analysis results must be submitted in the form of a legible, signed copy of a laboratory analysis sheet. The submitted lab sheet(s) must: use the same parameter units listed below; list the approved EPA test procedures used in the analyses (40 CFR 136 or 40 CFR 136.5); identify the legal location of the sampled discharge; identify the coal seam(s) represented in the sampled discharge; identify the sample date and analysis date of the discharge. Samples from co-mingled coal seams are acceptable as long as the sample(s) meet the following criteria: A. all of the coal seams being proposed for development are represented in the co-mingled sample, with no contribution from coal seams not being proposed for development at the facility. B. the ratio of each coal seam’s contribution is approximately the same in the sample and the proposed development, C. documentation is provided to verify the criteria listed in A. and B.

NOI SUBMISSION INSTRUCTIONS 1. Please provide as much information as possible on the NOI application form. Additional spaces may be inserted in the application form to accommodate additional information. Please keep attachments to a minimum. 2. Do NOT separate any portion of the application, including the following tables. All supplemental information should be attached following the permit application. Use of cover sheets should be restricted to supplemental information ONLY. 3. Do not staple or bind any of the NOI application materials. Only binder clips or paper clips should be used to separate or bind materials. 4. While the WDEQ allows permittees to reference previously completed works, please ascertain that the item being referenced is available to DEQ personnel for review during the NOIapplication process. DEQ personnel may request copies of referenced works if not available for review. Information easily incorporated into the NOI application may not be referenced (for example, the names and addresses of downstream irrigators). 5. Please place all oversized pages at the back (END) of the NOI application materials. This aids in scanning and/or copying of the NOI application materials. If necessary to attain adequate legibility, tables may be enlarged and submitted on paper other than 8.5 X 11. Use whatever size necessary to achieve adequate legibility. 6. If at all possible, the WYPDES program would appreciate the inclusion of an electronic version of the NOI application, either on CD or floppy diskette, including any supplemental permit application materials. Inclusion of an electronic version of the permit application speeds permit processing. 7. If at all possible, the WYPDES program would appreciate the inclusion of an electronic version of the outfall location table (Table 1 in the permit application), in either Word (.doc) or Excel (.xls) format for inclusion in the draft permit document. Inclusion of this information speeds permit drafting. 8. In order for the WYPDES Program and other agencies to coordinate on reservoir bonding and permitting, permittees are required to utilize and maintain unique reservoir names for each reservoir used to contain CBM produced water.
