Formalize agreements between bartenders and clients with this Bartending Agreement.
Oral agreements often lead to complications and disagreements about the terms of the
underlying agreement. A written agreement protects both parties by specifying the event
details, the bartender’s duties, the items supplied by the client, the compensation rate,
and much more. This agreement is ideal for individuals or small businesses that want to
enter into an agreement for bartending services at a particular event.
                                    BARTENDING AGREEMENT

THIS BARTENDING AGREEMENT (hereinafter referred to as the “Agreement”), made as of
_______________, [Instructions: Insert the date of this agreement] by and between
_______________________ [Instructions: Insert the Bartender’s name] (hereinafter referred
to as the “Bartender”), with an address of _____________________________ [Instructions:
Insert the Bartender’s address] and _______________________ [Instructions: Insert the
Client’s name] (hereinafter referred to as the “Client”), with an address of
_____________________________. [Instructions: Insert the Client’s address]

WHEREAS, Client desires to engage Bartender to provide bartending services in connection
with Client’s event; and, subject to the terms and conditions hereof, Bartender desires to accept
such engagement.

NOW, THEREFORE, in consideration of the promises and other good and valuable
consideration set forth, the parties agree as follows:

1.       ENGAGEMENT

Bartender agrees to provide bartending services (hereinafter referred to as the “Services”) at the
Event (as such term is defined herein), subject to the following terms and conditions:

     (a) Bartender shall:

            i.    Use Bartender’s best efforts to provide the Services in a timely and acceptable
                  manner, according to the standards of the profession;

           ii.    Comply with the state and local laws regarding the sale of alcoholic beverages
                  and applicable liquor laws. Bartender shall use best efforts to ensure that only
                  persons of legal drinking age are served alcoholic beverages. Bartender shall also
                  use its reasonable discretion in serving alcohol to guests. Bartender may refuse to
                  serve alcoholic beverage to any guest that Bartender believes is intoxicated and/or
                  acting in a manner that could be detrimental to the guest’s safety and/or the safety
                  of others; and

          iii.    Provide all necessary tools, including, but not limited to, wine keys, bottle
                  openers, pourers; and

     (b) Client shall:

            i.    Provide all items required by Client to enable Bartender to perform the Service
                  (hereinafter referred to as the “Required Items”), which, by way of example may
                  include: all beer, wine, alcohol, non-alcoholic beverages, mixers, glassware,
                  garnish, stirrers and ice. An exhaustive list of all such Required Items is attached
                  hereto as Exhibit “A” and incorporated herein.

           ii.    Comply with all rules, regulations and statutes regarding the Event, including, but
                  not limited to obtaining all required location permits and liquor licenses.

2.       THE EVENT

Bartender shall provide the Services at the event as described in this paragraph (hereinafter
referred to as the “Event”):

     (a) Event Address: _____________________________ [Instructions: Insert the Event’s
         address]

     (b) Event Date: ________________ [Instructions: Insert the Event’s date]

     (c) Set up Time: ________________ [Instructions: Insert the Event’s setup time]

     (d) Event Start Time: ________________ [Instructions: Insert the Event’s start time]

     (e) Event End Time: ________________ [Instructions: Insert the Event’s end time]

     (f) Tear Down: Bartender shall assist with cleaning the bar area following the Event.
         Notwithstanding the foregoing, within thirty (30) minutes following the end of the Event,
         Bartender shall remove all of Bartender’s personnel and equipment from the Event
         location.

3.        COMPENSATION

     (a) Upon execution of this Agreement, Client shall pay to Bartender _______________
         Dollars ($____), [Instructions: Insert the deposit amount] which shall be deemed a
         non-refundable deposit (the “Deposit”). In the event that Client cancels the Services, the
         Deposit shall be retained by Bartender. Otherwise, the Deposit shall be applied against
         the Fee hereunder.

     (b) In consideration of Bartender’s full and faithful performance of all of Bartender's
         obligations as set forth herein, Client shall pay to Bartender _______________ Dollars
         ($____) [Instructions: Insert the Bartender’s fee] (the “Fee”), which shall be payable
         upon the date of the Event.

     (c) Any request for extended Service time, may be accepted by Bartender, in Bartender’s
         sole discretion. If such request is accepted, Client will be charged at the rate of
         _______________ Dollars ($____) [Instructions: Insert the hourly charge for
         extended service] per hour.

     (d) Bartender [Instructions: Choose one: may OR may not] receive tips from Event guests.

4.       CANCELLATION

As described herein, the Deposit is fully non-refundable. Provided that Client provides written
notice of cancellation of the Services to Bartender at least _______________ (____) days
[Instruction: Insert the number of days notice required to cancel this agreement] prior to the
Event date (the “Cancelation Deadline”) Client shall not be required to pay the remainder of the
Fee. In the event that Client’s notice of cancellation is received by Bartender after the
Cancelation Deadline, Client shall be required to pay the remainder of the Fee, regardless of
whether the Services are rendered by Bartender.

5.       INDEMNIFICATION

Bartender and Client agree to indemnify and hold one another harmless for any and all liability
and damages (including, without limitation, reasonable attorneys' fees) the other party hereto
may suffer as a result of any and all claims, damages, costs or judgments for personal injury,
property losses or property damages incurred or suffered by or threatened against the other party
in connection with any claim brought by or on behalf of any third party, person, firm or
corporation (including either Client's or Bartender's employees) as a result of or in connection
with the Event or the Services rendered herein, when such claim results from the breach or
alleged breach of the indemnifying party's warranties, representations or agreements herein or
the negligence of such party.

6.       MISCELLANEOUS

     (a) In the event that any provision or part of this Agreement shall be deemed void or invalid
         by a court of competent jurisdiction, the remaining provisions or parts shall be and
         remain in full force and effect.

     (b) This Agreement is not assignable or transferable by either party, in whole or in part,
         without the prior written consent of the non-assigning party.

     (c) This Agreement constitutes the entire agreement between the parties hereto with respect
         to the specific subject matter hereof and supersedes all prior agreements or
         understandings of any kind with respect to the specific subject matter hereof.

     (d) Any modification to this Agreement must be in writing and signed by the parties or it
         shall have no effect and shall be void.

     (e) This Agreement shall be governed in accordance with the laws of the State of
         __________________.[Instructions: Insert the state’s laws that will govern this
         agreement]


IN WITNESS WHEREOF the parties have duly executed this Agreement as of the date first
written above.
