Justification:
For reasons of sound and rigorous management and on the basis of implementation,
Parliament considers that the appropriations for support expenditure are not consistent with
the real needs. Therefore they should be entered into a reserve until second reading and re-
allocated on the basis of an evaluation of the needs by then.

Remarks:
Add following text:
This appropriation covers interest subsidies granted for the reconstruction of the European
Union regions affected by the flooding in August and September 2002. Interest subsidies
may be granted on loans disbursed by the European Investment Bank out of its own
resources in the regions affected.

Justification:
To repair damage and rebuild infrastructure in disaster-stricken regions, the EIB has
repeatedly made loans available in the past on special terms from its own resources. The
interest cost has been charged to articles in this chapter.
The EIB has proposed that that also be done for the regions affected by the disastrous
flooding in August and September 2002, and a heading should therefore be created now to
enable the funding to be deployed as soon as the exact circumstances are known and the legal
basis is in place.

This appropriation is intended to cover expenditure arising in connection with measures
contributing to the completion of the internal market, its operation and development, and in
particular:
— greater proximity to citizens and businesses, including the development and strengthening
    of dialogue with citizens and businesses via measures intended to make the operation of
    the internal market more effective and to ensure that citizens and businesses are able to
    gain access to the most extensive rights and opportunities resulting from the opening and

    deepening of the internal market without frontiers and to exercise those rights and
    opportunities in full, and via monitoring and evaluation measures concerning the practical
    exercise by citizens and businesses of their rights and opportunities with a view to
    identifying and facilitating the removal of any obstacles which may be preventing them
    from exercising those rights in full,
—   implementation and monitoring of the provisions governing public contracts with a view
    to ensuring their genuine opening and optimum operation, including the awareness-
    raising and training of the various parties to these contracts; the introduction and use of
    the new technologies in the various fields of operation of these contracts; the continuous
    adaptation of the legislative and regulatory framework in the light of developments
    arising from these contracts, particularly the globalisation of the markets and existing or
    future international agreements,
—   improvement through the European Business Test Panel (EBTP) of the legal environment
    for citizens and businesses, for which promotion activities, awareness-raising and training
    actions could be envisaged; fostering cooperation, development and coordination of
    legislation in the field of business rights and assistance with the creation of European
    limited companies and European economic interest groupings,
—   strengthening administrative cooperation, the deepening and sound application of internal
    market legislation between Member States and support for administrative cooperation
    between the authorities responsible for implementing the legislation on the internal
    market,
—   the setting-up of a system that can effectively and efficiently deal with problems faced by
    citizens or business, arising as a result of the misapplication of internal market legislation
    by a public administration in another Member State; production of feedback information
    through the Solvit system by using an online database system accessible to all
    coordination centres and which will be also made accessible to citizens and business;
    support of the initiative by training actions, promotion campaigns and targeted actions
    which might include, among others, grants to different stakeholders,
—   interactive policy-making (IPM) in so far as it concern the completion development and
    operation of the internal market forms part of the Commission’s governance and the
    regulatory policy initiatives to respond better to the demands of citizens, consumers and
    business. Appropriations from this item may be used to make grants in favour of Member
    States and third parties to assist them to join and participate in the IPM initiative; they
    will also cover training, awareness-raising and network actions in favour of such
    participants with a view to making EU policy-making concerning the internal market
    more comprehensive and effective and as part of the process of assessing the actual
    impact of internal market policies (or the absence of them) on the ground,
—   a comprehensive review of regulations with a view to necessary changes and overall
    analysis of the effectiveness of the measures taken with a view to the sound operation of
    the internal market and the evaluation of the overall impact of the internal market on
    businesses and the economy, including the purchase of data and access by Commission
    departments to external databases, as well as targeted actions aimed at improving
    understanding of the functioning of the internal market and rewarding active participation
    in its fostering,
—   measures designed to guarantee the completion and management of the internal market,
    especially in the fields of pension, data protection (including measures to ensure a high
    level of protection both within the EU and in respect of personal data exported to non-EU
    countries), intellectual and industrial property, electronic commerce and commercial
    communications, in particular, the development of proposals for putting in place a
    Community patent and a corresponding jurisdiction in respect of it,

— strengthening and development of financial and capital markets and of financial services
  provided to business and private individuals; adaptation of the market framework
  especially as regards the monitoring and regulation of the activities of operators and
  transactions, so as to take account of changes at Community and world levels, the reality
  of the euro and new Financial Instruments, as well as developments within the «new
  economy»,
— improvement of payment systems in the internal market, in particular between Member
  States, notably those in which such systems are underdeveloped; reduction in the cost of,
  and time needed for, such transactions, taking into account the internal market dimension;
  development of the technical aspects so as to establish one or more payment systems on
  the basis of the follow-up to be given to Commission communications; grant aid to bodies
  in the cooperation network to facilitate the management of cross-border complaints,
— development and strengthening of the external aspects of the directives applicable in
  respect of financial institutions, the mutual recognition of Financial Instruments vis-à-vis
  third countries, international negotiations, assistance for third countries in establishing a
  market economy,
— planning, elaboration and implementation of an automated system for exchange of
  information, and cooperation on the analysis and investigation of relevant information on
  any fact which might be an indication on money-laundering; realisation of an appropriate
  and protected channel of communications between financial intelligence units (FIUs)
  through the FIU.NET initiative, in favour of Member States or other organisations;
  appropriations might also cover the realisation of studies, training and awareness-raising
  and promotion,
— analysis of the effect of measures in place as part of the follow-up to the progressive
  liberalisation of postal services, coordination of Community policies on postal services
  with regard to international systems and in particular participants in Universal Postal
  Union (UPU) activities; cooperation with central and east European countries; practical
  implications of the application of General Agreement on Tariffs and Trade (GATS)
  provisions to the postal sector and overlap with the UPU regulation,
— implementing of Community and international provisions in the field of money-
  laundering, including participation in intergovernmental or ad hoc measures in this field;
  grants and other expenditure relating to Commission participation as a member of the
  FATF (financial action task force) on money-laundering created under the organisation
  for Economic Cooperation and Development (OECD),
— grants and other expenditure in support of projects of Community interest undertaken by
  outside bodies.
Amend text as follows:
This appropriation is also intended to cover expenditure arising in the field of taxation and
customs via the following measures:
— simplification and modernisation of the VAT system in accordance with the new VAT
    strategy adopted by the Commission and the strengthening of administrative cooperation
    on combating fraud with a view to more effective exchanges between Member States,
— excise duties and environmental taxes: analysis of fiscal policies in relation to transport,
    the environment and energy,
— taxation and e-commerce: development and implementation of legislation with a view to
    giving businesses security with regard to the electronic delivery of services; analysis of
    fiscal policy in the field of e-commerce with a view to strengthening the competitiveness
    of electronic networks (Internet) and software and computer services generally in Europe,

— direct taxation: approximation and harmonisation of legislation with a view to ensuring
  the operation of the single market and the exercise of the freedom of movement and the
  freedom to provide services; analysis co-ordination of fiscal policies in the field of
  services and financial products with a view to strengthening the integration of financial
  markets, especially in the field of supplementary pensions and life insurance,
— fiscal policies and compulsory contributions: with a view to continuing the study of the
  overall examination of taxation in the taxation policy group so as to strengthen the
  coordination of fiscal policies, taking other Community objectives into account, and
  particularly tax measures likely to be taken into consideration when the code of conduct is
  revised, economic analysis of tax systems and compulsory contributions (extending the
  scope of investigation of actual rates of taxation to cover taxes other than corporation
  tax),
— administration of customs laboratories (harmonisation of working methods in Member
  States’ customs laboratories),
— setting-up of an external service to answer queries from users of the tariff website of the
  Directorate-General for Taxation and customs union (DDS site),
— customs: binding tariff information (BTI), evaluation of the content and terminological
  update of the BTI database, including diffusion of BTI to operators, update of the
  European customs inventory of chemical substances (ECICS),
— customs: preferential origin: analysis of the criteria of determination of the origin of
  goods by a study on their adaptation to the political objectives of the Community.

Dienstleistungsfreiheit für Einrichtungen der betrieblichen Altersversorgung verwirklicht
werden soll, in naher Zukunft zu rechnen. Daher sollte die Kommission die Möglichkeit
haben, auf die Mittel dieser Haushaltszeile zurückzugreifen, wenn sie dies für notwendig
erachtet.

This appropriation is also intended to finance the drawing-up of a study of the
implementation of a tax on capital movements ('Tobin tax').
Justification:
In view of the increasing volatility of the financial markets, the danger posed to the real
economy by speculation, and the need to obtain new sources of tax revenue, notably by
redressing the tax balance as between labour and capital, a study needs to be drawn up on the
implementation within the EU of a tax on capital movements, given the possibility of
capturing new financial resources for social and job-creation measures.

new measures targeted at microenterprises to be drawn up.

Justification:
Enlargement will be the greatest challenge over the next few years. Maximum use must
therefore be made of this preparatory action in the immediate run-up to enlargement. For that
reason, an increase in appropriations for 2003 is being proposed.

This appropriation is intended to finance a pilot project in order to prepare for a future
legal base to finance a programme supporting co-operation and business partnerships
between SMEs in present member states, candidate countries and countries bordering on
the enlarged union in the context of the preparation of enlargement. The Commission is
urged to make a proposal for a legal base and a permanent programme before the end of
the year 2003.

Appropriations of the Community budget should be dedicated to finance a project with the
aim of developing cross-border co-operation programmes, education, business events (for
example Partenariats) and networks between SMEs in present member states, candidate
countries and countries bordering on the enlarged Union. So far, this project responds to
EU political priorities in favour of SME development as well as the preparation of
enlargement, particularly in preparing SMEs in candidate and other neighbouring
countries for the internal market.

The projects should support the creation of partnerships and networks based on concrete
action plans between SME organisations, Chambers of Commerce, regional development
agencies and other local and regional authorities responsible for SME development in the
Union and in countries and regions eligible for support from the Phare, Tacis, Cards and

This action is intended to complement the measures financed under Decision
2000/819/EC and under the budget line B5-3003 in a wider geographical and economical
context than that of the present border regions.

The project should be financed under heading 3 of the Financial Perspective but should

Measures should inter alia:
— examine the possibilities of developing and extending the financial instruments in
  support of SME-development within the Union in the context of enlargement;
— facilitate information, education and the creation of business opportunities between
  SMEs through networks and between SMEs and regional and local administrations;
— focus on the development of networks based on partnerships and development plans
  between SMEs in the Union, the candidate countries and the countries eligible for
  support under the Phare, Tacis, Meda and Cards programs, in order to establish a
  market oriented development among SMEs in those countries.
Justification:
In the context of the Budget 2002, one of EP priorities was the creation of a Border region
programme and a pilot project for SMEs of cross border regions. EP also added a number of
budgetary remarks suggesting that Phare, Meda and Cards funding should be used for
Partenariats and other forms of SME cooperation.
In the context of the preparation of the present and future enlargements, there is however a
need for a more permanent and wider scope of such co-operation.

The enlargement perspective should not be limited to the current border regions, particularly
when it comes to economic development, SME co-operation, business transactions etc. In this
context the notion of Border regions should be widened and take on board the Union's future
new borders to Russia, Ukraine, the Western Balkans, North Africa etc.
The creation of patrnerships, networks etc for SMEs should contribute to the awareness of
the Union's new dimension, the extension of the internal market and the creation of growth,
employment, market economy and social welfare.

This appropriation is intended to fund, in the first year, a pilot project within the meaning
of the Interinstitutional Agreement of 6 May 1999 between the European Parliament, the
Council and the Commission on budgetary discipline and improvement of the budgetary
procedure.
Justification:
Well over 90% of all EU firms are SMEs. Many SMEs already act in a socially and
ecologically responsible fashion, albeit mostly on a local basis, unsystematically and with no
tie-in with a corporate strategy. Those SMEs, and micro-enterprises in particular, need
support to put a more strategic approach into practice and need help to identify the potential
competitive benefits of corporate social responsibility. What SMEs need above all is a user-
friendly tailored set of tools; they need an exchange of best practices, and they need best
practices to be disseminated.
If the EU wants to realise the Lisbon objectives and establish the world's most competitive
and most dynamic knowledge-based economy, we must support the drivers of that process:

competitive and profitable SMEs which create wealth and jobs and contribute to sustainable
development without neglecting society's social and ecological requirements.

Increasingly, the Council - in the face of opposition from the European Parliament and the

Justification:
This is to restore the level of appropriations proposed by the Commission in the Preliminary
Draft Budget. The decrease proposed by the Council would have serious consequences for
the functioning of the EMEA and its ability to carry out tasks which have been assigned by
the European Union. The budget cut would jeopardise, in particular, the development of the
new IT system as a part of the EU telematic strategy and the preparations for enlargement. It

This appropriation is also intended for the promotion of the associative movement among
SMEs, notably by creating and supporting associations of SMEs at national, interregional
and European level.
Justification:
The aim of this amendment is to increase the commitment and payment appropriations for
these budget headings in favour of SMEs, and also to add to the remarks the objective of
promoting the associative movement among SMEs and supporting associations of SMEs. The
already inadequate funding for these headings has suffered further cuts. Today, funding for
the so-called employment initiative (1998-2000), such as it is, is almost the same in terms of
appropriations as the total expenditure under the information policy. Associations of SMEs
can provide a wide range of services, from legal advice to information campaigns, and can be

important channels of contact, e.g. for public aids or, indeed, for measures aimed at
centralising credits which can contribute to lower costs and improved competitiveness for
their members.

Justification:
More than 80% of the jobs created in the Community are in SMEs, in particular because they
are flexible and adaptable. The appropriations concerned are intended to encourage
implementation of European Union policy in support of SMEs in particular, in whatever areas
they operate, and to encourage them to develop their full potential for employment.
Following the repeated downward revisions of growth prospects in the EU Member States for
2003, it is - to say the least - surprising to see that a cut in appropriations against article B5-
510 for next year is being proposed. During a period of week growth, when unemployment is
once again on the increase, it is particularly necessary for the 2003 appropriations for SMEs
to show a significant and realistic increase with respect to those for 2002.

   of assisting them in their preparation in view of the forthcoming accord on banking

— Drawing up an action plan to prevent an adverse impact on small and medium-sized
   enterprises and small credit institutions as a result of Basel II; in formulating the
   action plan the results of the study referred to in point 1 will be duly taken into

Justification:
With SMEs universally acknowledged as the main sources of employment and growth in
Europe, it is imperative to at least maintain the level of last year's funding for a budget line
whose stated destination is "to cover expenditure on the implementation of Community
policy in support of enterprises, and particularly small and medium-sized enterprises". With
the Basel committee for international banking supervision discussing a revision of the 1988
Basel I accord, which classified credit risk and imposed minimum amounts of capital to be
set against each type of risk, SMEs should be assisted in their preparation in view of Basel II.
The aim of the study and action plan proposed here is to prevent an adverse impact of Basel
II on SMEs and small credit institutions.

importance to provide SMEs with information on possibilities for cross-border activities,
access to funding and on regulatory matters affecting them. The Euro Info Centres are
particularly important in realising that objective. Their appropriations under this
multiannual programnne will be strengthened. Under this multiannual programme, part of
the appropriations shall be made available for SMEs in border regions in the run-up to
enlargement. Similarly, part of the appropriations shall be made available to business start-
ups by women and to placement firms. In this context, appropriate emphasis must be placed
on the development of new technologies.
Justification:
The Euro Info Centres are of particular importance in providing European SMEs with
information on possibilities for cross-border activities, access to funding and on regulatory
matters affecting them. There is albeit currently not enough EU-funding for the Euro Info
Centres. Each Euro Info Centre gets a yearly allowance of EUR 25.000 from the Community

Budget. This covers approximately 10-15% of an Info Centres expenditure. The rest is
covered by the host structures, like chambers of commerce or municipalities. Some of the
host structures are complaining about the burden they have to carry. There are cases, where
Info Centres had to close down because of lack of funding. This is not acceptable taking the
great value of the Euro Info Centres into account. It is therefore proposed do strengthen their
appropriations under this multiannual programme

Justification:
More than 50% of small and medium-sized enterprises (SMEs) are undercapitalised. In the
main, this affects sectors such as tourism and construction, etc. Because the Basle II
provisions (tightened-up lending) are already being applied early by credit institutions, the
SMEs concerned are falling on hard times more and more in that they are no longer able to
meet increased interest rates on borrowings or, as the case may be, are no longer being given
loans for urgently need investment. To help these firms promptly, action must be taken to
improve capital adequacy.

In disaster situations, this appropriation is also to be used to fund emergency support
measures for SMEs by means of a fast-track, simplified authorisation and implementation
procedure. A reserve totalling EUR 1 000 000 is to be created for this purpose. In the
process, account must be taken of both European added value and forward-looking
investment, in particular job creation. With regard to implementation, there must be
compliance with binding deadlines within the necessary time frame. In this connection, the
provision of credit guarantees for banks and savings banks, enabling them to extend
assistance promptly and without red tape, is also a priority.
Justification:

The catastrophic flooding in summer 2002 in Central Europe has shown that SMEs are very
badly hit by such disasters, which may also have serious consequences in terms of preserving
and creating jobs. Adequate funds therefore need to be available in a reserve for release in
similar disaster situations in order to finance necessary emergency measures. This must be
possible under a prompt authorisation and implementation procedure with no red tape. For
the measures to be implemented, there must be compliance with binding deadlines within a
limited time frame. In this connection, necessary lending to firms by banks and savings banks
should also be made easier by providing credit guarantees.

This appropriation is intended to support regional measures of an experimental nature to
promote the establishment of «regions of knowledge» in the field of technological
development and regional-level cooperation among universities and researchers in order to
foster integration among European regions.

To receive funding, projects must involve bodies or entities from at least three European
countries.
Justification:
The Presidency Conclusions of the Lisbon European Council (23 and 24 March 2000) point,
among the priority objectives, to the establishment of a European knowledge area where,
together with education and training, other measures in connection with research,
development and innovation can identify appropriate ways of enhancing entrepreneurship and
the functioning of the internal market - the keys to job creation - and hence set innovative and
competitive economic processes in train.
Research, development and innovation are an important driving force behind a knowledge-
based society. These factors become essential when incorporated into a strategy for
businesses which includes greater product market competitiveness, better access to risk
capital, better protection of intellectual property rights and better networking and technology
diffusion.
The need to structure complex and integrated processes such as those identified in the Lisbon
document calls for pilot measures of an experimental nature which, taking European regions
constituting «regions of knowledge» as their geographical basis, can turn into genuine models
for integrated practices to be extended to European Union level.

Conclusions of the European Council in Lisbon on 23 and 24 March 2000.
This appropriation is intended to fund a pilot project within the meaning of the
Interinstitutional Agreement of 6 May 1999 between the European Parliament, the Council
and the Commission on budgetary discipline and improvement of the budgetary procedure.
Decision No 283/1999/EC of the European Parliament and of the Council of 25 January 1999
establishing a general framework for Community activities in favour of consumers (OJ L 34,
9.2.1999, p. 1).

According to the proposal for a regulation of the European Parliament and of the Council
amending Council Regulation (EC) No 2236/95, additional commitment appropriations
totalling EUR 100 000 000 will be allocated to TEN-T projects aimed at removing
bottlenecks at borders with the candidate countries over the period 2003 to 2006. 2006 and
cross-border rail bottlenecks and/or which concern missing links located in areas where
natural barriers represent obstacles to the free circulation of goods and passengers. To this
should be added EUR 50 000 000 to be reallocated within the overall allocation for TEN-T.
For 2003 the additional amounts proposed for border regions total EUR 35 000 000
(additional commitment appropriations) and EUR 15 000 000 (reallocated commitment
appropriations).
Justification:
Restore the PDB. The above amendment uses the exact wording of Amendment 8 to Article
5(3) of Regulation 2236/95/EC set out in the legislative resolution adopted by Parliament on
2 July 2002 on the proposal for a European Parliament and Council regulation amending
Regulation 2236/95/EC.
No solid grounds have been put forward by the Council for the reduced amounts proposed.

The amendment to the remarks stems from the need to adopt a different, more specific
approach to the safety of persons with reduced mobility compared with other transport users.

Justification:
Preventing increasing violence against children and women remains a major objective of the
European Parliament. An additional amount of EUR 500 000 is specified for information
campaigns and appropriate actions to increase awareness about and to counter the serious
problems relating to bullying.
In 2001 at its own initiative the European Parliament created budget Article B5-804 to
provide funding for a pilot project to launch an information campaign to combat paedophilia
in the 15 Member States.
In order to ensure that funding is assured in 2003 the European Parliament proposes that
the appropriations for the Daphne programme (Article B5-802) be topped up by EUR 1 500
000 so as to enable it to be used to fund appropriate information measures to combat
paedophilia and other forms of sexual abuse.

— the setting-up of setting up a network at European level to promote and coordinate
   information and actions on measures aimed at protecting, and preventing violence
   towards, children, young people and women, and at combating both trafficking in women
   for the purpose of sexual exploitation and female genital mutilation, as well as forced
   marriage,
— special measures at European level for the protection of children, adolescents and women,
   with primary consideration being given to them in all actions concerning them; their
   rights are to be enjoyed without discrimination of any kind,

— prevention of, and protection of children, adolescents and women from, all kinds of
  violence and commercial sexual exploitation, trafficking, and other abuse, including
  female genital mutilationmutilation and forced marriage, and promoting the
  rehabilitation of victims of such abuses,
— pilot projects and subsidies to NGOs or voluntary organisations working towards these
  aims, in particular, working for the rights and the protection of children, adolescents and
  women, in particular victims of trafficking for sexual exploitation and victims of sexual
  abuse and abuse, female genital mutilation,mutilation and forced marriage,
— promoting the introduction of instruments designed to encourage reporting of violence
  against women, children and adolescents, forms of trafficking in women for the purpose
  of sexual exploitation, and female genital mutilationmutilation and forced marriage, in
  accordance with arrangements which are similar in all Member States,
— conducting a cost-benefit analysis of the national laws of the Member States and
  international conventions on trafficking in women and prostitution,
— conducting information campaigns aimed at combating paedophilia, sexual exploitation
  and exploitation, female genital mutilationmutilation and forced marriage.

spectrum of areas of EU policy and operation as the need arises.

This appropriation is intended to cover a study analysing the situation of disabled persons
living in homes institutions in Europe, including the candidate countries.
Justification:
The 8 mio EUR allocation for the European Year 2003 spread across activities of 15 Member
States is insufficient, in particular given that the participation of disabled people in an activity
has important additional costs to ensure their equal access (personal assistants, sign language
interpretation, disability accessible meeting rooms and hotel rooms being more expensive
etc.)
A supplementary funding of 780 000 euro would significantly increase the visibility of the
European Year by allowing for increased participation by participants from representative
disability organizations in transnational events. It would strengthen the European dimension
for the Year enabling actions organized at national level to fund participation from disability
organizations from other European countries in these events. This supplementary funding
allocation would also contribute towards the costs of holding a Disabled People’s Parliament’
to be hosted by the European Parliament to mark the European Year 2003 and the 10th
anniversary of the UN Standard Rules on the Equalisation of Disabled People and gives an
unprecedented opportunity for representative disability organisations in Europe to voice their
concerns and debate key issues directly with the European Parliament.
The proposed remarks mistakenly refer to ‘disabled people living in homes’, rather than the
better and more appropriate term ‘disabled people living in institutions’. This mistake in the
translation of the phrase needs to be corrected.

This appropriation is intended to finance training, exchange, cooperation and awareness-
raising programmes in the fields of justice and home affairs.

EUR 3 000 000 is to be made exclusively available for border protection projects under the
ARGO programme (Article 4).

EUR 1 000 000 in funding from the Title VI programme is to be available to promote the
rights of the defence and procedural guarantees and assist persons being prosecuted in the
framework of transnational judicial cooperation. It is to be used in particular to fund for
each Member State, depending on the law in force, the publication and translation of a
«letter of rights» to be handed to persons to be questioned, either upon arrival at a police
station or at the location where questioning is to take place.

The budget heading will also be used to perform a comparative study in order to identify
tried and tested practices in the Member States in the field of the provision of funds to
compensate victims of crime and regarding a solidarity fund which could be created for
victims in cases with a cross-border dimension or for EU citizens who are victims of
terrorist acts in third countries.
Justification:
Both the report on the Commission’s green paper on compensation for victims of crime and
the green paper itself contain a number of lacunae regarding how victims of terrorism in the
EU and third countries should be compensated where appropriate.
The Commission green paper states that not even half the Member States compensate their
own nationals for crimes to which they fall victim in EU countries, and for the consequences
thereof. Although the report and green paper have already resolved a number of issues,
adequate information and data are not available on which to base decisions on resources for
the fund.
Before a solidarity fund is set up, therefore, concrete figures and statistics are needed on how
many problematic cross-border cases there are within the EU and how many EU victims of
terrorist attacks in third countries have regrettably not received compensation to date.
On 13 June 2002, the Council approved a plan for the integrated administration of the EU's
external borders. By means of the ARGO programme, Member State activities to secure the
external borders are to be supported in order to provide an equivalent level of effective
protection and surveillance at external borders and strengthen controls at border crossing
points and surveillance between crossings points (Article 4). An additional EUR 3 m is to be
made available for relevant projects. The appropriations have been placed in the reserve; they
may be released when an appropriate draft invitation to tender has been submitted.
In addition, action is to be taken to ensure that, under the Title VI programme, EUR 1 m of
the EUR 11.78 m appropriation is used in 2003 to promote and guarantee the rights of the
defence, e.g. in connection with «Fair Trials Abroad». The appropriations have been placed

in the reserve; they may be released when an appropriate draft invitation to tender has been
submitted. This pro rata commitment is commensurate with the result of Parliament's vote
when it was consulted on the legal basis. Parliament approved the financial framework
proposed by the Commission only on the basis that that point would be incorporated. During
the consultation process, the Commission assured the committee responsible that
implementation of such projects would be possible, whether or not express reference was
made in the legal basis, and had already been funded under a forerunner programme (Grotius
II).
A «letter of rights» in the language of the suspect is important to guarantee the rights of the
defendant.

Justification:
More than ever before, one of the European Union's priorities must be to continue to take

illegal and harmful content on global information networks. That priority must be reflected in
the appropriations proposed. The slight increase in commitment and payment appropriations

Justification:
Surveys carried out in a number of Member States show that, particularly in certain areas,
attacks on commercial drivers engaged in export trade pose a very significant human and
commercial problem for export traders. Owing to the transnational nature of export trade, the
security of commercial drivers is Member States' joint responsibility and an adequate level of
security for drivers requires that the problems be uniformly addressed in all Member States.
The preparatory action will also by trying to prevent attacks on truck drivers help to improve
the health and safety for the commercial drivers. On the basis of these arguments is it natural
that the EU-Commission should also become part of the project.

ensure application of Articles 6 and 7 of the Treaty on European Union. This will involve
in particular an assessment of the implementation of each of the rights laid down notably in
the Charter of Fundamental Rights of the European UnionEuropean Union, taking account
of developments in national laws, the case-law of the Court of of Justice of the European
Communities and of the European the European Court of Human Rights and Rights, the
conclusions of treaty monitoring committees concerning implementation of UN
conventions by Member States, reports by other relevant monitoring bodies, and any
notable case-law of the Member States' national and constitutional courts.
Justification:
One reason for setting up the network of experts was to assist the rapporteur in drawing up
the annual human rights report on the situation in the EU. In addition to the assessment areas
referred to, the network should also analyse the conclusions and reports of treaty monitoring
committees and other bodies.

funding must be made available for research along alternative lines, by contrast, such as in

Justification:
Biomedical testing on animals must be confined to research leading to substantial
improvements in public health. During that research too, however, needless suffering by
animals must be prevented. There should be more investment in good-quality housing in a
social environment. The existing rules, which date back as far as 1986, need to be revised and
brought into line with the ethological knowledge gained since then. A closer watch should be
kept on research establishment compliance with both European legislation and national
legislation, the latter being more stringent in many instances.
Fresh testing on anthropoids (hominoid primates) is ethically irresponsible and no longer
necessary. No new projects must therefore be launched, and projects under way should be
phased out. Existing colonies must be «pensioned off» in as proper a fashion as possible. The
EU should set aside money for this too.

the 6th Framework Programme for research and technological development (2002-2006),

upon by the European Parliament and the Council.
Justification:

This appropriation is intended to help SMEs "boost their technological capacities and develop
their ability to operate on a European and international scale". The specific activities for
SMEs should complement and be coordinated with activities covered by other budget lines
(e.g. B5-510) and aimed at assisting SMEs in view of Basel II. The provisions agreed by the
Council and the European Parliament in favour of international cooperation should also be
clearly stated. Finally, in the expectation of a timely completion by the Council of the
remaining stages of approval of the full FP6 package, it should be ensured that the
Framework Programme is set in motion without undue delay and the annual breakdown of
appropriations for this and all other headings over the entire period of the programme reflects
in a reasonable way the agreed priorities and overall amounts.

and the annual breakdown of appropriations for this and all other headings over the entire
period of the programme reflects in a reasonable way the agreed priorities and overall

This appropriation is intended to finance supplementary needs once it has been proven that
the trend of outstanding payments will start to be reduced.
Justification:
The negative trend in the reduction of the backlog shows that the management instruments of
the Commission for the implementation of this budget line are not adequate and need
improvement. Until the trend is reversed or the Commission can demonstrate that the
management is improved, appropriations have been entered in this new reserve. The
budgetary authority will consider to transfer appropriations to the source budget line, if the
backlog is reduced and the Commission can demonstrate that the management for this budget
line is improved.
