					                                 PRESS ADVERTISEMENT
There have been various allegations of impropriety by the media against my person in
relation to dispensing my mandate as the Chief Registrar of the Judiciary. I have set out the
facts responding to the allegations as follows:

          ALLEGATION                                FACTS
1.        1 billion renovation of Milimani Law      The building was commissioned on 24th
          Courts                                    February 2010 before my appointment
                                                    as the Chief Registrar of the Judiciary. .
                                                    The repairs undertaken later, in January
                                                    2012 were done by the same
                                                    contractors at their cost.

                                                    The current WAN/LAN installation at
                                                    Milimani Law Courts will cost 230
                                                    million. The scope includes voice and
                                                    data communications, power backup,
                                                    internet, CCTV, structured cabling, and
                                                    email.



2.        Chief Justice House                       Funds availed by Parliament in the
                                                    Judiciary budget for the FY 2012/2013.
                                                    The process was through open tender
                                                    advertised on 5th October, 2012.
                                                    The JSC was appraised and approved
                                                    the award through a resolution on 10th
                                                    May, 2013.
3.        Lease for Court of Appeal premises        Funds availed by Parliament in the
          at Upper Hill (Elgon Place)               Judiciary budget for the FY 2012/2013.
                                                    The process was through open tender
                                                    and advertised on 2nd October, 2012.
                                                    The JSC was appraised and approved
                                                    the award through a resolution on 21st
                                                    January, 2013.
4.        Lease for Rahimutulla Building            Funds availed by Parliament in the
                                                    Judiciary budget for the FY 2012/2013.
                                                    The process was through open tender
                                                    and advertised on 2nd October, 2012.
                                                    The JSC was appraised and approved
                                                    the award through a resolution on 21st
                                                    January, 2013.
5.        Purchase of vehicles                      JSC policy to provide vehicles for judges
                                               and Landrovers for court stations.

                                               The Judiciary utilizes a pre-negotiated
                                               contract by the Government, that was
                                               circulated to Government institutions
                                               vide circular No. R04/2011-2012 dated
                                               29th November 2011 from the Ministry
                                               of Public works.
6.   Hiring of Staff irregularly and payment   Upon the beginning of my tenure, I
     grades                                    requested for staff from the National
                                               Treasury,      the      Public     Service
                                               Commission,       Ethics,    and     Anti-
                                               Corruption Commission, Independent
                                               Electoral and Boundaries Commission,
                                               the     Ministry      for     Information
                                               Technology, Ministry of Planning, the
                                               National Council for Law Reporting and
                                               the Kenya Forest Services to be
                                               seconded.

                                               Upon    job    appraisal,  the    JSC
                                               subsequently resolved to employ some
                                               of them through a resolution on 1st
                                               December, 2012


7.   Undue Interference with cases             The office of the Chief Registrar does
                                               not unduly interfere with judicial
                                               proceedings.

                                               The office of the Chief Registrar from
                                               time to time receives complaints from
                                               the members of the public concerning
                                               their cases and forwards the same to
                                               the Judiciary Ombudsman.
8.   Sitting allowances                        Payments of allowances are pegged on
                                               attendance. I have not been paid for
                                               meetings that I have not attended.

     Per diem for trips not undertaken         Per diem for scheduled trips is paid a
                                               few days prior to the date of departure.
                                               Due to the nature of my work I have to
                                               sometimes cancel a trip. In such
                                               instances, the per diem is refunded to
                                               the Judiciary. Further, the Finance
                                                     Directorate deducts unremitted imprest
                                                     and per diem from officers who do not
                                                     refund the same.




Up to now, I have still not yet officially received any specific allegations of impropriety and
otherwise.
