									Photography Contract
This Photography Contract is made between a photographer and a client for the
provision of photography services for an event or a wedding. This document contains
the material terms and conditions of the contract including the services to be provided,
the payment details and the duration of the services. It includes numerous standard
provisions and opportunities for customization to address the specific needs of the
parties. This document should be used by photographers or clients when hiring a
photographer for an event or a wedding.
                                       PHOTOGRAPHY CONTRACT


      THIS PHOTOGRAPHY CONTRACT (the “Contract”), is made on __[Date]__, by and
between __[Name of Client]__ (the “Client”) of _[Address]_, __________, __________
__________ and _[Name of Photographer]_ (the “Photographer”) of __[Address]__,
__________, __________ __________.

       WHEREAS, the Photographer provides photography services to businesses and
individuals;

       AND WHEREAS, the Client desires to obtain the photography services of the
Photographer;

       AND WHEREAS, the Client and the Photographer wish to enter into this Contract to
provide for the terms and conditions relating to the provision of the photography services.

       NOW THEREFORE in consideration of the mutual promises and covenants contained in
this Contract, and other good and valuable consideration, the parties hereto agree as follows:

Performance of Services. The Photographer agrees to provide the photography services, as set
out below, to the Client and shall complete all photography services in a timely, professional
manner. The photography services to be provided by the Photographer shall be performed at the
location(s) as set out below.

Term. The Photographer shall commence the photography services on _[Event Date]_ (the
“Event Date”) at _[Start Time]_ and shall complete the services by _[End Time]_.

Locations. The photography services shall be performed at the following locations:

   2. __________, __________, __________ __________

Description of Services. The Photographer agrees to provide the following photography
services (the “Services”): ________________________________________________________

Payment. The Client shall pay to the Photographer the sum of _[$ Amount]_ (the “Fees”) in
consideration of the Services. Upon the execution of this Contract, the Client shall pay to the
Photographer a deposit in the amount of _[$ Amount]_ (the “Deposit”). The Client shall pay to
the Photographer the balance of the Fees due and payable __________ days prior to the Event
Date. Any amounts which remain outstanding to the Photographer shall be subject to interest at
the rate of __________ Percent per month.

Cancellation Policy. In the event that the Client provides at least __________ days written
notice of cancellation prior to the Event Date, to the Photographer, the Photographer shall return
__________ Percent of the Deposit to the Client. In the event that the Client provides less than

__________ days written notice of cancellation prior to the Event Date, the Photographer shall
be entitled to retain the entire Deposit. In the event that the Photographer cancels for any reason,
the entire Deposit and any other fees paid by the Client will be returned to the Client.

Copyrights. The photographs, digital negatives or prints produced by the Photographer are
protected by Federal Copyright Law (all rights reserved) and the Photographer retains the
copyright to all photos and images produced. The Client may reproduce any images in any
manner they like for sharing and enjoyment of friends and relatives. The Client must obtain
written permission from the Photographer prior to the Client or their friends or relatives
publishing or selling the photographs for profit.

Location Limitations. The Photographer is limited by the rules and guidelines of the location(s)
and site management. The Client agrees to accept the technical results of their imposition on the
Photographer. Negotiation with the officials for moderation of guidelines is the Client’s
responsibility; the Photographer will offer technical recommendations only.

Independent Contractor. The Photographer acknowledges that it is independent of the Client
and that by the Photographer performing the photography services contemplated herein, no
relationship shall be established between the parties except for one of an independent
Photographer.

Indemnification. The Photographer agrees to indemnify and hold the Client harmless from and
against and any and all claims, damages or liabilities which may arise out of any personal injury
that to the Photographer or any of its employees that is not the result of any intentional or
reckless or negligent act of the Client or Client's agent(s). The Photographer further agrees to
indemnify and hold the Client harmless from and against any and all claims for damages that
may occur to any of the Photographer’s materials or equipment while performing the
photography services, save and except for any loss which is due to any negligence or willful
misconduct by the Client. This provision shall survive the termination of this Contract. The
Client agrees to indemnify and hold the Photographer harmless from and against any and all
liabilities, claims and expenses, including reasonable attorneys’ fees, arising from the Client’s
use of the photographs produced in connection with the Services. This provision shall survive
the termination of this Contract

Insurance. Prior to the Photographer commencing the photography services, the Photographer
shall have in place and in good standing, suitable insurance coverage in respect to employer's
liability, workers compensation and comprehensive general liability in an amount not less than
__________ Dollars. Within __________ days prior to the Event Date, the Photographer shall
furnish to the Client a copy of such insurance policy evidencing same.

Arbitration. Notwithstanding the foregoing, and anything herein to the contrary, any dispute
under this Contract shall be required to be resolved by binding arbitration of the parties hereto. If
the parties cannot agree on an arbitrator, each party shall select one arbitrator and both arbitrators
shall then select a third. The third arbitrator so selected shall arbitrate said dispute. The
arbitration shall be governed by the rules of the American Arbitration Association then in force
and effect.

No Waiver. A waiver by any party of any provision of this Contract in any instance shall not be
deemed to waive it for the future. A party’s failure to insist on strict compliance with any of the
terms of this Contract on one or more occasions is not a waiver of any rights or obligations under
this Contract.

Entire Agreement. This Contract constitutes the entire agreement between the parties and
except as herein stated. This Contract may not be amended or modified in any respect except by
written instrument signed by both parties.

Governing Law. This Contract shall be interpreted in accordance with the laws of the State of
__________ applicable therein and as amended from time-to-time.

Severability. In the event that any one or more of the provisions contained herein, or the
application thereof in any circumstance, is held invalid, illegal or unenforceable in any
jurisdiction, the validity, legality and enforceability of any such provision in such jurisdiction in
any other respect and of the remaining provisions herein shall not be affected or impaired
thereby.

      IN WITNESS WHEREOF the parties hereto have hereunto set their hands and seals as of
