   On 02-17-2013,.      4:47 hours, I, Officer Jeremy Welsh of the SaukRapids Police Department
   responded to the      rsection of 9th Avenue North and 18th Street North Sauk Rapids, Benton County,
   MN for a motor ve icle accident. The caller identified as Scott Killinger reported that a blue Chevy
   blazer crashed and was currently in his yard 1711 9th A venue North. Killinger was unsure if the
   driver was injured or not. Gold Cross was dispatched to the scene.

   While approached the scene I observed several Waste Management garbage cans shattered along the
   North side of 18th Street North near the turn to Summit Place. I observed black plastic debris
   consistent from a vehicle and a street signs knocked down. I observed large amounts of snow thrown
   onto the North lane of 18th Street North. The debris and the vehicle tracks lead to MN 307BUP .
   which I observed in the front yard of 1711 9th Avenue North. I observed the driver's window down
   and the driver rocking the vehicle back and forth with it's tires spinning in an attempt to break free of
   the snow bank. I approached the vehicle and ordered the male to shut the vehicle off for Officer and
   public safety reasons. As I approached the vehicle I observed no shoeprints outside of the vehicle. I
   recognized the driver as Sauk Rapids Mayor Bradley Gunderson. Gunderson looked at me and stated
   "I almost got away, now I'm fucked." I detected a very strong presence of alcohol coming from
   Gunderson. I asked Gunderson ifhe was injured, which he stated no. I cancelled Gold Cross
   ambulance. I observed Gunderson to have slurred speech while speaking to me. Gunderson had
   bloodshot, watery eyes, and had a difficult time focusing on me while speaking to me. I escorted
   Gunderson out of the vehicle and through the snowbank. Gunderson needed assistance walking back
   to my patrol vehicle. Gunderson stated that he had two 22 ounce beers at JP's bar in Sauk Rapids and
   was on his way home. Gunderson pleaded with me to save him $2000 in legal fees and just bring him
   home. Gunderson advised me that he was not that intoxicated and continued to request that I transport
   him home. I administered a digital preliminary breath test from patrol vehicle 45 to Gunderson,
   which revealed an alcohol concentration of .296. Gunderson told me that he is my boss and that I
   needed to bring him home. I placed Gunderson into the rear seat of my patrol vehicle at this time. I
   advised Gunderson for his safety and based on my observations I would be placing him into the rear
   seat of my patrol vehicle.

   I contacted Sauk Rapids Police Chief Perry Beise and advised him of the call. I advised ChiefBeise
   that I had requested Minnesota State Patrol to respond due to the conflict. I ended the call with Chief
   Beise at this time.

   I photographed the first area of impact where Gunderson had left the roadway and then proceeded to
   strike Waste Management garbage cans. I photographed the snowbank with tires tracks leading to the

         street signs that were damaged and knocked to the ground. I crossed the roadway and photographed
         the vehicle. I observed fresh damage to the front center of the vehicle along with the passenger side
         headlight missing and the passenger side mirror broken. The front license plate was bent directly
         underneath the vehicle, which I photographed. I walked back across the roadway and examined to the
         debris, which matched Gunderson's vehicle. I located the passenger side headlight assembly near the
        base of the knocked down street sign. The headlamp was for the passenger side of the vehicle. I
        entered my patrol vehicle, at which time Gunderson continued to ask for a ride home and told me that
        I was fucking up his life and both of his jobs. Gunderson stated that he was talking to a couple of
        people about me the other day and they stated I was a "cgoodguy" and asked how he could get out of
        thi~,.Gunderson asked for an explanation on why I couldn't just give him a ride home. I explained to
        G~erson       that it's my duty to be fair and treat everyone who commits a crime equally. Gunderson
        asked me several times for "tips" on how to beat the DWI arrest. It should be noted that when I re-
        entered my patrol vehicle I activated my audio recorder on my shoulder to capture the conversation.
        At this time Minnesota State Trooper Norstrom arrived on scene. I requested Trooper Norstrom
        badge #225. take over the D WI portion of the accident. Trooper Norstrom approached Gunderson and
        explained to him that he would be conducting the DWI portion and had Gunderson exit my patrol
        vehicle. Trooper Norstrom had Gunderson perform the Horizontal Gaze Nystagmus. Gunderson
        advised Trooper Norstrom that he had previous surgery on his knees and would not be able to perform
        any type of balance tests. Norstrom then explained and administered a digital preliminary breath test
        to Gunderson. Norstrom advised Gunderson that he had failed for the HGN and preliminary breath
        test and placed him under arrest. Gunderson was placed into the rear seat of Norstrom's patrol
        vehicle. Norstrom left the scene at this time.

        Collins Brothers towing responded to the scene and removed the vehicle from the front yard. I placed
        a hold on the vehicle pending the DWI test results. I spoke to Scott Killinger at this time. Killinger
        advised me he heard a crash and looked outside and observed the blue Chevrolet blazer stuck in the
        Northeast corner of his front yard. Killinger observed the vehicle occupied only by the driver and
        observed the driver making an attempt to back out onto the street. Killinger reported that the driver
        had been rocking the vehicle back and forth in an attempt to free the vehicle until I ordered him to
        stop. After Collins Brothers Towing had removed the vehicle I photographed the area where
        Gundersonwas stuck. The tires had made it through almost 2 feet of snow down to the grass ..

        I, Officer J. Zwack, was advised by 220l/ChiefP.   Beise to follow up on this incident.

        I tried finding the home owner home at 1724 18 St. N., no one was home.

        03-22-13, 0738 Hours:

        I spoke with the home owner at 1724 18 St. N., he advised me that he did not have any damage to his
        garbage cans, etc. regarding this incident.

        I met with/spoke with Alicia Clark, 1726 18 St. N., Sauk Rapids, MN. Alicia said that her

    rented garbage cans were damaged, and Waste Mgt. is the company that owns these cans. Alicia said
    that Waste Mgt. told her to not worry about the damag~, they would take care of it. Alicia has no
    idea/no estimate of the candamage. I added Alicia's full name/phone information to this name file.
