1.         Summary
This Brief seeks to engage a Party (referred to hereinafter as the Leasee) to manage
and operate the Bingara Swimming Pool facility for the 2012/2013 pool season.

The Lease will be a single contact for the management and operation of the Bingara
Swimming Pool. The work will include preseason start up, grounds maintenance,
amenity cleaning, pool supervision, water testing, reporting.

The Lease will be for a period of one season with the option of two additional
seasons provided satisfactory management and operation of the swimming pool is
accomplished to Councils standards.

Pool season starts 1st October 2012 to 31st March 2013.

Minimum Opening hours are as follows:

                  October and March 12pm to 6pm

                  November, December, January and February 11am to 7pm.



Council will provide remuneration in the form of 8, monthly instalments of equal
value.

Council will provide operational costs such as pool chemical and electricity.

Pool admission charges are set by Council and retained by the Leasee.

The Leasee will be permitted to generate an income from the canteen.

All Advertisements for pool opening hours and associated activities are the
responsibility of the Leasee.



2.         General
The contract shall be between the Leasee and Gwydir Shire Council (the Principal).

The canvassing of Councillors at any time in respect of this Lease will not be
permitted. Any firm or representative canvassing or approaching Councillors shall be
disqualified from the process of being considered.

3.         Background

           a. Location
Bingara, a town of around 1200 people, is located in the North West slopes and
plains of NSW, approximately 150km North of Tamworth, 110km east of Moree and
70km west of Inverell. (see Appendix A – map)

The swimming pool facility is located on the Bundarra Road 800m from the post
office and adjacent to the Riverside caravan park.


           b. Existing Facilities
The swimming pool facility comprises of a 33m pool and a toddlers pool. Five large
shade structures are located at the pool covering the toddler’s pool, each end of the
33m pool and marshalling area at the deep end of the 33m pool.

The pool filtration is via 4 separate inline pumps and four pressure sand filters, at a
minimum 3 pumps and filters must be in operation to provide sufficient filtration.
Disinfection is by sodium hypochlorite and pH is control using hydrochloric acid. Both
systems have residual analyses and are automatic in control.

The amenities building was constructed in 1997 and comprising of an entry area,
canteen/kitchen, first aid room/office, men’s toilets and females toilets.

4.         Remuneration
          Lease payments - Council will provide remuneration in the form of 8, monthly
           instalments of equal value.

          Pool admission charges are set by Council and retained by the Leasee.

          The Leasee will be permitted to generate an income from the canteen.


           a. Pool Admission Prices
Pool admission prices are set by council, the current and next season prices are as
follows: Income from admission charges is retained by the Leasee.

           b. Pool attendance:
On average of 10,000 people per season attend the Bingara Swimming Pool. This
generates an average income of $19,000 dollars. The total numbers are made up of
17% Adults, 32% Children and 51% season ticket holders on an average.


           c. Canteen arrangement
The Leasee will be permitted to operate a canteen as a separate business. The
canteen must be registered with department of fair trading and the operator must
have the appropriate Food Handling authority training and certification. Evidence of
this must be provided with the tender.

Existing equipment consists of double door drink fridge, ice cream fridge,
300LWestinghouse fridge and a chest freezer.



5.         Expenses covered by Council

           a. Chemicals
All chemicals associated with the operations of the pool (Sodium hypochlorite,
hydrochloric acid, sodium bicarbonate). All water testing equipment and tablets.


           b. Electricity
All electricity charges associated with running the pool, including the kiosk.


           c. Water
All water charges associated with running the pool, including water access charge
and user charges for swimming pool and grounds maintenance.


           d. Rates
Gwydir Shire Council rates and charges associated with the pool.


           e. Insurance
Building insurance.

           f.     Building Maintenance
Major building maintenance will be responsibility of Council, such as painting of
building, roof or structure repairs, shade sail repairs.


           g. Equipment maintenance
All equipment maintenance will be responsibility of Council including pump repairs,
dosing equipment repairs and service, vacuum cleaners.


           h. Telephone
Line rental will be responsibility of Council, but all other phone charges will be the
responsibility of the Leasee. In internet connection may be provided at the cost of the
lessee.



6.         Expenses related to the Leasee

           a. Wages
Wages for the provision of a qualified life guard during opening hours of the
swimming pool. Wages for operational activities of the pool such as water testing,
operating pumping equipment, backwashing filters, adjusting chemical dosages and
all Grounds maintenance. The leasee is required to pay all wages associated with
the employment of extra staff or relief staff required to perform all duties required by
this contract.


           b. Consumables
All consumables related to the amenities, cleaning of the amenities. All activities of
the canteen.


           c. Grounds maintenance
The leasee is required to provide a mower and edging equipment, all fuels and oils to
operate the equipment to perform the maintenance required under this contract.


           d. Insurance
Within 4 weeks of Appointment and prior to the pool opening the Leasee will need to
provide:

          Proof of Workers’ Compensation or if exempt, proof of personal accident
           insurance

          Proof of Public Liability Insurance minimum of $20,000,000 and Gwydir Shire
           Council needs to be listed as an interested party.


           e. Advertising
All Advertisements for pool opening hours and associated activities are the
responsibility of the Leasee.


           f.     Telephone
All call charges will be responsibility of the Leasee, Council will issue monthly
account to the Leasee for all telephone charges except line rental. The leasee must
not, under any circumstances, change the service provider or change the telephone
contract arrangement.



7.         Skills, knowledge and experience (key selection criteria)

           a. Authority and Accountability
           Demonstrated communication and public relations and interpersonal skills and
            the ability to supervise pool patrons.


           b. Judgement and Problem Solving
          Ability to work within a team and unsupervised.
          Awareness of emergency procedures and sound knowledge of first aid and
           rescue techniques as applicable to an aquatic centre.


           c. Specialist Knowledge and Skills
          Thorough knowledge of the NSW Health Department’s health and safety
           standards for swimming pools.


           d. Essential Qualifications and Experience

          Certificate III in Aquatics;
          All supervisory staff present at the swimming pool must hold a current senior
           first aid certificate. There must be a least one person with a current senior first
           aid certificate within the grounds of the swimming pool whilst the pool is open
           to the public.

          All staff present at the swimming pool and acting as a life guard must hold a
           current RLSS Pool Lifeguard certificate or equivalent and demonstrated
           experience as a lifeguard. There must be a least one person with a current
           RLSS Pool Lifeguard certificate or equivalent (and demonstrated experience)
           within the grounds of the swimming pool whilst the pool is open to the public.
          All staff to be nominated by the leasee that will be acting as a life guard will be
           required to undertake a functional assessment in accordance with Royal
           Lifesaving Society Australia’s requirements. These staff must maintain the
           required physical fitness in accordance with the Royal Lifesaving Society
           Australia’s requirements throughout the course of the contract. Council
           reserves the right to demand a functional assessment of any staff thought not
           to be able to meet the Royal Lifesaving Society Australia’s requirements for
           physical fitness , as required by this contract (at Council’s expense).
          Hold a current national “C” class driver’s licence;
          Hold a Working with Children Check or provide proof of having applied for the
           assessment (eg receipt). Alternatively, the leasee must provide Council with
           authorisation to undertake a Working with Children Check for all staff engaged
           by the lessee who will be working under this contract;
          Hold a National (or Federal) Police Certificate (no more than 6 months old) if
           over 18 years old. Alternatively, the leasee must provide Council with
           authorisation to undertake a National (or Federal) Police Certificate check,
           where applicable, for all staff engaged by the leasee who will be working under
           this contract.
          Hold food handling certification

           e. Desirable:
          Certificate IV in recreation

          Experience in Pool management



8.         Scope of Engagement

           a. Patron supervision
To provide supervision of all patrons and ensure safety standards are maintained.


           b. First Aid
Administer first aid as required.

           c. Pool Operation
The Leasee shall undertake the following major tasks and roles as a minimum,
resulting in successful Management and operation of the Bingara swimming pool:


           d. Preseason
          Preseason – start up (filling, cleaning and vacuuming the pool. Pump
           operation and chemical dosing adjustment to ensure the pool is in a suitable
           condition for opening).

          Preseason grounds maintenance including watering, mowing and edging.


           e. Daily duties
The following maintenance/operation works shall be carried out on a daily basis by
the Leasee during the Swimming Season:

          To provide supervision of all patrons and ensure safety standards are
           maintained;

          check and clean amenities as often as required to ensure cleanliness at all
           times;

          vacuum pools and remove debris from outlets and screens;

          office work including the acceptance and recording of bookings for the
           Swimming Centre and attending to patrons as required, supervising entry and
           pool users. Completion of daily pool running sheet.

          check and monitor water quality of the pools;

          regulate the circulation of sodium hypochlorite at appropriate rates;

          backwash filters and carry out routine maintenance of plant in accordance with
           operating instructions;

          maintenance and adjustment to the pool cleaning equipment;

          ensure the safety of all patrons in the event of a thunder storm, including the
           closure of the pool complex, if required. If the pool complex is closed due to a
           thunderstorm, it must be reopened within 20 minutes, if deemed by the Life
           Guard that it is safe for patrons to re-enter the complex. The Life Guard must
           make the assessment of the dangers associated with thunderstorms as an
           threat in the immediate vicinity of the pool complex and not based on a distant
           and/ or possible threat.

           f.     General
          carry out all normal operation and maintenance works and running repairs
           associated with the Swimming Centre and shall carry out all such routine
           maintenance in respect of greasing and cleansing as may be prescribed by
           the Council and in particular shall paint and grease locks, hinges, ironwork
           and turnstiles at least once in each year.

          operation of all water purification equipment with the Swimming Centre
           including the control of water quality and cleanliness, chlorine levels and pH in
           accordance with the NSW Department of Health Public Swimming Pool and
           Spa Pool Guidelines 1996;

          carry out risk assessments to identify hazards, assess the likelihood and
           consequence of the hazard to cause harm to and implement control measures
           to minimise the risk of harm.

          minor repairs to buildings;

          repairs to minor breaks in the security fencing;

          provision of maintenance labour for minor repairs to Council equipment used
           by the Leasee;

          maintenance of all locks and keys (the Council to renew locks as necessary).

          The Leasee shall maintain all buildings, toilets, urinals, cubicles, lockers,
           shower recesses, offices, plant room, filtration plant and equipment chemical
           treatment and filtration plant and equipment, water purification equipment
           (including annual servicing charges and expenses of all of those items) drains,
           taps, showers and all other structures, fittings and fixtures situated in or
           forming part of the Swimming Centre.

          The Leasee shall keep any gardens forming part of the Swimming Centre
           watered, neat, well trimmed and free from weeds and shall water, cultivate,
           manage and maintain all lawns shrubs and trees in a proper manner close
           mowing the lawns from time to time whenever necessary. All equipment shall
           be supplied by the Leasee.

          The Leasee shall ensure that for at least eighty per centum (80%) of the
           period during which the Swimming Centre is open to the public they are
           personally on duty at the Swimming Centre to supervise the conduct and
           running of the Swimming Centre and that for the balance of such period the
           Leasee or a person duly authorised by the Council in writing will be on duty at
           the Swimming Centre to so supervise.

          The leasee must provide details of all staff engaged under this contract and
           provide the required documentation as required by the role and or roles that
           persons will be performing, as detailed above. The lessee must advise
           Council’s contract manager of any proposed changes to staffing
           arrangements. In particular, the leasee must not engage any staff until all
           documentation, as required by this contract has been provided to the Contract
           Manager, and the appointment has been approved by Council’s Contract
           Manager. Council reserves the right to scrutinise any staff appointment.
           Council also reserves the right to scrutinise the continued engagement of any
           member of the leasee’s staff. The leasee must comply with all directions
           provided by Council with regards to engaging, disciplining or dismissing staff,
           within the constraints of the contract and applicable employment law.

          The Leasee shall at their expense at the end of the Swimming Season close
           down the Swimming Centre. Without limiting the generality of the foregoing
           the Lessee shall:

                 o Ensure that all equipment and stock supplied is clean and tidy.

                 o Ensure that the pool surrounds and kiosk are clean and tidy.

                 o Ensure the pool record books are returned to Council.

                 o Ensure the standard of maintenance is satisfactory.

                 o Ensure that any repair or maintenance works required to the pool
                   complex are reported to Council for action in the off season.

12. Assessment of the Application
Applications will be assessed on skills, qualification in the selection criteria and price
submitted for the Lease. The lowest tender will not necessarily be accepted.

Applicants under consideration will be interviewed by council and will be required to
under a functional assessment and working with children check for the position
before appointment. (At Councils expense)

The functional assessment includes medical examination, swimming and rescue
assessment to ensure the applicant can physical carry out the job.
