PURPOSE:
This protocol was developed to establish criteria for the lowering of the Canadian flag flown on Township flagstaffs.
POLICY:
That the Township of Muskoka Lakes have a uniform and coordinated flag protocol for Township buildings.
STANDARDS: 1. Flags are flown at the half-mast position as a sign of mourning. 2. Flags on Township of Muskoka Lakes flagstaffs shall be lowered to half-mast when directed by the CAO or designate. Council shall be informed of this via email, fax, or telephone so that they may answer questions regarding the purpose. General circumstances will include:

On the death of the Sovereign or a member of the Royal Family related in the first degree to the Sovereign (spouse, son or daughter, father, mother, brother or sister), the Governor General, the Prime Minister, a former governor general, a former prime minister, or a federal cabinet minister; On the death of the Lieutenant Governor, the Premier or another person similarly honored by the province of Ontario; On the death of our serving Member of the House of Commons, or our Member of the Provincial Legislature; On the death of a Senator, a Canadian Privy Councillor, or a Mayor; On the death of a person whom it is desired to honour.

Flag protocol for Remembrance Day, November 11, will be in accordance with ceremonial protocol. Protocol for lowering the flag to half-mast will be as follows:

The flag is brought to the half-mast position by first raising it to the top of the mast then immediately lowering it slowly to the half-mast position. The position of the flag when flying at half-mast will depend of the size of the flag and the length of the flagstaff. It must be lowered at least to a position recognizably “halfmast” to avoid the appearance of a flag, which has accidentally fallen away from the top The Corporation of the Township of Muskoka Lakes TOWNSHIP POLICY C-LS-02 Page 1 of 2
of the mast due to a loose flag rope. A satisfactory position for half-mast is to place the centre of the flag exactly halfway down the flagstaff.

For areas that may have more than one flagstaff and the Canadian flag is brought to half-mast, then all flags shall be brought to half-mast and all to the same height. Flagstaffs not equipped with halyards and pulleys shall not be placed at half-mast. Flags shall be lowered to the half-mast position upon notification of the death or when directed by the CAO or designate. Flags shall remain at half-mast until sunset the day of the funeral.
Community Centres and Hallboards will be subject to this policy and coordinate with the Township. Every effort will be made to coordinate the timing of the lowering and raising of flags at all Township facilities.

PURPOSE:
To establish rates for charging the general public for photocopying that will encourage alternate service sources to be used
POLICY:
That the Township of Muskoka Lakes charges the following rates for photocopying for the general public: 1 to 10 copies 11 & over Special Groups Staff time @ $ 0.50 per copy $ 0.25 per copy $ 0.10 per copy $25.00 per hour
STANDARDS: 1. 2. The Township purposely charges higher than commercial fees. The Township does not want to compete with private photocopying businesses, nor infringe on private enterprise. Special Groups within the Township are: The Museum Figure Skating Clubs Minor Hockey Clubs Ringette Clubs Vintage Blue (Senior Figure Skating) a. When the special group provides the paper required, the fee may be waived at the discretion of the Clerk. 3. Retention of Records

PURPOSE:
To establish a schedule of retention periods during which receipts, vouchers, instruments, rolls or other documents, records and papers must be kept by the Township of Muskoka Lakes.
POLICY:
That the Township of Muskoka Lakes will retain records as required by legislation and prudent business practices.
RESPONSIBILITIES: The Clerk shall oversee all departments’ records and record storage to monitor compliance with the Policy and with related Administrative Procedures.
STANDARDS:
Detailed Records Management Procedures are provided in Administrative Procedure A-LS-04. Record retention periods shall be established by Municipal By-law and approved by the municipal auditor.

Sale of Flooded Land

PURPOSE:
To provide a procedure for the sale of flooded land.
POLICY:
Pursuant to Section 43 of the Municipal Act, 2001, as amended, a municipality that permanently closes a highway shall not convey the land forming the highway if it is covered with water without the consent of the Ministry of Natural Resources. Pursuant to Section 43 of the Act, the Ministry of Natural Resources has provided written consent to the Township of Muskoka Lakes to close and convey the flooded portions of original shore road allowance adjacent to private landowners where Council deems it appropriate. Pursuant to Township Council Policy C-LS-08 (Original Shore Road Allowance), the Township of Muskoka Lakes will consider applications for the closure and conveyance of original shore road allowances to the abutting landowner. All closures are at the discretion of the Township of Muskoka Lakes. Generally, portions of the original shore road allowance covered with water will remain in the ownership of the Township of Muskoka Lakes.
In the case of a two storey boathouse or a boathouse with living accommodation and in order to meet the Ministry of Natural Resources Free Use of Crown Land Policy, the Township of Muskoka Lakes will consider the sale of a portion of the flooded original shore road allowance when the landowner applies to obtain ownership of the crown lakebed where their boathouse is situated.
STANDARDS:

The Township of Muskoka Lakes will consider the sale of a portion of the flooded original shore road allowance in the case of a two storey boathouse or a boathouse with living accommodation when the landowner applies to obtain ownership of the crown lakebed where their boathouse is situated in order to meet the Ministry of Natural Resources Free Use of Crown Land Policy. The Ministry of Natural Resources will only consider the sale of crown land under a two-storey boathouse to those persons who own the land directly abutting it. The Township of Muskoka Lakes will only consider the sale of the original shore road allowances to the abutting landowner.

In these site specific cases, the surveyor will designate the portion of flooded shore road allowance directly between the unflooded portion and the crown lakebed under the two storey boathouse that is to be purchased, as a separate part number on a registered reference plan. The sale price of the flooded land will be charged at the rate equivalent to the price per lake as set out in the schedule in Township Council Policy C-LS-08 (Original Shore Road Allowance). In the case of a new original shore road allowance closing application, the standard application form and fee will be required. The request to purchase the flooded land will be included as part of the standard application process pursuant to Township Council Policy C-LS-08 (Original Shore Road Allowance). For those applications that have already acquired the unflooded portion of original shore road allowance, a new application form and fee will not be required. a. b. The applicant must submit a written request to the Township Clerk. The applicant will be responsible for all survey, legal, by-law, registration and other costs associated with the closure and conveyance.
