EXHIBIT “A” RIDER
Exhibit “A” is herein incorporated and made part of the “ENTERTAINMENT ENGAGEMENT AGREEMENT” between __________________ (hereinafter known as ______________________) and __________________ (hereinafter know as PRODUCER) for the services of James Brandon (hereinafter known as ACT). ACT can present his Magic and Illusion performance providing PRODUCER complies with the provisions required as stipulated in this Rider. ACT cannot be held accountable in the event PRODUCER fails to comply with the following provisions: TRANSPORTATION 1. All props/equipment to be picked up at _____________________________________ no earlier than 2 weeks prior to the commencement date of the contract, and returned to __________________________________________ no later than 2 weeks after the conclusion of the contract. PRODUCER will transport props as needed during the entire duration of the contract. 2. The animals – _______________________________to be picked up and returned to ________________________________________________at the conclusion of the tour, no later then three days thereafter. Animals to be transported by PRODUCER during the entire duration of the tour at PRODUCERS expense. HOUSING OF PROPS AND ANIMALS 1. Props to be kept in a storage area safe from weather damage and vandalism. PRODUCER to be completely responsible for the safe keeping of ACT’s props inside of the venue and when transported. 2. ACT will provide a portable collapsible compound per code “requirements” to keep animals during the day. Such compound must be put inside PRODUCERS truck/trailer overnight for safekeeping. PRODUCER to provide night watchman/security. STAGE 1. ACT must have proper area to store and access props while on stage. Storage area on stage must be in compliance to ACT’s performance needs. ACT must have stage free of obstacles that will impede the flow of ACT’s performance, see ACT’s diagram of preferred stage set up.

11/9/09 ________ Initial here -> STAGE -continued a. Stage to have at least 3 fly bars to hang 3 curtains. b. PRODUCER to provide 3 curtains as described; one blackout curtain, one light color shimmering drop, one front house curtain. Curtains/drops are to be purchased by PRODUCER. c. Overhang height to be no less then 25 feet in height from the stage floor to the top of the frame structure. And 8 feet in front of back black curtain. Proscenium opening to be 20 feet in height and a minimum of 32 feet wide. d. Stage floor to have a minimum of 14 feet in front of proscenium. Floor to be flat and smooth without obstructions of any kind. Behind proscenium a minimum of 15 feet are required. e. Stage area must be air conditioned. f. Stage must have guardrails on outside side edges to prevent props, dancers and assistants from falling over the edge. LIGHTING 1. PRODUCER to provide 2 super trooper follow spots and minimum of 8 moving lights. 6 above stage and 1 on each side of stage. In addition to full color washes, color washes to be hung on stage in front of stage and behind proscenium. PRIVATE DRESSING ROOM 1. To be attached to back of stage completely enclosed floor on same level. Dressing room facility to be air conditioned and must have a dehumidifier. 2. Dressing room facility to be carpeted, have two clothes racks, make up table with mirror and lights, 4 chairs and 2 tables (minimum 18 inches x 36 inches) to preset effects and Pyro. 3. In the event ACT is to use dressing room as rest area PRODUCER is to provide sofa and sofa chair with coffee table and sufficient electrical outlets, minimum of 6 outlets running on 110 power or transformers must be provided by PRODUCER. 4. Dressing room to be clean and sanitized so as to preserve costumes and all magic paraphernalia required for ACT’s performance. 5. PRODUCER will provide a water cooler for the exclusive use of James and his assistants and will keep it full at all times with filtered drinking water. 6. PRODUCER will provide a toilet for ACT’s exclusive use. If a portable toilet is to be used, than it must have a lock on it and sit within 40 feet of ACT’s dressing room. Toilet must be cleaned every night after the shows have finished. 7. Dressing room to be locked overnight. Producer is responsible for the safe keeping of all props, costumes and personal items in dressing rooms. ________ JB ________ SM

1. Because the assistants are an intricate part of ACT’s grand illusions, it is imperative that PRODUCER supports ACT’s final decision in choosing 5 female dancers during auditions for PRODUCERS line up at no expense to ACT. The nature of the tasks that dancers are required to perform necessitates for ACT to interview and have a rehearsal with the dancers selected to be “Magic Assistants” on stage. 2. Dancers are to take direction from ACT therefore, dancers should have clause in their contract with PRODUCER to reflect this requirement. ACT will provide dancers with costumes. Dancers are to adhere to ACT’s rules and regulations. 3. Dancers are to be informed that they may come in close contact with exotic animals such as tigers. INSURANCE 1. PRODUCER warrants that his general insurance policy will cover the contents of James Brandon’s props and animals when they travel and when they are being housed and/or stored at venue or in producers trucks. 2. PRODUCER warrants that his general insurance policy will cover James Brandon, his assistants and dancers during the performances, rehearsals, setup of props, breaking down of props and between shows. 3. PRODUCER warrants that his general insurance policy will cover any audience members that might be brought up on stage during shows. TRAVEL EXPENSES 1. PRODUCER will reimburse ACT on a weekly basis with gasoline money when ACT is able to utilize his personal vehicle for the purpose of transporting ACT to next city. PRODUCER will pay for ACT’s airfare and local transportation in the event the allotted time or distance to travel to the next city is deemed difficult or unreasonable by ACT. 2. ACT’s animal handlers will drive and travel in code-approved vehicle provided by PRODUCER for the duration of the entire tour. PRODUCER will provide ACT’s animal handlers with local transportation during tour to purchase meat for animals in each city. ACT’s animal handlers are unable to travel with animals, PRODUCER will provide airfares for two animal handlers when required. COMPS 1. ACT to be entitled to 25 complimentary seats per week for his guests, in mid-center or front seats.

PHOTOGRAPHY and VIDEOGRAPHY 1. Photography and videography of ACT’s performance is strictly prohibited without the Express written consent of ACT. 2. Act may video tape or photograph his performances as he sees fit as long as it does not interfere with the audiences view of the show.

COMMUNICATIONS 1. PRODUCER will provide ACT with 2 local use cell phones. 2. PRODUCER will provide ACT 2 walkie talkies to communicate during show.

PYRO PRODUCER will provide the following: 1. 5 Ounces of low altitude “Airburst” flash powder for every 50 shows. 2. 8 Ounces of flash cotton for every 50 shows. 3. 50 sheets (10 inches x 10 inches) of flash paper for every 50 shows. 4. 350 feet of black flash string for ever 50 shows. 5. 1 gallon of lantern fuel for every 50 shows. 6. 1 pint of lighter fluid for every 50 shows. MISCELLANEOUS 1. No act using any animals will take place when the temperature on or backstage exceeds 80 degrees Fahrenheit. 2. All cast and crew must sign James Brandon’s secrecy agreements, rules and regulations and any rules that the animal trainers may provide.
