                                           MINUTES


Regular                The Board of Commissioners met in regular session on Tuesday, September 6,
Commission      2011, at 6:00 p.m. in the Commission Chambers of the David Perry County
Meeting         Administration Building, 423 College Street, Carrollton, Georgia.

                       The meeting was called to order by Chairman Bill Chappell.

Invocation             The invocation was offered by Commissioner George Chambers.

Pledge of              The Pledge of Allegiance was led by Commissioner John Wilson.
Allegiance

Roll Call              Roll was called by the County Clerk.

Minutes                The minutes of the August 2 and 31, 2011 meetings were adopted, as
                previously circulated, on a motion by Commissioner Jackson and seconded by
                Commissioner Wilson.

Public                 Public comments were made by: Charles Rousseau, Paul Blaum, Joseph
Comments        Grannum and Rosalyn Smith. Comments were tendered on the following subjects:
                Animal Control procedures, Lighthouse Ministries, and Valley Circle property.

Financial               County Comptroller Don Johnson presented the financial recap of County
Session         funds as of July 31,2011 reporting a total cash reserve of $8,375,923 with
                revenues to date totaling $138,285 (0.3%), and expenditures to date totaling
                $2,760,906 (5.7%), and a fund balance of$10,211,336.

J. Smith Lani          On a motion by Commissioner Hendrix and seconded by Commissioner
& Co. Contr     North, the Commission voted 6-0 (Anderson absent) to approve changing the
Auto Damag      County's automobile physical damage coverage deductible, through J. Smith
Deductible      Lanier & Co., for FY2011-2012 from $25,000 to $5,000 with an increased premium
                of approximately $48,000 to be funded by the Sheriff's Office.

Resolution             On a motion by Commissioner Hendrix and seconded by Commissioner
Little         North, the Commission voted 6-0 (Anderson absent) to approve a Resolution
Tallapoosa     authorizing a contract between the Georgia Department of Natural Resources
Trails Grant   and Carroll County for a Recreational Trails Program grant (NRT-I0(10» for the
               construction of trails at the Little Tallapoosa Park in the amount of $100,000 with
               a $25,000 local match.

Resolution             On a motion by Commissioner Hendrix and seconded by Commissioner
Little         Wilson, the Commission voted 6-0 (Anderson absent) to approve a Resolution
Tallapoosa     authorizing the County's application for a Tourism Product Development Grant
Signage Gr     through the Georgia Department of Economic Development Tourism Division to
               develop a signage program for the Little Tallapoosa Park in the amount of $20,000
               with a local match of 100% (60% cash + 40% in-kind).

Bids -                On a motion by Commissioner Wilson and seconded by Commissioner
Little         Hendrix, the Commission voted 6-0 (Anderson absent) to accept and approve
Tallapoosa     West Georgia Electric, Inc.'s bid of $146,620 for the materials, labor, tools,
Phase 1        equipment and appurtenances for the construction of the Little Tallapoosa Park
Electrical     Phase 1 Electrical (RFP 12-A002).

Barnes Drive          On a motion by Commissioner Wilson and seconded by Chairman
Property       Chappell, the Commission voted 5-1 (Hendrix opposed, Anderson absent) to
Purchase       approve a land purchase and sale agreement for the purchase of 16.94 acres
               located on Barnes Drive, Carrollton (Land Lot 217 of the 5th Land District) for
               $169,400.

Temple                On a motion by Commissioner Hendrix and seconded by Chairman
Recreation     Chappell, the Commission voted 5-1 (Jackson opposed, Anderson absent) to
Property       approve the City of Temple's request for funding assistance for the purchase of
Purchase       11.3 acres on Rainey Road, Temple for expansion of the City's Recreation
               Department in the amount of $57,500 (Y2 total purchase price of $115,000).

E-911                  On a motion by Commissioner Hendrix and seconded by Commissioner
Charges        Wilson, the Commission voted 6-0 (Anderson absent) to approve a Resolution
Resolution     Authorizing and Reaffirming the Imposition of Enhanced E 9-1-1, Voice Over
               Internet Protocol (VolP) Connections and Prepaid Wireless 9-1-1 Charges within
               Carroll County, Georgia. ($1.50/mthly for land lines, $1.50/mthly for wireless
               connections, $1.50/mthly for VoIP, and $.75/transaction for prepaid wireless).

John Tanner             On a motion by Commissioner Wilson and seconded by Commissioner
State Park     Hendrix, the Commission voted 6-0 (Anderson absent) to approve a Resolution
Conveyance     Approving the Proposed Conveyance of John Tanner State Park From the State of
               Georgia to Carroll County, Georgia, Acknowledging the Prohibition of
               Assignment of Any Interest in John Tanner State Park to Any Private Individual
               or Entity, Acknowledging Agreement Not to Enter Into an Operational Agreement
               With a Third Party for John Tanner State Park that Conveys a Real Property
               Interest and Setting Forth the Intended Uses for John Tanner State Park.

Survivor                  On a motion by Commissioner Jackson and seconded by Commissioner
Medical          Wilson, the Commission voted 5-0 (Hendrix abstained, Anderson absent) to
Insurance        approve the request to allow the continuation of medical and dental benefits for the
Benefits         surviving spouse and dependent children of a County employee killed in the line of
                 duty (the employee's death must occur within the course and scope of employment
                 under the same guidelines as workers' compensation and the employee's injury
                 resulting in death must be determined to be a covered workers' compensation
                 claim).


Mt. Zion                 On a motion by Commissioner North and seconded by Commissioner
Annexation       Hendrix, the Commission voted 6-0 (Anderson absent) to table consideration
Agreement        of an Intergovernmental Agreement between the City of Mt. Zion, Georgia and
                 Carroll County for the annexation of the City-owned ball fields located on Tanners
                 Beach Road.


Appointment· -           On a motion by Chairman Chappell and seconded by Commissioner
Region 6         Hendrix, the Commission voted 6-0 (Anderson absent) to appoint Rev. Charles
DBHDD            Thomas to the Region 6 Department of Behavioral Health Developmental
Planning Bo      Disabilities Planning Board for a term beginning immediately and ending June 30,
                 2014.


Zoning                  Before beginning the Zoning Session, Chairman Chappell stated the policies
Session          and procedures governing the conduct of zoning hearings. The applicant(s) or
                 proponent(s) of the zoning application shall be allowed ten (10) minutes to present data,
                 evidence, and opinion. Those opposed to the zoning application shall be allowed ten
                 (10) minutes to present data, evidence, and opinion. Both sides shall be allowed five (5)
                 minutes for rebuttal.


Conditional             On a motion by Commissioner Wilson and seconded by Commissioner
Use Permit-      Hendrix, the Commission voted 6-0 (Anderson absent) to approve the request of
Hutcheson        Pamela J. Taylor for a Conditional Use Permit (application C-11-08-01) to build a
Ferry Road,      guest cottage at the front of property (9.42+1- total acres) owned by Pamela J.
Whitesburg       Taylor, located at 4175 Hutcheson Ferry Road, Whitesburg, and lying in Land Lot
                 0098 of the 3rd Land District (also known as Carroll County Tax Map #206, Parcel
                 #0007 as shown on Conditional Use Permit Application #C-11-08-01).


Conditional              On a motion by Commissioner Hendrix and seconded by Commissioner
Use Permit-      North, the Commission voted 6-0 (A'<derson absent) to approve the request of
Old              Tammy Watson for a Conditional Use Permit (application C-11-08-02) to split out
Draketown        and purchase a 3.0 +1- acre tract (4.54+1- total), on property owned by Thomas,
Temple           Sprayberry, located at Old Draketown Road, Temple, and lying in Land Lot 0280
                 of the 6th Land District (also known as Carroll County Tax Map #120, Parcel
                 #0117 as shown on Conditional Use Permit Application #C-11-08-02).

Adjournment          There being no further business to come before the Commission, the
              same was adjourned at 6:43 p.m. on a motion by Commissioner Wilson and
              seconded by Commissioner North.
