A RESOLUTION TO PROMOTE THE HEALTH AND WELLNESS OF THE CITY OF SOUTH PORTLAND RESIDENTS, EMPLOYEES AND VISITORS BY ESTABLISHING THE CITY OF SOUTH PORTLAND PARKS AND RECREATION ATHLETIC FACILITIES, PLAYGROUNDS, AND ASSEMBLY AREAS AS TOBACCO-FREE ZONES BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SOUTH PORTLAND, MAINE, THAT WHEREAS, the City of South Portland, Maine, strives to be a safe and healthy place to live, work and play; and WHEREAS, tobacco use is the single most preventable cause of death and disease in the United States, as well as in South Portland, Maine; and WHEREAS, secondhand smoke is proven to contain many harmful chemicals and cancer-causing agents and is a serious health risk to humans, especially infants, children and pregnant women, and increases a non-smoker’s risk for asthma, heart disease and lung cancer; and WHEREAS, the use of tobacco products in public is associated with cigarette and cigar butts being cast upon the public grounds, beaches, parking areas and other surfaces in the City of South Portland Parks and Recreation settings; and WHEREAS, chewing tobacco contains many harmful chemicals and cancercausing agents, and its use is associated with cancers of the mouth, gums, tongue and throat; and WHEREAS, the use of chewing tobacco is associated with saliva, or spit, being cast upon the ground, seating areas and other surfaces in recreational settings; and WHEREAS, tobacco use in and around the City of South Portland Parks and Recreation facilities sends contradictory messages to young people in being encouraged to participate in activities beneficial to their health, while

at the same time being exposed to the use of tobacco products and secondhand smoke; and WHEREAS, the purpose of the City of South Portland Parks and Recreation Department is to provide quality recreation and leisure experiences that enhance the quality of life for South Portland residents and visitors, including providing a safe environment for these experiences; and WHEREAS, tobacco-use, exposure to secondhand smoke, discarded cigarette butts and potential fire hazards are contrary to enhancing the quality of life and providing clean, safe and healthy environments. NOW, THEREFORE, BE IT RESOLVED, by the South Portland City Council, that we do hereby approve this resolution promoting the health, wellness and safety of the City of South Portland residents, employees and visitors by establishing South Portland Parks and Recreation areas as tobacco-free zones and where the use of any tobacco product, including but not limited to cigarettes, cigars, and chewing tobacco, on, in or at any recreational area, athletic field, playground or public park assembly area under the authority of the City of South Portland Parks and Recreation Department is discouraged. BE IT FURTHER RESOLVED, that the City of South Portland Parks and Recreation Department and/or other City staff overseeing an event or activity in any of the public areas noted above are authorized to take reasonable steps such as posting signage, distribution of written materials, and the use of other communication tools to achieve voluntary compliance with the tobacco-free zones as set forth herein this document.
