Medicare must provide coverage of skilled care and therapy services to beneﬁciaries,
even if the beneﬁciary cannot show a likelihood of improvement. This change to
Medicare’s long-standing practice came as a result of a class action settlement in a
Federal court in Vermont.
President Obama signed the Strengthening Medicare and Repaying Taxpayers
(SMART) Act, intended to streamline the Medicare Secondary Payer Process. This
impacts cases where Medicare is entitled to reimbursement for medical expenses it
paid while a personal injury lawsuit is pending.
A Massachusetts Court reafﬁrmed the Doctrine of Necessaries, which holds that a
person is liable for his or her spouse’s medical expenses. Texas also follows the
Doctrine of Necessaries.
And, ﬁnally, Seniors have developed their own texting codes. Here’s a brief guide.
