   10       PROCESS FOR SETTLEMENT METERING OPERATING GUIDE- REVISIONS


   10.1       Introduction

            (1)       A request to make additions, edits, deletions, revisions, or clarifications to the
                      Settlement Metering Operating Guide (Guide), including any attachments and
                      exhibits to this Guide, is called a “Settlement Metering Operating Guide
                      Revision” (SMOGRR). Except as specifically provided for in other Sections of
                      this Guide, this Section shall be followed for all SMOGRRs. ERCOT Members,
                      Market Participants, PUCT Staff, ERCOT Staff, and any other entities are
                      required to utilize the process described herein prior to requesting, through the
                      PUCT or other Governmental Authority, that ERCOT make a change to this
                      Guide, except for good cause shown to the PUCT or other Governmental
                      Authority.

            (2)       All decisions of the Metering Working Group (MWG), as defined below, the
                      ERCOT Wholesale Market Subcommittee (WMS),the Technical Advisory
                      Committee (TAC) and the ERCOT Board with respect to any SMOGRR shall be
                      posted to the Market Information System (MIS) within three Business Days of the

                date of the decision. All such postings shall be maintained on the MIS for at least
                180 days from the date of posting.

        (3)     The “next regularly scheduled meeting” of the MWG, WMS, the TAC or the
                ERCOT Board shall mean the next scheduled meeting for which required notice
                can be timely given regarding the item(s) to be addressed, as specified in the
                appropriate Board or committee procedures.

        (4)     Throughout the Guide references are made to the ERCOT Protocols. ERCOT
                Protocols supersede the Guide and any SMOGRR must be compliant with the
                Protocols. The ERCOT Protocols are subject to the revision process outlined in
                ERCOT Section 21, Process for Protocol Revision.

        (5)     ERCOT Staff may make non-substantive corrections at any time during the
                processing of a particular SMOGRR. Under certain circumstances, however, the
                Guide can also be revised by ERCOT Staff rather than using the SMOGRR
                process outlined in this section.

                (a)     This type of revision is referred to as an "Administrative SMOGRR" or
                        “Administrative Changes” and shall consist of non-substantive
                        corrections, such as typos (excluding grammatical changes), internal
                        references (including table of contents), improper use of acronyms, and
                        references to ERCOT Protocols, PUCT Substantive Rules, the Public
                        Utility Regulatory Act (PURA), North American Electric Reliability
                        Council (NERC) regulations, Federal Energy Regulatory Commission

10.2    Submission of a Settlement Metering Operating Guide Revision Request

The following Entities may submit a SMOGRR:

        (1)     Any Market Participant;

        (2)     Any Entity that is an ERCOT Member;

        (3)     PUCT Staff;

        (4)     ERCOT Staff; and

        (5)     Any other Entity who resides (or represent residents) in Texas or operates in the
                ERCOT Region.


10.3      Metering Working Group

        (1)     WMS shall assign a working group ("Metering Working Group" or “MWG”) to
                review and recommend action on formally submitted SMOGRRs. WMS may
                create such a working group or assign the responsibility to an existing working
                group, provided that:

                (a)     Such subcommittee’s meetings are open to ERCOT Staff, ERCOT
                        Members, Market Participants, and the PUCT Staff; and

                (b)     Each Market Segment is allowed to participate.

        (2)     Where additional expertise is needed, the MWG may request that WMS refer the
                SMOGRR to existing subcommittees, working groups or task forces for review
                and comment on the SMOGRR. Suggested modifications—or alternative
                modifications if a consensus recommendation is not achieved by a non-voting
                working group or task force—to the SMOGRR shall be submitted by the chair or
                the chair’s designee on behalf of the subcommittee, working group or task force
                as comments on the SMOGRR for consideration by MWG. However, the MWG
                shall retain ultimate responsibility for the processing of all SMOGRRs.

        (3)     The MWG shall ensure that the Guide is compliant with the ERCOT Protocols.
                As such, the MWG will monitor all changes to the ERCOT Protocols and initiate
                any SMOGRRs necessary to bring the Guide in conformance with the ERCOT
                Protocols. The MWG will also initiate an ERCOT Protocol Revision Request
                (PRR) if such a change is necessary to accommodate a proposed SMOGRR prior
                to proceeding with that SMOGRR.

        (4)     ERCOT shall consult with the chair of the MWG to coordinate and establish the
                meeting schedule for the MWG or other assigned subcommittee. The MWG shall
                meet at least once per month, unless no SMOGRRs were submitted during the
                prior 24 calendar days, and shall ensure that reasonable advance notice of each
                meeting, including the meeting agenda, is posted to the MIS.

10.4      Settlement Metering Operating Guide Revision Procedure


10.4.1         Review and Posting of Settlement Metering Operating Guide Revision Requests

         (1)      SMOGRRs shall be submitted electronically to ERCOT by completing the
                  designated form provided on the MIS. ERCOT shall provide an electronic return
                  receipt response to the submitter upon receipt of the SMOGRR.

         (2)      The SMOGRR shall include the following information:

                  (a)    Description of requested revision;

                  (b)    Reason for the suggested change;

                  (c)    Impacts and benefits of the suggested change on ERCOT market structure,
                         ERCOT operations, and Market Participants, to the extent that the
                         submitter may know this information;

                  (d)    SMOGRR Impact Analysis (IA) (applicable only for a SMOGRR
                         submitted by ERCOT Staff);

                  (e)    List of affected Guide Sections and subsections;

                  (f)    General administrative information (organization, contact name, etc.); and

                  (g)    Suggested language for requested revision.

         (3)      ERCOT shall evaluate the SMOGRR for completeness and shall notify the
                  submitter, within five Business Days of receipt, if the SMOGRR is incomplete,
                  including the reasons for such status. ERCOT may provide information to the
                  submitter that will correct the SMOGRR and render it complete. An incomplete
                  SMOGRR shall not receive further consideration until it is completed. In order to
                  pursue the revision requested, a submitter must submit a completed version of the
                  SMOGRR with the deficiencies corrected.

         (4)      If a submitted SMOGRR is complete or once a SMOGRR is corrected, ERCOT
                  shall post the complete SMOGRR to the MIS and distribute the SMOGRR to the
                  MWG within three Business Days.


10.4.2         Withdrawal of a Settlement Metering Operating Guide Revision Request

         (1)      By providing notice to MWG, the submitter of a SMOGRR may withdraw the
                  SMOGRR at any time prior to a recommendation for approval of the SMOGRR
                  by the MWG. ERCOT shall post a notice of the submitter’s withdrawal of a
                  SMOGRR on the MIS within one Business Day of the submitter’s notice to
                  MWG.

         (2)      The submitter of a SMOGRR may request withdrawal of a SMOGRR after a
                  recommendation for approval by MWG. Such withdrawal must be approved by
                  the WMS (if it has not yet been considered by WMS) or by TAC (if it has been
                  recommended for TAC approval by WMS, but not yet considered by the TAC).

         (3)      Once approved by the TAC, a SMOGRR cannot be withdrawn.


10.4.3         Metering Working Group Review and Action

         (1)      Any interested party may comment on the SMOGRR.

         (2)      To receive consideration, comments must be delivered electronically to ERCOT
                  in the designated format provided on the MIS within 21 days from the posting
                  date of the SMOGRR. Comments submitted after the due date of the 21 day
                  comment period may be considered at the discretion of MWG after these
                  comments have been posted. Comments submitted in accordance with the
                  instructions on the MIS—regardless of date of submission—shall be posted to the
                  MIS and distributed electronically to the MWG within three Business Days of
                  submittal.

         (3)      The MWG shall review the SMOGRR at its next regularly scheduled meeting
                  after the end of the 21 day comment period, unless the 21 day comment period
                  ends less than three Business Days prior to the next regularly scheduled MWG
                  meeting. In that case, the SMOGRR will be reviewed at the next regularly
                  scheduled MWG meeting. At such meeting, the MWG may take action on the
                  SMOGRR to:

                  (a)    Recommend approval as submitted or modified;

                  (b)    If no consensus can be reached, present options for WMS consideration;

                  (c)    Recommend rejection;

                  (d)    Defer action on the SMOGRR; or

                  (e)    Request that WMS refer the SMOGRR to a subcommittee, workgroup, or
                         task force.

         (4)      Within three Business Days after MWG takes action (other than deferral),
                  ERCOT shall issue a report (“MWG Recommendation Report”) to WMS
                  reflecting the MWG’s action and post the same to the MIS. The MWG
                  Recommendation Report shall contain the following items:

                  (a)    Identification of submitter;

                  (b)    Revised Guide language, when appropriate;

                  (c)    Identification of authorship of comments;

                  (d)    Proposed effective date(s) of the SMOGRR;

                  (e)    Recommended action; and

                  (f)    Recommended priority and rank for any SMOGRRs requiring a change to
                         ERCOT’s computer systems.


10.4.4         Comments to the Metering Working Group Recommendation Report

         (1)      Any interested party may comment on the MWG Recommendation Report. To
                  receive consideration, comments on the MWG Recommendation Report must be
                  delivered electronically to WMS and ERCOT in the designated format provided
                  on the MIS within five days from the date of posting/distribution of the MWG
                  Recommendation Report. Comments submitted after five days may be
                  considered at the discretion of WMS.

         (2)      Within three Business Days of receipt of comments related to the MWG
                  Recommendation Report, ERCOT shall post such comments to the MIS. The
                  comments shall include identification of the commenting Entity.

         (3)      Comments submitted in accordance with the instructions on the MIS—regardless
                  of date of submission—shall be posted to the MIS and distributed electronically to
                  the WMS and MWG within three Business Days of submittal.

         (4)      WMS shall review the MWG Recommendation Report and any posted comments
                  to the Recommendation Report at its next regularly scheduled meeting after the
                  end of the five-day comment period, unless the five-day comment period ends
                  less than seven days prior to the next regularly scheduled WMS meeting. In that
                  case, the SMOGRR will be reviewed at the following month’s regularly
                  scheduled WMS meeting.

         (1)      ERCOT shall complete an IA based on the submitted SMOGRR
                  Recommendation Report and will report the IA’s results to MWG at the next
                  scheduled MWG meeting.

         (2)      The IA shall include:

                  (a)    An estimate of any cost and budgetary impacts to ERCOT;

                  (b)    The estimated amount of time required to implement the proposed
                         SMOGRR;

                  (c)    The identification of alternatives to the original proposed language that
                         may result in more efficient implementation; and

                  (d)    The identification of any manual workarounds that may be used as an
                         interim solution.


10.4.6         Metering Working Group Review of Impact Analysis

         (1)      After ERCOT posts the results of the IA, MWG shall review the IA at its next
                  regularly scheduled meeting. MWG may revise its MWG Recommendation
                  Report after considering the information included in the IA.

         (2)      If MWG revises its Recommendation Report, a revised MWG Recommendation
                  Report shall be issued by MWG to WMS and posted on the MIS. Additional
                  comments received regarding the revised MWG Recommendation Report shall be
                  accepted up to three Business Days prior to the WMS meeting at which the
                  SMOGRR is scheduled for consideration. If MWG revises its recommendation,
                  ERCOT shall update the IA and issue the updated IA at least three Business Days
                  prior to the regularly scheduled WMS meeting. If a longer review period is
                  required for ERCOT Staff to update the IA, ERCOT Staff shall submit a schedule
                  for completion of the IA to the WMS chair.


10.4.7         Wholesale Market Subcommittee Review and Action


         (1)      WMS shall consider any SMOGRRs that MWG has submitted to WMS for
                  consideration for which both a MWG Recommendation Report has been posted
                  and an IA based on such MWG recommendation (as updated if modified by
                  MWG under Section 10.4.6, Metering Working Group Review of Impact
                  Analysis) has been posted on the MIS for at least three days. The following
                  information must be included for each SMOGRR considered by WMS:

                  (a)    The MWG Recommendation Report and IA; and

                  (b)    Any comments timely received in response to the MWG Recommendation
                         Report.

         (2)      WMS shall take one of the following actions regarding the MWG
                  Recommendation Report:

                  (a)    Recommend approval of the SMOGRR as recommended in the MWG
                         Recommendation Report or as modified by WMS;

                  (b)    Reject the SMOGRR; or

                  (c)    Remand the SMOGRR to the MWG with instructions.

         (3)      If WMS recommends approval of a SMOGRR, ERCOT shall prepare a WMS
                  Recommendation Report, issue the report to TAC and post the report on the MIS
                  within three Business Days of the WMS recommendation concerning the
                  SMOGRR. The WMS Recommendation Report shall contain the following
                  items:

                  (a)    Identification of the submitter of the SMOGRR;

                  (b)    Modified Guide language proposed by WMS;

                  (c)    Identification of the authorship of comments;

                  (d)    Proposed effective date(s) of the SMOGRR;

                  (e)    Recommended priority and rank for any SMOGRR requiring a change to
                         ERCOT’s computer systems;

                  (f)    MWG recommendation; and

                  (g)    WMS recommendation.


10.4.8         ERCOT Impact Analysis Based on Wholesale Market Subcommittee
               Recommendation Report

For SMOGRRs not designated Urgent, ERCOT shall review the WMS Recommendation Report
and update the IA as soon as practicable, but no later than 30 days after the WMS
Recommendation Report is issued, unless a longer period is warranted due to the complexity of
the changes proposed by WMS. ERCOT shall issue the updated IA (if any) to TAC and post it
on the MIS within three Business Days of issuance. If a longer review period is required for
ERCOT Staff to update the IA, ERCOT Staff shall submit a schedule for completion of the IA to
the WMS and TAC chairs.


10.4.9         PRS Review of Project Prioritization

At its next regularly scheduled meeting, the PRS shall recommend to TAC an assignment of                 Formatted: Pattern: Clear
Project Priority for each SMOGRR recommended for approval by WMS that requires a change
to ERCOT’s computer systems.


10.4.10        Technical Advisory Committee Review and Action

         (1)      Upon recommendation for approval of a SMOGRR by the WMS and issuance of
                  an IA by ERCOT to TAC, the TAC shall review the WMS Recommendation
                  Report and the IA at its next regularly scheduled meeting; provided that the IA is
                  available for distribution to the TAC at least seven days in advance of the TAC
                  meeting.

        (2)      The TAC shall take one of the following actions regarding the WMS
                 Recommendation Report:

                 (a)    Approve the WMS Recommendation Report as originally submitted or as
                        modified by the TAC;

                 (b)    Reject the WMS Recommendation Report; or

                 (c)    Remand the WMS Recommendation Report to WMS with instructions.

        (3)      If the WMS Recommendation Report is approved by the TAC, as recommended
                 by WMS or modified by the TAC, the TAC shall review and approve or modify
                 the proposed effective date.

        (4)      If TAC approves as submitted, approves as modified, or rejects a SMOGRR,
                 ERCOT shall prepare a TAC Action Report and post it on the MIS within three
                 Business Days of the TAC decision. The TAC Action Report shall contain the
                 following items:

                 (a)    Identification of the submitter of the SMOGRR;

                 (b)    Identification of the authorship of comments;

                 (c)    Proposed effective date(s) of the SMOGRR;

                 (d)    Procedural history;

                 (e)    WMS’ recommendation;

                 (f)    TAC Action (or recommendation to the Board for SMOGRRs requiring
                        changes to ERCOT’s computer system);

        (5)      TAC shall consider the Project Priority of each SMOGRR requiring a change to
                 ERCOT’s computer systems and make recommendations to the ERCOT Board.

        (6)      The Chair of TAC shall report the results of all votes by TAC related to
                 SMOGRRs to the ERCOT Board at its next regularly scheduled meeting.


10.4.11       ERCOT Board Review and Action

                 The ERCOT Board shall review all SMOGRRs which impact ERCOT systems or
                 staffing. The ERCOT Board shall take one of the following actions regarding
                 SMOGRRs recommended by TAC which have such impacts:

                 (a)    Approve the TAC recommendation as originally submitted or as modified
                        by the ERCOT Board; or

                 (b)    Reject the TAC recommendation; or

                (c)     Remand the TAC recommendation to TAC with instructions.


10.5    Appeal of Decision

        (1)     With reference to a decision by MWG, any interested party may appeal directly to
                the WMS. Such appeal to the WMS must be submitted to ERCOT within ten
                Business Days after the date of the relevant decision. Appeals made after this
                time shall be rejected. Appeals to the WMS shall be posted on the MIS within
                three Business Days and placed on the agenda of the next available regularly
                scheduled WMS meeting, provided that the appeal is provided to ERCOT at least
                11 days in advance of the WMS meeting; otherwise the appeal will be heard by
                the WMS at the next regularly scheduled WMS meeting

        (2)     With reference to a decision by WMS, any interested party may appeal directly to
                the TAC. Such appeal to the TAC must be submitted to ERCOT within ten
                Business Days after the date of the relevant decision. Appeals made after this
                time shall be rejected. Appeals to the TAC shall be posted on the MIS within
                three Business Days and placed on the agenda of the next available regularly
                scheduled TAC meeting, provided that the appeal is provided to ERCOT at least
                11 days in advance of the TAC meeting; otherwise the appeal will be heard by the
                TAC at the next regularly scheduled TAC meeting.

        (3)     With reference to a decision by TAC, any interested party may appeal directly to
                the ERCOT Board. Such appeal to the ERCOT Board must be submitted to
                ERCOT within ten Business Days after the date of the relevant decision. Appeals
                made after this time shall be rejected. Appeals to the ERCOT Board shall be
                posted on the MIS within three Business Days and placed on the agenda of the
                next available regularly scheduled ERCOT Board meeting, provided that the
                appeal is provided to the ERCOT General Counsel at least 11 days in advance of
                the Board meeting; otherwise the appeal will be heard by the Board at the next
                regularly scheduled Board meeting.

        (4)     Any interested party may appeal any decision of the ERCOT Board regarding the
                SMOGRR to the PUCT or other Governmental Authority. Such appeal to the
                PUCT or other Governmental Authority must be made within 35 days of the date
                of the relevant decision. If the PUCT or other Governmental Authority rules on
                the SMOGRR, ERCOT shall post the ruling on the MIS.


10.6    Urgent Requests

        (1)     The party submitting a SMOGRR may request that the SMOGRR be considered
                on an urgent basis. WMS may designate the SMOGRR for urgent consideration.
                The MWG shall consider the Urgent SMOGRR at its earliest regularly scheduled
                meeting, or at a special meeting called by the MWG chair to consider the urgent
                SMOGRR if the regularly scheduled meeting will not take within 14 Calendar
                Days.

        (2)     If the submitter desires to further expedite processing of the SMOGRR, a request
                for voting via electronic mail may be submitted to the WMS chair. The WMS
                chair may grant the request for voting via electronic mail. Such voting shall be
                conducted pursuant to TAC procedures. If approved, ERCOT shall submit a
                WMS Recommendation Report to the TAC within three Business Days after
                WMS takes action. The WMS chair may request action from WMS to accelerate
                or alter the procedures described herein, as needed, to address the urgency of the
                situation.

        (3)     Notice of an urgent SMOGRR pursuant to this subsection shall be posted on the
                MIS.


10.7    Revision Implementation

        (1)     For SMOGRRs with no impact to ERCOT systems or staffing, upon TAC
                approval, ERCOT shall implement SMOGRRs on the first day of the month
                following TAC approval, unless otherwise provided in the TAC Action Report for
                the approved SMOGRR.

        (2)     For SMOGRRS with impacts to ERCOT systems or staffing, upon Board
                approval, ERCOT shall implement SMOGRRs on the first day of the month
                following Board approval, unless otherwise provided in the Board Action Report
                for the approved SMOGRR.

        (3)     ERCOT shall implement an Administrative SMOGRR on the first day of the
                month following the date it posted the Administrative SMOGRR to the MIS.

G 1Settlement     Metering Operating Guide (SMOG)

                Overview
                    The following process has been established to announce, develop,
                    revise, and approve changes to the Settlement Metering Operating
                    Guides (SMOG):

                     Proposed SMOG revisions are submitted to ERCOT at                                Formatted: Bullets and Numbering

                     The Metering Working Group (MWG) reviews the Settlement
                      Metering Operating Guides Revision Request (SMOGRR) and

                      recommends an action to the Wholesale Market Subcommittee
                      (WMS).
                     After reviewing the MWG’s recommendation to revise the SMOG,
                      the WMS approves or rejects the recommendation.
                     If approved, the WMS submits proposed SMOG language revisions
                      to the Technical Advisory Committee (TAC) for review and approval.
                     The TAC reports the results of all TAC votes regarding proposed
                      SMOG revisions to the ERCOT Board of Directors.

                    Throughout the SMOG, references are made to the Protocols.
                    Protocols are subject to their own revision process, not this SMOG
                    revision process.


                Roles and Responsibilities
                    Market Participant
                    Any Market Participant may submit a SMOGRR. The Market
                    Participant is responsible for monitoring the progress of their submittal.
                    Submitters are encouraged to attend MWG meetings and offer
                    suggested language that ensures the intent of the request is
                    maintained.

                    MWG
                    The MWG has ultimate responsibility for ensuring that the SMOG are
                    compliant with Protocols. As such, the MWG will monitor all changes
                    to Protocols and initiate any SMOGRRs necessary to bring the SMOG
                    into conformity with Protocols.

                    The MWG will acknowledge receipt of all SMOGRRs it receives. The
                    MWG will also provide progress updates to the submitter of the
                    SMOGRR apprising the submitter of the status of the SMOGRR at
                    each major step of the approval process. All communication between
                    the submitter of a SMOGRR and the MWG will be done using
                    electronic mail.

                    ERCOT
                    When ERCOT is assigned duties in the Change Control Process the
                    ERCOT Settlement Metering Department will be responsible for
                    performing the work.

                    ERCOT will have the responsibility for managing the database used to
                    track submitted changes to the Settlement Metering Operating Guides.

                                PUCT Market Oversight Committee

                            The original submission of a SMOGRR must be
                            accompanied by a description of the requested revision,
                            the reason for the suggested revision, a list of any other
                            affected ERCOT Guides sections, and the suggested
                            SMOG language.

                            A SMOGRR is first submitted to ERCOT where the
                            request is verified for completeness. Within five business
                            days ERCOT will notify the submitter that the SMOGRR
                            has been received. At this time ERCOT will also inform
                            the submitter whether the SMOGRR is considered
                            complete or not complete. Completed SMOGRRs are
                            forwarded to the MWG for review. SMOGRRs that are
                            not complete are returned to the submitter. No further
                            action will be taken by ERCOT on any SMOGRR deemed
                            incomplete. To pursue the request further, the submitter
                            must submit a new SMOGRR.

                            ERCOT will use the Metering Exploder list to forward the
                            SMOGRR to the Chair of the MWG. The Chair will place
                            this SMOGRR on the agenda for the next regularly
                            scheduled MWG meeting. If the next regularly scheduled
                            MWG meeting will occur more than 30 days after a
                            SMOGRR is submitted to ERCOT, the Chair of the MWG
                            may convene a special meeting of the MWG to discuss
                            this request.

                            making this SMOG language revision. Further, the MWG
                            will be responsible for ascertaining that the proposed
                            SMOG language revision complies with Protocols. The
                            MWG will sponsor changes to the Protocols when these
                            changes must be made to accommodate the proposed
                            SMOG language revisions.

                            During the process of evaluating a SMOGRR, the MWG
                            may circulate the proposal to other working groups for
                            review and comment. The MWG shall have no
                            responsibility to address or incorporate comments from
                            the other working groups into its SMOG language
                            revisions.

                            After the MWG reviews the SMOGRR one of three
                            actions will be taken:

                                1.The SMOGRR is accepted as submitted and the SMOG                        Formatted: Bullets and Numbering

                                    or
                                2.The SMOGRR is accepted with MWG modifications and the
                                    resulting SMOG language revisions are submitted to the
                                    WMS for approval, or
                                3.The SMOGRR is rejected.

                            Action 1.
                            When the MWG accepts a SMOGRR as submitted, the
                            MWG will forward the proposed SMOG language
                            revisions to the WMS for review and approval at the next
                            regularly scheduled meeting of the WMS.

                            Action 2.
                            When the MWG accepts the SMOGRR in principle, but
                            has concerns with some elements of the SMOGRR, the

                            MWG will draft alternative proposed SMOG language.
                            The revised SMOG language will be submitted to the
                            WMS for review and approval at the next regularly
                            scheduled meeting of the WMS.

                            The MWG will inform the entity submitting the SMOGRR
                            that the MWG will forward the SMOG language revisions
                            to the WMS for review and approval; however the MWG
                            has modified the submitter’s proposed SMOG language
                            revisions to better reflect the viewpoint of the MWG. The
                            submitter may forward its original SMOGRR to the WMS
                            for consideration as an alternative to the SMOG language
                            revisions submitted by the MWG.

                            Action 3.
                            When the MWG rejects a SMOGRR the MWG will issue a
                            report to the submitter of the SMOGRR within five
                            business days of the MWG making its determination.
                            This report will include the original SMOGRR and a
                            detailed reason for the rejection decision. A submitter
                            has ten business days to register a request to appeal the
                            decision of the MWG with the WMS.




3.Wholesale Market          When the WMS reviews the proposed SMOG language                             Formatted: Bullets and Numbering

                            Action 1.
                            When the WMS approves the proposed SMOG language
                            revisions as presented, the WMS will submit the proposed
                            SMOG language revisions to TAC for review and
                            approval.

                            Action 2.
                            When the WMS accepts the proposed SMOG language
                            revisions, but requests the MWG make specific changes
                            to the language before having it submitted to the TAC, the
                            MWG could accept or reject the language edits offered by
                            the WMS. If the MWG accepts the language edits offered
                            by the WMS then the SMOG language revisions are
                            forwarded to the TAC for review and approval. If the
                            MWG rejects the language edits made by the WMS then
                            SMOG language revisions are treated as though the
                            WMS sent it back to the MWG for further work. Follow
                            the steps for Action 3.

                            Action 3.
                            When the WMS accepts the proposed Guides language
                            revisions in concept, but has concerns with some of the
                            details, the WMS will return the proposed SMOG
                            language revisions to the MWG with comments and a
                            request for additional MWG work on this proposal.

                            The MWG can take one of two further actions:

                                1.Discontinue further action toward implementing the proposed             Formatted: Bullets and Numbering
                                    SMOG language revisions, or
                                2.Modify the proposed SMOG language revisions to
                                    accommodate concerns of the WMS.

                                    Further Action 1.
                                    When, after taking into consideration the review and
                                    commentary of the WMS, the MWG determines that the
                                    proposed Guides language is not necessary, a response will
                                    be prepared stating why the proposed Guides language
                                    revisions are no longer being pursued by the MWG. This
                                    response will be sent to the Chair of the WMS, and to the
                                    submitter of the original SMOGRR.

                                    Further Action 2.
                                    After the proposed SMOG language revisions have
                                    been modified to accommodate concerns raised by
                                    the WMS, the Chair of the MWG will submit the
                                    modified proposed SMOG language revisions to
                                    the WMS for review and approval.

                            Action 4.
                            When the WMS decides not to approve the proposed
                            SMOG language revisions, the WMS will provide the
                            MWG with reasons why the WMS rejected the proposed
                            SMOG language revisions.

                                1.At this point the MWG can pursue one of two further actions:            Formatted: Bullets and Numbering
                                    Discontinue further action toward implementing the proposed
                                    SMOG language revisions, or
                                2.Resubmit the proposed SMOG language revisions to the WMS
                                    after reworking it to address the objections of the WMS.

                                Further Action 1.
                                When the MWG accepts the decision of the WMS,
                                then a response to the submitter of the SMOGRR is
                                prepared by the MWG stating that the MWG will take
                                no further action concerning the SMOGRR. This
                                communication will state that the WMS rejected the
                                proposed SMOG language revisions suggested in the
                                SMOGRR. This communication will also state the
                                reasons why the WMS rejected the proposed SMOG
                                language revisions.

                               Further Action 2.
                               When the MWG determines that the proposed SMOG
                               language revisions should be adopted, the MWG will
                               develop proposed SMOG language revisions that
                               address the objections raised by the WMS during this
                               Subcommittee’s initial review of the proposed SMOG
                               language revisions. The revised SMOG language
                               revisions will be resubmitted to the WMS for review at
                               the next regularly scheduled meeting of the WMS.
                               Step three of this process begins anew.
4.Technical Advisory        The TAC will review the proposed Guides Language                              Formatted: Bullets and Numbering

                            Action 1.
                            If the TAC approves the proposed SMOG language
                            revisions, the revisions will have an effective date
                            occurring on the first day of the month following TAC
                            approval unless otherwise designated by the MWG.

                            Action 2.
                            If the TAC determines that the proposed SMOG language
                            revisions need further work, then the request will be sent
                            back to the MWG to address TAC’s issues. Unless
                            otherwise directed, the resulting modified SMOG
                            language must pass through the WMS review and
                            approval process described in Step 3 above.

                            Action 3.
                            If TAC rejects the proposed SMOG language revisions,
                            the MWG will terminate any further activity toward
                            implementing these proposed SMOG language revisions.
                            Within three business days of TAC making its decision,
                            the MWG will notify the entity submitting the SMOGRR of
                            TAC’s decision to reject the proposed SMOG language
                            revisions as suggested in the SMOGRR.

                ERCOT shall make all reasonable efforts to establish consensus for all
                revisions to any existing or new procedures or forms in discussions with
                the MWG prior to implementation. Such processes and forms shall be
                located on the ERCOT web site.
