									2008 FORMULA 1TM ING AUSTRALIAN GRAND PRIX MY Ticketek KISS Promotion CONDITIONS OF ENTRY 1. Information on how to enter and prizes form part of these Conditions of Entry (Conditions). Participation in this promotion (Promotion) is deemed acceptance of these Conditions. 2. The promoter is the Australian Grand Prix Corporation (ABN 86 947 927 465), 220 Albert Road, South Melbourne, VIC, 3205 (Promoter). 3. Entry is only open to ‘My Ticketek’ members who are residents in Victoria, Queensland or Western Australia. 4. The Promoter and Ticketek Pty Ltd (Ticketek), and their employees (and their immediate families), and their agents associated with this Promotion are ineligible to enter. 5. The promotion period begins at 12am (AEDST) on Thursday 14 February 2008 and ends at 12 midday on Friday 7 March 2008 (AEDST) (Promotion Period). 6. To enter, you must purchase a KISS Pole Position upgrade ticket (i.e. in addition to purchasing a General Admission ticket valid for Sunday 16 March or a Grand Stand ticket valid for Sunday 16 March) to the 2008 FORMULA 1TM ING Australian Grand Prix (Event) on-line at or during the Promotion Period, and register your details for this Promotion upon making your purchase. 7. Multiple entries are accepted provided that each entry is submitted separately and with respect to a separate qualifying purchase in accordance with the entry instructions. There is a maximum of one entry per qualifying purchase. 8. The draw will take place at the registered office of the Promoter, 220 Albert Road, South Melbourne, Victoria 3205 on 7 March 2008 at 5.30pm AEDST. 9. The winner will be notified by phone and mail, and their name will be published in the Australian and at on 11 March 2008 . 10. If, despite reasonable attempts, the Promoter is unable to contact the winner as at midday on Wednesday 12 March 2008, the original winner will be deemed to have forfeited the prize and the Promoter will conduct a redraw at the same location as the original draw. The winner of the redraw will be notified by telephone and mail and their name will be published in the Australian on Friday 14 March 2008. Judges' decision is final and no correspondence will be entered into. 11. The prize comprises of 2 tickets to the Pit Exit Suites at the Event (value $2, 265.00 each,
total value $4,530.00) and 2 x KISS "meet and greet" introductions (approximate value

$200 each, total value $400) The total prize value is approximately $4,930.00. The

Promoter accepts no responsibility for any variation in the prize value. Prizes (or any unused portion of a prize) are not transferable or exchangeable and cannot be taken as cash. 12. Spending money, meals, airfares, transport to and from the Event, airline and/or airport taxes, transfers and all other ancillary costs incurred as a result of taking the prize ar e not included and remain the responsibility of the winner and any person who shares in any part of the prize (Prize Companion). 13. No element of the prize is transferable or exchangeable and cannot be redeemed for cash. The value of the prize has been calculated based on Event prices for 2008. The Promoter accepts no responsibility for any variation in the value of the prize. All elements of the prize must be taken to coincide with the Event to be held from 13-16 March 2008, and any element not taken at t he time(s) stipulated will be taken to be forfeited. The Promoter accepts no responsibility in circumstances where the Event is cancelled or the Event dates are inconvenient to the winner, or if the Event dates are re-scheduled for any reason beyond the reasonable control of the Promoter. 14. The Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process and to cancel, terminate, modify or suspend the Promotion. The Promoter does not accept any responsibility for late, lost, incomplete or incomprehensible or misdirected entries for the Promotion. 15. The winner and their Prize Companion must comply with all directions of the Promoter & race officials at all times. The winner and their Prize Companions attending the Event agree to (and the winner agrees to procure that the Prize Companions will) comply with these Conditions, the Conditions of Sale and Conditions of Entry to the Event, as well as the Corporate Facility Standard Terms and Conditions (collectively, the Conditions) (copies of which are available at or from the Promoter, and the Conditions of Entry displayed at entrances to the Event). The winner agrees to make his or her Prize Companions aware of these Conditions to the Event. 16. As a condition of accepting their prize, each entrant and their Prize Companion acknowledge and agree that the Promoter gives no representation and in no way guarantees that entrants and Prize Companions will be able to view any particular activity as part of their participation in the prize, including in relation to Formula One teams and/or drivers, KISS and / or any other aspect of the Event . 17. ENTRANTS ARE REMINDED AND ACCEPT AND ACKNOWLEDGE THAT MOTOR RACING, THE EVENT AND CERTAIN ACTIVITIES ASSOCIATED THEREWITH (INCLUDING, WITHOUT LIMITATION, PARTICIPATION IN THE PRIZE) ARE DANGEROUS AND ACCIDENTS CAN HAPPEN. Entrants and their Prize Companions are warned that there is a possibility of an accident causing injury, death or property damage or loss and attendance at the Event and participation in the prize is at each entrant’s and Prize Companion’s own risk. Entrants and any Prize Companion acknowledge that the risks associated with attending the Event and participating in the prize

include but are not limited to the risk of suffering harm as a result of cars (or parts of them) colliding with other cars, persons or property. Entrants and any Prize Companion acknowledge that entry to and remaining at the Event and participating in the prize has a degree of danger and, to the extent permitted by law (in particular sections 32J and 32JA of the Fair Trading Act 1999 (Vic) and section 74 of the Trade Practices Act 1974 (Cth)), hereby exclude, release and forever discharge the Promoter, the Crown in right of the State of Victoria, the Minister administering the Australian Grands Prix Act 1994 (Vic), the Minister administering the Crown Land (Reserves) Act 1978 (Vic), Fédération Internationale de l'Automobile, Formula One Administration Limited, Formula One Management Limited, Confederation of Australian Motor Sport, Parks Victoria, the State Sports Centres Trust, Kellogg Brown & Root Pty Ltd, Event sponsors and all other persons involved in the organisation, conduct and promotion of the Event or the prize (Associated Entities) from all liability for claims, loss, damage, costs or expenses arising from any personal injury or death (whether arising from negligence (but excluding gross negligence) or otherwise), arising from or connected with participation in Recreational Services (as defined below) at the Event, including the prize. To the extent permitted by law (in particular sections 32J and 32JA of the Fair Trading Act 1999 (Vic) and section 74 of the Trade Prac tices Act 1974 (Cth)), entrants and any Prize Companion acknowledge that, to the extent to which they participate at the Event in: • • a sporting activity or similar leisure time pursuit; or an activity that : a. involves a significant degree of physical exertion or physical risk; and b. is undertaken for the purposes of recreation, enjoyment or leisure,

(Recreational Services), including, without limitation, participation in any element of the prize, the Associated Entities do not make any warranty that the Recreational Services at the Event, including the prize, will be provided with due care and skill or that any materials provided in connection with the Recreational Services, including the prize, will be fit for the purposes for which they are supplied. Entrants and any Prize Companion acknowledge that, to the extent that any warranty is implied it is excluded to the full extent permitted by law. WARNING: If you or your Prize Companion participate in these activities your rights, or the rights of your Prize Companion, to sue the supplier under the Fair Trading Act 1999 if you or your Prize Companion are killed or injured because the activities were not supplied with due care and skill or were not reasonably fit for their purpose, are excluded, restricted or modified in the way set out in these Conditions. NOTE: The change to your rights, or the rights of your Prize Companion, as set out in these Conditions does not apply if your , or your Prize Companion’s, death or injury is due to gross negligence on the supplier’s part. “Gross negligence” is defined in the Fair Trading (Recreational Services) Regulations 2004.

For the purpose of this Condition 17 “the supplier” shall mean and include the Associated Entities. Without limiting any other release or limitation of liability contained in these Conditions, the Associated Entities will not be liable for any indirect or consequential loss suffered by you or your Prize Companion caused by any acts or omissions of the Associated Entities, their directors, employees, agents, consultants, contractors or sub-contractors arising out of or in relation to the Event or the prize. Nothing in this Condition 17 or these Conditions generally affects your rights under the Trade Practices Act 1974 (Cth), Fair Trading Act 1999 (Vic) or similar legislation regarding implied conditions and warranties to the extent that such implied conditions and warranties cannot be excluded by law. 18. The Promoter and Ticketek collect entrants’ personal information in order to conduct the Promotion. If the information requested is not provided, the entrant may not participate in the Promotion. By entering the Promotion, unless otherwise advised, each entrant also agrees that the Promoter may use this information, in any media for future promotional, marketing and publicity purposes without any further reference, payment or other compensation to the entrant, including sending the entrant electronic messages, and telephoning the entrant for an indefinite period. Such personal information will be dealt with by the Promoter in accordance with the Information Privacy Act 2000 (Vic) and the Promoter’s privacy policy, and (in the case of Ticketek) in accordance with the Privacy Act 1988 (Cth) and Ticketek’s privacy policy. Entrants’ personal information may b disclosed to State and Territory lottery departments and e winners’ names published as required under the relevant lottery legislation. A request to access, update or correct any personal information, or to access the Promoter’s or Ticketek’s privacy policy, should be directed to the Promoter by contacting the Promoter at Grand Prix House, South Melbourne, VIC, 3205. All entries become the property of the Promoter. 19. Entrants consent to the Promoter using the entrant's and any Prize Companion’s name, likeness, image and/or voice in the event they are a winner (or Prize Companion) (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting the Promotion (including any outcome) and promoting any products manufactured, distributed and/or supplied by the Promoter. 20. The Promoter reserves the right to request the winner provide photographic proof of age, identity and residency prior to awarding any element of the prize. Identification considered suitable for verification is at the unfettered discretion of the Promoter.
