INTRODUCTION HealthSupply WA has produced this Buyers Guide to provide information required to purchase Hospital Beds, trolleys, bassinets, cots, general ward mattresses and pillows and pressure relieving devices throughout this period contract. This Buyers Guide is available on the Government Health Supply Council Web Site at http://www.ghsc.health.wa.gov.au Health Purchasers are advised that amendments / variations may occur to this contract throughout the contract period. Contract Overview HealthSupply WA has arranged and entered into this contract on behalf of all Western Australian Government Health Care Units. 2.1. SCOPE Provides for the supply and delivery of Hospital Beds, trolleys, bassinets, cots, general ward mattresses and pillows and pressure relieving devices. 2.2. CONTRACT TERM The contract is valid for the period from 1st July 2004 to 30th June 2007. After this time, HealthSupply WA has the option of extending the contract for a further two, twelve month periods. 2.4. CONTRACT TYPE 2.4.1. Mandatory Unless the State Supply Commission approves an exemption from the contract, Government agencies are required to purchase all the stated equipment through the listed suppliers. There is no requirement to obtain quotes from the listed suppliers when purchasing through this contract. 2.4.2. Purchasing Rules The proposed contract reflects a Whole of Health requirement and will be mandatory for WAPHCU’s. The State Supply Commission has granted approval to vary the buying rules for purchases above $50,000 for 'Agency Specific Panel Contracts'. Where a panel arrangement is established for the proposed contract the Commission has approved the calling of 'restricted tenders' from panellists rather than public tenders for purchases in excess of $50,000. The approval was granted following the Commission's consideration of the rigorous and extensive nature of the proposed evaluation process and Hospitals' time-lines in relation to equipment purchases. The items on this contract are deemed to be GST-free in accordance with Schedule 3 to the GST Act with the exception of bassinets, cots and pillows. 3. KEY FEATURES • • Competitive pricing Rigorously tested and evaluated equipment. 3.1. NEW TECHNOLOGY, PRODUCTS/SUPPLIERS Where new technology or new equipment are identified as appropriate for inclusion on the Contract the Principal reserves the right to include them on the Contract subject to meeting the original terms and conditions of contract. 3.2. EXCUSABLE DELAY Contractor/s are advised that Health’s requirements are for on time delivery of goods, spare parts, and service: The Contractor/s must take all reasonable steps to minimise delay. Where it becomes evident to the Contractor/s that it will be delayed in performance of the contract by a cause beyond its control (except a cause arising out of an industrial dispute at F8/20(01/08/02) Page 5 of 32 Contract No. 11/2003 Hospital Beds, Trolleys, Bassinets, Cots, General Ward Mattresses & Pillows, Pressure Relieving Devices Issue No. 001 the Contractor/s premises, or any breach of the provisions of the Contract) the Contractor/s may claim in accordance with this clause an extension of the time for delivery. Where the Contractor/s wishes to claim an extension of time for delivery, the Contractor/s must : Notify the ordering WA Public Healthcare Unit and this Contract Manager immediately in writing of the cause for the delay, the extent and duration of the delay and amended delivery date. Should the ordering WA Public Healthcare Unit determine that the cause of the delay is such as to justify an extension of time for delivery, that WA Public Healthcare Unit shall confirm in writing acceptance of the revised delivery date. Where the ordering WA Public Healthcare Unit and the Contract Manager determine that the cause of the delay is not justified, the Contractor/s will be notified in writing. 3.3. KEY PERFORMANCE INDICATORS In monitoring the performance of the Contractor/s the following key performance indicators have been identified as critical to the effective operation of the contract : • • • • • Consistency of standard of equipment offered – conformance with tender specification and accessories. Adherence to the contracted delivery timelines for standard configurations of equipment. Fitness for purpose assessment – operational performance and design of equipment. Availability of spare parts and accessories in accordance with agreed delivery timelines. Response time for service in accordance with agreed timeline. The Contractor/s will be requested to provide regular reporting at twelve monthly intervals during the contract period to the Contract Manager ensuring compliance to the stated key performance indicators and Conditions of Contract. 3.4. LIQUIDATED DAMAGES FOR DELAY IN DELIVERY Should the Contractor/s delay delivery of goods, spare parts or service beyond the period specified in the contract or the date mutually agreed to, then the ordering WA Public Healthcare Unit is, without prejudice to any rights that otherwise accrue under the Contract, entitled to deduct from monies due to the Contractor, as liquidated damages and not as a penalty the following: • • • • 5% discount deducted off the total order per one week delay beyond the agreed delivery date; 10% discount off the total order per two week delay beyond the agreed delivery date; 15% discount off the total order per three week delay; 20% discount off the total order for more than four weeks delay. The delivery as stated in the Contract will apply to the whole, or any item or part thereof that is so delayed. 3.5. DELIVERY CHARGES Items will be delivered free to the metropolitan area. Regional deliveries may be delivered free to metropolitan premises of a freight company as directed by the buyer. Freight costs will be an additional cost. Delivery times given in this Buyers Guide are estimates only. Suppliers should be contacted to establish agreed delivery arrangements and delivery time. It may be necessary to contact more than one supplier to obtain suitable arrangements. 4. HOW TO USE THIS CONTRACT To purchase through this contract, buyers must: 1. Identify the items and the preferred supplier from this Buyers Guide that meet their requirements. 2. Place an order with that supplier. Include the contract number, Buyers Guide reference number, item description and supplier’s product code, department contact and delivery arrangements. Please note: The contract number must be quoted to receive the contract price. 5. COMPLAINT RESOLUTION Every supplier is required to provide a satisfactory level of service. If a Health Care Unit is dissatisfied with the product or service provided by a supplier or has any specific concerns, these should be discussed with the supplier in the first instance. Please keep a written record in your files of all complaints including the following details: • Nature of the complaint. • When the complaint was made. • To whom the complaint was made. • The issues involved. • The supplier’s response. • Whether the matter was resolved to your satisfaction. • Any other relevant details. This information will be required if the Contract Manager is to take action under the contract. It should also be referred to when completing contract assessment surveys. Supplier performance is a key tender assessment criterion so Health Supply Services should not only be advised of any problems or issues not resolved to your satisfaction but also we ask that you provide positive feedback regarding good or excellent supplier performance.
