Cradle to Crayons Home Daycare Contract By signing this contract, the parent or guardian agree to the terms and conditions outlined in the parent’s handbook and this contract. This contract will cover care until the month of______________ the year ________, unless otherwise noted. Tuition may, at the provider’s discretion, increase periodically, but not during the term of this contract. K K K Cradle to Crayons/ Dionne Lane offers childcare Monday through Friday, 6:30 a.m. to 9:00 p.m. (Please be advised my full time rate is based on 11 hours per day.) Cradle to Crayons/ Dionne Lane does not offer childcare on the weekends. Cradle to Crayons/ Dionne Lane does not offer childcare before 6:30 a.m. or after 9:00 p.m. FULL-TIME PLAN Care is provided for greater than 5 hours each day but no more than 11 hours each day, Monday through Friday. An additional charge will be added to the full-time rate for any scheduled time that the parent or guardian child is in the provider care for more than 11 hours per day. Scheduled means the parent or guardian have listed the time in the "Contract Hours" section of the Child Care Contract and the parents pay for the time every week, regardless of the parent or guardian child’s attendance. Full time Daycare Rates for a 11 hour day: $105 a week for a 5 day week for care from 6:30am to 6:00pm $125 a week for care after 6pm. The above rates are payable whether or not your child is here. All care is paid in advance. Tuition is paid in cash or money order only. Payment is due Friday when picked up your child i.e. 6:00 pm. If payment has not been made on Friday there will be an additional charge of $20.00 per day for each day the payment is late. This DOES include weekends. I WILL deny care on Monday until payment is made. Repeated late payment is grounds for immediate termination. If a holiday falls on Friday, then payment will be under the same terms on Thursday. If your child will not be in care on Friday you will need to drop payment off Thursday when picked up your child. Do not put me in a position to ask for the Tuition – please remember to bring it. 1 All care is paid in advance. Refunds will be given if provider is unable to work. Your childcare rates are based on enrollment and not attendance. Parents must pay me prior to their taking time off for Personal Days Off, Vacation, Time spend with another parent and Holidays if the time taken off falls on the scheduled last day of the week. PICK-UP TIMES AND LATE FEES The parent or guardian are contracted for a specific set of hours. This means that if the parent or guardian are contracted to have the parent or guardian child(ren) here from ______a.m. Until ________p.m., and the parent or guardian arrive to pick them up at _______pm, the parent or guardian will be considered late, and the parent or guardian need to be contacted by phone if the parent or guardian will be late in picking up the parent or guardian child. The only time the provider will waive the late fee is if the parent or guardian are late because of unforeseen weather such as a snowfall or very heavy rain. Late fees are waived only at the provider’s discretion. Late fees for unexpected overtime are payable at the pick-up time of the day the parent or guardian is late. Overtime rates are as follow $1 per 1 minute after ___________. $5 per 15 minutes If the child needs to arrive before 6:30 a.m. If any child needs to come earlier it will be handle on a case by case basis CONTRACT HOURS Please indicate the hours (include a.m. and p.m.) the parent or guardian child will be left in the provider’s care below: Monday to Tuesday to Wednesday to Thursday to Friday to The parent or guardian will provide a schedule as accurately as possible. Once the parent’s or guardian’s child has been signed in, the parent or guardian must pick the parents or guardians child up no more than eleven hours later. The parent or guardian will be charged a flat rate for both full-time care (eleven hours each day) and part-time care (five hours each day). The provider does not give refunds for early pick-ups or for scheduled days that the parent or guardian child does not attend. ________(Initial) If for some reason the "Contract Hours" above change due to the parent’s or guardian’s work schedule, the parent or guardian must notify the provider in writing at least one week in advance. Notification must be provided to ensure the parent or guardian child’s spot within the daycare. 2 If the parent or guardian change the "Contract Hours", the parent or guardian will note that the agreed upon payment rate as stated above may also change. The provider will notify the parent or guardian in advance of the new rate and a supplement will be attached to this contract stating the changes. _________(Initial) Please initial next to your chosen payment option: Weekly: Monthly: Pre-School Learning Program, which is a preschool curriculum and craft program. The fee for this program is $10 per month and is payable with your first payment each month. HOLIDAYS I get paid for all my holidays. These are the holidays I take off: Thanksgiving Thursday and Friday Christmas Eve Day and Christmas Day New Year's Eve Day, New Year's Day. I am available the following Holidays: Memorial Day July 4th Labor Day MLK and Good Friday. If you need care on any of these Holidays there will be an additional fee of $20.00 per child. If you choose to keep your child(ren) home, the regular day’s fee stills apply. I will be available for care on New Year's Eve from 5PM to 3AM for a fee of $45 per child for current families and $60 per child for drop in care. ________(Initial) WELLNESS POLICY: Cradle to Crayons Home Childcare is a "Well Child Care Daycare"! This means if your child is not feeling well, for whatever reason, you must make other arrangements for their care until they are feeling well and no longer contagious. Do not bring your child(ren) to childcare if your child is suffering from one or more of the following conditions: A. Severe coughing 3 B. Unusual or unexplained loss of appetite, fatigue, irritability or headache. C. Any discharge or drainage from eyes, nose, ears or open sores. D. Difficulty in breathing wheezing or a persistent cough. E. A fever over 100 degrees F/37.8 degrees C orally or 99 degrees F/37.2 C under the arms. F. Infected skin or eyes or an undiagnosed rash. G. An intestinal or stomach disorder, including diarrhea, cramps, loose stool, nausea or vomiting. H. Severe itching of body and scalp. I. Head lice J. If your child has a common cold - slight cough, sneezing, or a runny nose, you can bring them to childcare. However, when the cold reaches the point when your child will not play, cries, whines, wants to be held constantly, or has a continuous cough, you will be required to keep your child home K. If a child is brought "too sick" you will be phoned to pick up your child and allowed 45 minutes to make other arrangements. . L. Children with known or suspected communicable diseases. Your child can come back into care until they are symptom free for 24 hours. M. If they are too sick to go outside, they are too sick to be at childcare. This well care policy is for the benefit of all the children. To keep everybody at Cradle to Crayons Home Childcare healthy as possible. If you bring your child to childcare ill, If you can not pick your child(ren) up in that time with in 45 minutes you will be charged $20.00 the sick child care charge in addition to your normal daily fee. Due at the when you come to pick up your child. If your child becomes ill while at daycare, no extra fees will charged. Provided you pick up your child with in 2 hour of the time you are made aware of your child(ren)’s illness. If you can not pick your child(ren) up in that time frame you will be charged $20.00 the sick child care charge in addition to your normal daily fee. Due when pick up your child. If your child is ill enough to require Prescription medication – Pink Eye, Strep Throat, Bronchitis, Pneumonia, etc. We will require you to keep your child(ren) home until he or she has been on medication for 48 hours and they are no longer contagious. Children who become ill with any of the above symptoms will be returned home. We appreciate your cooperation with this policy. If you have any questions about whether or not your child should attend daycare that day, please call me before bringing in your child. In the event of a communicable disease, the parents shall be informed to seek alternate childcare during the illness time period, for the benefit of the other children. A doctor's note of wellness shall be required stating the child is fully recovered and may resume participation at Cradle to Crayons Home Childcare. ________(Initial) Provider Illness: Payment is not required when the provider have to close due to an illness. 4 In this situation the provider will adjust contracted fee. It is the parent or guardian responsibility to find other childcare arrangements. Your Families Vacations When you go on vacation you will be responsible for ½ of your contracted weekly rate. This is to hold your child's spot in the childcare until s/he returns to be no longer than one weeks <5 days> vacation. After that it will be full daycare fee. Failure to pay this fee on time will result in termination of care. Two weeks advance notice will be required for vacations to receive ½ regular daycare price. You must pay for the entire interim time period during Sabbaticals and extended leave of absences if you want me to hold your child’s spot for you. If your child does not attend childcare, then your payment must be made in advance of the impending week, i.e. Friday. This payment is not applied to future childcare, and is not negotiable nor is it refundable. The Provider’s Vacation The provider will be taking 1 weeks (5 days) of unpaid vacation per year. and The provider will be taking 1 weeks (5 days) of paid vacation per year. The parent or guardian will be notified at least two weeks in advance of the provider vacation days. The Provider’s Personal Days The parent or guardian will be notified at least one week in advance the provider’s personal days. ALTERNATE CARE The provider does not have a back-up person to provide care for the children if the provider is sick or on vacation. It will be the parent or guardian responsibility to have a back-up person to provide care for the parent or guardian child(ren) when the provider is not available. ________(Initial) MEALS The following meals are served each day: Breakfast at: Other Arrangements: 1. State law requires that any food brought from the child’s home must be in a marked container labeled with the child’s name. 8:00 a.m. Lunch at: Afternoon Snack at: 11:30 p.m. 3:00 p.m. 5 2. If food is brought from home for the parent or guardian child(ren) as a special treat (i.e. birthdays, etc.) please remember to bring enough food for all the children in the daycare. 3. A special diet-statement If the parent or guardian child must adhere to a special diet, it will be the parent or guardian responsibility to supply foods or meals. PARENT RESPONSIBILITIES The parent or guardian am responsible for providing these Supplies for your child: Sleeping mat Pillow Pillowcase Crib Sheet for mat. Tooth brush Tooth paste for kids Hair brush Baby Wipes Sunscreen for kids Insect repellent for kids Change of clothes 2 pairs of panties or underwear, both shorts and pants, long sleeve shirt and short sleeve shirt (including extra socks) labeled with the parent or guardian child(ren)’s name, appropriate for the weather. Thermometer Diapers Rash Ointment During the spring and summer: a swimsuit, and shoes that can get wet. If your child is not potty trained you need to supply diapers or pull ups. Parents with infants need to supply formula or breast milk baby food Pacifiers Bottles Pack n' Play Sheets for Pack n’ Play Any other supplies that the parent or guardian child may need I supply Blankets and No Spill Cups. These items will be kept in the parent or guardian child’s cubbie. These are to be kept at the provider’s home. Parents will be notified when supplies are running low. 6 The parent’s or guardian’s child or children must be dressed and ready for a busy day at daycare including a clean diaper or underwear and a clean body before they will be allowed in the daycare area. If for some reason, these rules are not adhered to the parent or guardian child(ren) will be terminated. If the parent or guardian child(ren) is under the age of two, the law requires him/her to sleep in a crib/playpen that meets specific requirements. The parent or guardian will provide a portable crib/playpen to be used for sleeping purposes. ACCIDENT REPORTS If the parent or guardian child(ren) is hurt while in the provider care, the provider will provide a detailed report. The provider or guardian will be required to sign the report. The provider will need to keep the signed copy in the parent or guardian child’s file. If the parents would like a copy for the parent or guardian records, please inform the provider and the provider will see that the parent or guardian get one. HOUSEHOLD PETS This facility does contain outdoor pets: which includes 1(one) cat. At any time, if the parent or guardian or the parent or guardian child(ren) feels uncomfortable with any of the animals in the provider’s home, termination of care will be Name of Person Relationship Telephone Number Cell Number provided. No reimbursement will be given for care already provided or for the remainder of the scheduled week. CHANGES IN VITAL INFORMATION To ensure the safety of the parent or guardian child(ren) any changes in address, telephone numbers (home, work, and out-of-state contact) should be given to the provider, in writing, and as soon as possible. All names and telephone numbers on the parents’ child’s emergency forms must be kept current! All updates of information must be provided in writing no later than seven days following the change. AUTHORIZED PERSONS TO RELEASE THE PARENT’S OR GUARDIAN’S CHILD TO: 7 The parent or guardian child(ren) will ONLY be released to someone the parent or guardian list below in the "Authorized Persons To Release The Parent’s or Guardian’s Child(ren) To" section. The provider will refuse to let the parent or guardian child(ren) leave with anyone who is not on the list. The provider will require photo identification from anyone she do not recognize. ________(Initial) 1. If the list of authorized persons changes for any reason or someone not on the list will be picking the parent or guardian child up - the parent or guardian must notify the provider in writing before the parent or guardian child will be released to anyone but those persons listed. CONTRACT CHANGES AND RENEWAL The provider retains the right to terminate or make changes to this contract at any time. The provider will make an effort to give at least two weeks notice to any changes made. Contracts will be renewed on an annual basis for each child(ren). The renewal contract will be provided no later than fifteen days into the parent or guardian child’s anniversary month. The parent or guardian will have no more than seven calendar days to sign and return the documents to the provider. If the parent or guardian fails to return or sign the renewal contract, termination of care will be immediate. No refunds will be provided. Previous contracts will remain legal and binding until the renewal contract has been returned to the provider. 8 REQUIRED FORMS AND RECORD RETENTION In addition to this contract, the State of Texas has additional forms that are required by law to be completed and retained by the provider. Some of the information may be duplication to what is found in this contract. These forms, as this contract, are required to be completed before the parent or guardian child(ren) may be left in the provider’s care. The required forms and the parent or guardian child(ren)’s file will be retained for at least one year after the parent or guardian child has left the providers care. If the parent or guardian need copies of anything within the parent or guardian child’s file the parent or guardian will let the provider know and the provider will see that the parent or guardian receive them promptly. Holding Fee If the parent or guardian need the provider to hold the parent or guardian child(ren)’s spot in the provider’s daycare for 1 months or less there will be a holding fee. The parent or guardian will be responsible for $60 a week. This is to hold the parent or guardian child's spot in Cradle to Crayons childcare. This fee is nonrefundable. No spot will be held longer than 1 months. Liabilities: Children will never be left unsupervised nor will they be abused or neglected while in the provider’s care. However, accidents do happen. In case of emergency, the provider will administer the necessary First Aid. An ambulance will be called & the parent or guardian child will be transported to the nearest hospital. If an ambulance must be called to transport the parent or guardian child, the cost of the ambulance will be the parent or guardian responsibility. The parent or guardian is responsible for all costs involved in emergency medical treatment, including emergency transportation, if required. The owner of Cradle to Crayons, or her family will not be held liable for any sickness/injury of either parent/guardian or child while on these premises. Field Trips: Occasionally, the provider will take the children on neighborhood walks that involve transportation of children by foot or in strollers. The parents authorize that the child may participate in planned field trips or activities. Advance notice of all trips will be given except in cases of emergency not involving your child. _________(Initial) TRIAL PERIOD The first two weeks will be a trial period for the provider, parent, and child. This agreement may be terminated at any time during the trial period by either the parent or guardian or the provider. This must be provided in writing by the Friday before the 3rd week begins. 9 Fees will not be refunded. _________(Initial) DAYCARE POLICY If at any time the provider does not meet the expectations of the parent/guardian, The parent or guardian will need to give a 10-day written notice to Cradle to Crayons when taking the parent or guardian child out of the providers care (or, if preferred by the parents, payment for 10-day days). If at any time the child(ren) or parent/guardian does not meet the expectations of the provider, a meeting will be required to establish appropriate guidelines and a possible trial period (if necessary). If for some reason, no agreement can be obtained immediate termination of care will be provided. No REFUND will be provided, _________(Initial) If the parent or guardian leave Cradle to Crayons Home Daycare and do not come get all of the parents child’s items with in 30 days they will be donated to charity ________(Initial) The parent or guardian have read and received a copy of this contract and Handbook of Policies and Procedures. By signing this agreement, the parent or guardian agree to comply with all the terms covered in this contract and Handbook of Policies and Procedures: The parent or guardian understand this is a legally binding contract. Persons signing contract are responsible for payment and shall at this time enter into an agreement with Dionne Lane, of Cradle to Crayons Home daycare for the care of the parent or guardian (our) child(ren) ______________________ & ________________________. Starting date: _______________ A rate* of $ ____a week ____________a month These rates will be charged regardless of the child's attendance. The contracted days and hours are as in the above contract. Lack of enforcement of a certain policy at any time does not indicate that the particular policy is no longer in effect.
