  the Sea Turtle Conservation Regulations and as Managed by
  the FMPs for Shrimp in the Gulf and South Atlantic – Analyzed
  all listed species and critical habitat

• February 25, 2005, Biological Opinion on Shrimp Trawling under
  the South Atlantic FMP – Analyzed sawfish only

• January 13, 2006, Biological Opinion on Shrimp Trawling under
  the Gulf Shrimp Fishery – Analyzed sawfish only

• 2002 Biological Opinion found not likely to be
  adversely affected; no incidental take anticipated
• Key Facts of determination:
   • Anadromous: only exposed to Gulf shrimp fisheries
     during winter when in Gulf (late fall to early spring)
   • Occur mainly in state waters, very rare in federal waters
   • No documented takes in federal waters

• Both anticipated one lethal capture annually, based on
  opportunistic self-reported captures

• Concluded each fishery not likely to jeopardize …

• Each included an incidental take statement with reasonable and
  prudent measures and implementing terms and conditions to
  minimize post-release mortality and monitor take

• Shrimp trawl fisheries associated with high adult
  mortality
• January 2009 Recovery Plan ranks the severity of the
  threat of injury from trawl entanglement as high
• Data from Australia's Northern Prawn Fishery indicate
  sawfish get caught in the body of the net forward of the
  trawls

             Key Sawfish Facts: Life History

• Juveniles remain inshallow coastal waters; adults can
  be found in same habitat, but also offshore at depths
  up to at least 122 meters.

• Life history limiting factor for recovery: slow growing,
  late maturing, few young born

• Commonly grow to 18 feet+

Satellite archival tags (n=9) are
being attached in south Florida
area to better determine habitat
utilization
Archival tags can provide
information on daily and
seasonal movement patterns
that could aid in developing
additional critical habitat
information.

which my help reduce further
fishery interactions through
bycatch mitigation.

             Sea Turtles: Reinitiation Trigger=
             New Information on the Impacts of
             Trawling
• New information=
   • Elevated strandings associated with forced
     submergence
   • Recent evidence of TED Compliance problems (e.g.,
     skimmer trawl tow time violations, general TED regs.)
   • Increase in nearshore sea turtle abundance/trawl
     CPUE per relocation trawl captures
• Recent Actions
   • MDNR: ER to reduce skimmer trawl tow times to 30
     minutes; Free TEDS distributed to 90+ shrimp vessels;
     acquired funding for observers

• Continue to assemble the best available information
  (e.g., obtain bycatch estimates)
• Complete new biological opinion for all species
   • Formal Consultation Timeline:
   —135 days, once all necessary information
     received, including description of proposed action

  New opinion must be based on the best available scientific and
  commercial information; Must err on the side of conservation for
  the species
