1.0 EXPRESSION OF INTEREST
Expressions of Interest are sought from interested parties who wish to engage in
concept development work for a new public artwork commemorating Charles
Darwin (1809-1882).
This document outlines Darwin City Council's (Council's) requirements in seeking a
number of proponents to undertake concept development work for the Charles
Darwin Commemorative Artwork.
The purpose of this EOI process is to:
• Outline the opportunity to engage in concept development work for the
Charles Darwin Commemorative Artwork.
• Seek to formally identify parties from a public search process who have
the capacity, experience and interest in undertaking concept
development work for the Charles Darwin Commemorative Artwork.
• Select parties (or a party) to undertake concept development work for the
Charles Darwin Commemorative Artwork.
This initial phase of the process does not seek to establish any binding commercial
or legal terms and conditions between Council and any party and is intended to
provide a public process to identify the interests of various parties.
Subsequent stages will be at the discretion of Council and may include a formal
Stage 2 selective tender process with parties short listed from the EOI or direct
negotiations with one or more short listed parties.
This document also provides instructions on how to respond to this Expression of
Interest.

2.0 SCOPE & OBJECTIVES
This EOI process is intended to enable Council to pre-qualify and select a short list
of proponents that are the most suitable to engage in concept development work for
this project.
Those proponents who are selected for the short list will then be invited to participate
in a Stage 2 process (if required), and may be asked to provide additional supporting
information and/or a personal presentation. It is expected that this will take place
during November 2007.
Primary Objectives
The Darwin City Council’s objectives for the project are to achieve the following:
• Engage a number of artists or artist to undertake concept
development work for the Charles Darwin Commemorative artwork.
• Selection of the preferred design from a number of concepts
presented to Council following the concept development stage.
• Carry through to completion the commission, design and
development of a significant public artwork for the city of Darwin.
• Completion of the selected artwork by January 2009.
• Launch of the commissioned artwork on 12 February 2009 to
coincide with the 200th Birthday celebrations of Charles Darwin.
Tasks
During the concept development stage, the artist will:
• Define the importance, style and breadth of the commemorative
work by:
Consulting with key stakeholders;
Reviewing research on Charles Darwin, other artworks around
the world commemorating Charles Darwin, and the history of the
naming of Darwin city.
• Set project timelines for the design and construction of a Charles
Darwin Commemorative Artwork, to meet the project deadline of
January 2009.
• Set cost estimates for the public art project.
• Define benefits and limitations of the chosen site for the public art
piece.

• Present recommendations to the Arts and Cultural Development
Advisory Committee, and/or to the full Council on occasion.

3.0 BACKGROUND AND OVERVIEW
The port of Darwin, Australia, was sighted in 1839 by Lieutenant John Lort Stokes on
the third voyage of HMS Beagle, and named the Port of Darwin by the captain of the
ship, Commander John Clements Wickham, who had earlier accompanied Charles
Darwin, the British explorer and naturalist, on the second voyage of the Beagle from
1831 to 1836.
The Charles Darwin Commemorative Artwork, to be commissioned by Darwin City
Council, is intended to be launched on Charles Darwin’s 200th birthday, upcoming on
12 February 2009. Around the world, a variety of events are being planned to
celebrate this day, including the launch of a replica Beagle, the ship in which Darwin
circumnavigated the Earth between 1831 and 1836. For information on Charles

Around the world there are a number of sites commemorating Charles Darwin’s life
and work. It is anticipated that the Charles Darwin Commemorative Artwork to be
commissioned by Darwin City Council may link in some way to these international
sites.
Charles Darwin spent much of his working life in the London Borough of Bromley,
which maintains a significant program recognising Darwin’s life and achievements.

The “Living World” education centre at St. Louis Zoo in Missouri, USA features an
anamatronic Charles Darwin “robot” who helps to present to visitors “the story of the
animal world, an evolutionary journey from single-celled animals to man”. For more

Following the initial selection process for Darwin City Council’s Charles Darwin
Commemorative Artwork, up to five (5) artists will be selected to engage in research,
planning and concept development work over a three month period for a fixed fee.
Selected artists will report to the Community Development Officer on a fortnightly
basis and will be required to present to the Arts and Cultural Development Advisory
Committee (ACDAC) and/or the full Council on occasion. Following the concept
development period, Council will commission an artist or artists to develop the
selected artwork or artworks to completion.
Successful applicants for the concept development stage of the artwork will be
invited to attend a Council briefing to discuss the location, budget, and scope of the
artwork.
An approximate budget for the artwork is $50,000, however further funding for the
project may be sought.

4.0 EXPRESSION OF INTEREST REQUIREMENTS
Council is seeking Expressions of Interest proposals that address the following
matters:
Commercial Terms
Proponents must provide the details required in the EOI Form.
Supporting Materials
Proponents must submit a Curriculum Vitae and portfolio of works.
Vision and Community Benefits
Proponents must submit a proposal which is in line with Council’s Action Plan to:
• add to Darwin’s stock of tourism infrastructure;
• support the Central Business District as a vibrant and active centre; and
• assist in the promotion of Darwin as a major tourist destination.
The proposal must include the EOI Form.
The Expression of Interest proposal must include the matters detailed in the
Expression of Interest Requirements.

Ownership of the Expression of Interest Documents
All EOI documents become the property of the Council upon their submission.
Council may make copies of the EOI documents for any purpose related to this
project, in particular for the evaluation of the EOI.
Nature of EOI
The EOI is not:
• An offer of any kind;
• An invitation to tender; or
• Intended by Council to create legal relations with any person
receiving or responding to it.
Costs Borne by Applicants
All costs and expenses incurred by Proponents in any way associated with the
submission of EOI will be borne entirely and exclusively by the Proponent.

Right To Extend Closing Date
Council may in its absolute discretion at any time before the closing date extend
the closing date by posting a notice on Council’s web site www.darwin.nt.gov.au
Whilst all efforts will be made to advise parties who have registered on the web
site, it is the responsibility of prospective Proponents to make their own enquiries in
this regard.
Late Lodgement of EOI
An EOI lodged after the closing date will not be accepted.

5.0 SELECTION CRITERIA AND DECISION
Assessment Criteria:
• Quality of Curriculum Vitae and Portfolio.
• Experience in undertaking public art works for local government
organisations or similar.
• Quality of public art works undertaken for local government
organisations or similar.
EOI submissions will be assessed by a panel comprising members of the Council
staff and assisted by external advisers.
The decision on the selection of proposals for the short list as part of the stage 2
selected tender process may be determined by Council.
Darwin City Council reserves the right to short list as many applicants, or none, and
to vary the process outlined in this document at its discretion.
Council’s Right to Vary the Process
Council reserves the right at any stage to amend, vary, discontinue or supplement
the process set out in this Expression of Interest Package.

All financial or other information contained in this Information Memorandum or any
Attachment is for the assistance of Applicants but no representation or warranty in
respect of that material or by any other means made by on behalf of the Council
(and/or its agents) is binding on the Council (and/or its agents) or actionable by the
Applicant.
Applicants are required to obtain their own legal, financial or other advice and to
make their own enquires in relation to the information contained in this Information
Memorandum and the Attachments.
No responsibility is accepted by the Council (and/or its agents) as to the accuracy of
any such financial or other information or for the omission of any relevant

ATTACHMENT 1 –
CONDITIONS OF EXPRESSION OF INTEREST
MANDATORY REQUIREMENTS
Expression of Interests will not be considered unless the following mandatory
requirements are complied with:
Expression of Interest Closing
The Expression of Interest closes at the time and date on the front cover of this
EOI Package. Expressions of Interest must be lodged before the closing time and
the closing date (which is 2:00pm sharp on Thursday 25 October 2007).
Expression of Interest Lodgement
Expression of Interests can be lodged in the Tender Box in the Civic Centre, Harry
Chan Avenue, Darwin NT. Access to the Tender Box is available between 8:30am
and 5:30pm Monday to Friday (public holidays excluded). Expression of Interests
can also be mailed or delivered to Darwin City Council, GPO Box 84 Darwin NT
0801.
Expression of Interests sent by mail shall be admitted subject to receipt at the Civic
Centre in time for lodgement in the Tender Box prior to the closing of the Tender
Box. It is the responsibility of the Proponent to ensure the Expression of Interest
reaches the Tender Box before the closing time and date. Tenders not conforming
with this requirement shall be regarded as invalid.
No E-mail or Facsimile Expressions of Interest
Expressions of Interest will not be accepted via e-mail or facsimile.
Applicants must submit all the information sought in the Expression of Interest
Package.
No Canvassing
Canvassing of Council officers or Elected Members of Council is not permitted and
could result in the Expression of Interest being disqualified.

EXPRESSION OF INTEREST PACKAGE
If you are in any doubt as to the true meaning of any of the information or
Expression of Interest documents comprised in this Expression of Interest
Package; or if you consider any provision, description or other matter is
contradictory or inconsistent with any other provision, description or other matter,
you must immediately notify the Council.
Darwin City Council will consider all requests for clarification, and determine
whether or not to provide any interpretation of the documentation upon which
clarification has been sought.
Any interpretation of the documentation comprising this Expression of Interest will
be made only by formal Addendum to the Expression of Interest documents, and
will be transmitted to all prospective Applicants who are registered as having been
issued with the Expression of Interest Package.
Do Not Copy Expression of Interest Package for Others
You must not copy the Expression of Interest Package for use by other persons. If
unauthorised copies of the Expression of Interest Package are made, the Darwin
City Council takes no responsibility for failure to provide any Addenda to persons in
receipt of unauthorised copies of the Expression of Interest Package.
Confidentiality
Darwin City Council will endeavour to respect the confidentiality of submissions
and will not disclose them to the public except where the disclosure is permitted or
required by law.
In deciding whether or not to disclose EOI submissions requested under FOI
legislation, Council will ensure that the FOI officer receives advice from a legal
practitioner.
All proponents will be required to maintain confidentiality with respect to their own
competing submissions, and will not be permitted to advance their own bids via the
media without the prior written approval of Council.
Expression of Interest Evaluation Process
Darwin City Council will evaluate the Expression of Interests according to the
information sought in the Expression of Interest Package and provided by the
Applicant.
Applicants may be short listed for further consideration. Further information to
substantiate Expression of Interest submissions may be requested. This process is
not to be construed as an opportunity to amend an Expression of Interest
submission.
An Applicant shall not take a request for information as an indication that his/her
Expression of Interest will be successful.

Non-Mandatory Administrative Requirements
Expression of Interests should be submitted in duplicate printed in black (or
colour) on single sided pages.
Expressions of Interest should be enclosed and sealed in an envelope.
Oversized Expression of Interests should be sent to the Darwin City Council GPO
Box 84, Darwin NT 0801
Tailor Expression of Interest Submissions
Applicants are encouraged to tailor their submissions according to the Expression
of Interest evaluation criteria. To assist with evaluation, the Expression of Interest
submission should be based on the same topics and set out in the same order as
the topics in this Package.
Declare Conflict of Interest
You must declare any conflict of interest that may detrimentally affect or be
perceived to detrimentally affect the Proponent’s (or agent's) relationship with the
Council (or Council Members) at the time of submitting the Expression of Interest.
If for any reason the Council requires any amendment to the Expression of Interest
Package, this will be undertaken by way of Addendum issued to all those who
received the Expression of Interest Package .
