Secrecy Agreement
Teknologisk Institutt as – The National Institute of Technology - is a shareholding company, wholly owned by a Norwegian independent private foundation. The company’s main objective is to offer upto-date expertise and technology competence to the Norwegian industry, with the aim to improve profitability and competitiveness. Among the wide range of services offered is preparation of high quality Material Safety Data Sheet (MSDS, Product Label), product registration, transport regulation, training courses, advisory services on handling chemicals, etc. The undersigned consultants, employed at Teknologisk Institutt as (TI) will treat any information given by the client confidentially and keep any written information safely locked away. However, when needed to complete the assigned work, they may have to give away a minimum of information to third party or government authority, but only after written permission from the Client. To ensure traceability, TI will keep all written information for at least 5 years, safely locked away and with limited access. The consultants will only make use of the necessary minimum of information needed to meet market demands and government regulations regarding health, safety and environment. This includes declaration of parts of the formula on the Product Label and MSDS. But it may also include the complete formula for product registration under strict confidence with the National Registrar in countries where required. TI guarantees that the undersigned consultants will perform their work according to this agreement. TI shall only be liable for damage and/or loss caused by TI’s gross negligence. Under no circumstances shall TI’s liability for breach of this or any other written agreement, exceed the contractual compensation for TI, related to the actual task. Any dispute arising with reference to this agreement shall, if not resolved otherwise, be brought before the arbitration court in Oslo, Norway. This agreement is valid only when signed by the Client, the consultants in question and a person in power to sign on behalf of TI. The agreement is issued in duplicate of which the Client and TI shall keep one each.
