Chairperson Angela Giessner called the meeting to order at 7:00 p.m. During the meeting, Mr. Lasher mentioned the video system is not functioning due to an electrical problem with the projector controls. Therefore, no Power Point presentation of case materials could be provided. AGENDA PUBLIC HEARING ITEM #8-S070501, Site Plan, Goelzer Addition, Block 1, Lots 3R, 4, and 5 (City Council District 1) Senior Planner Mary Elliott presented this case to the Commission for approval of a Site Plan containing 3.33 acres for the development of three office/warehouse facilities on three nonresidential lots. The site is currently zoned Planned Development-221 (PD-221) and is generally located west of Belt Line Road and south of Trinity Blvd. The owner/applicant is Goelzer Industries, c/o Paul Goelzer. The applicant is requesting Site Plan approval for three 11,220 square-foot office/warehouse buildings, totaling 33,660 square-feet of building area. The tenants remain to be determined. The proposed pad sites will be 52,404 square feet, 46,454 square feet and 46,572 square feet, which is a little over one acre apiece. The total land area is 145,430 square-feet or 3.33 acres. The applicant is appealing the twenty-five (25) foot building setback between buildings as required by Planned Development-221. 2

Commissioner Lester asked staff if the Fire Department had expressed any concerns or comments regarding this case. Mrs. Elliott replied no, the Fire Department did not address any concerns with this site plan. Pann Sribhen, P.E., 17819 Davenport Road, Ste 210, Dallas, TX stepped forward representing the case. Mr. Sribhen presented the Commission with color renderings of the proposed office/warehouse facilities. Commissioner Murphy asked the applicant why they are requesting a variance to the twenty-five foot building setback between buildings. Mr. Sribhen said providing a 20 foot building line between buildings would give them the adequate setbacks needed for additional landscaping and sidewalks adjacent to the parking areas located between buildings. Commissioner Giessner noted there were no more speaker cards submitted for this case. There being no further discussion on the case, Commissioner Lester made a motion to close the public hearing and approve case S070501. AGENDA PUBLIC HEARING ITEM #9-SU070502/S070503, Specific Use Permit/Site Plan, Fruit of the Earth, 1430 Avenue R (City Council District 1) Senior Planner Martin Barkman presented this case to the Commission for approval of a Specific Use Permit for an outside storage tank with hazardous contents (ethyl alcohol). The site is currently zoned Planned Development-63 Light Industrial (PD-63 LI) District and is generally located south of Avenue R and east of N. Great Southwest Parkway. The owner is Fruit of the Earth, c/o Thomas McCurry. The applicant is Enterprise E & M., c/o Kelly Thompson.

PLANNING AND ZONING COMMISSION MEETING MINUTES OF MAY 21, 2007 The proposed use will continue to function as a manufacturing and distribution facility for skincare products within a Planned Development for Light Industrial uses. The existing facility currently mixes, bottles, and distributes skincare lotions, creams, sunscreens, and burn relief aids. The business will operate from 6:30 am to 3:00 pm, with some extended hours during peak seasons. They employ between 50 and 150 individuals based on production requirements. The company uses their regular employees and supplements them with temporary employees provided by temporary employment services. No appeals are being requested by the applicant. The Development Review Committee recommends approval of the request for a Specific Use Permit for mass storage of ethyl alcohol, a hazardous material, in a Planned Development, Light Industrial District in accordance with the conditions shown in the draft ordinance. Commissioner Ethridge asked if the ethyl alcohol was used in their products. Mr. Barkman replied yes, the existiing facility currently uses the alcohol when mixing bottles of skincare lotions and creams. Claude Smith, Driector of Operations for Fruit of the Earth, Inc., 902 Rosewood Court, Euless, TX stepped forward representing the case. He stated the proposed storage tank would be located on the northwest corner of the property. Commissioner Murphy asked Mr. Smith to explain the containment process and how it would function. Mr. Smith noted the pumps have valves that would need to be manually opened when a spill occurs. Rainwater accumulations would be pumped outside the dike wall across paving and into a stormwater swale (or drainage ditch) at the south end of the building. If there is a spill, the Environmental Department would be notified. Commissioner Lester stated he understands that safety is their top priority. He asked if the piping process is safer than using the steel tote storage containers. Mr. Smith replied yes, it would be a safer process and a dramatic improvement since it would minimize the risk for movement and involve less handling of the material in individual containers of alcohol stored in totes. The alcohol would be piped directly into the mixing area. Commissioner Giessner noted there were no more speaker cards submitted for this case.

AGENDA PUBLIC HEARING ITEM #10-SU070402, Specific Use Permit, 3 Dollar Car Wash, 5100 Block of S. State Highway 360 (City Council District 6) Senior Planner Martin Barkman presented this case to the Commission for approval of a Specific Use Permit for an approximate 11,366 square foot car wash facility. The site is currently zoned Planned Development-114A (PD-114A) District and is generally located east of S. State Highway 360 and north of W. Camp Wisdom Road. The owner is One Prime L.P., c/o Keith Falls. The applicant is EDG Architects, c/o Vincent Jarrard. The proposed use will function as an automated tunnel type car wash designed in a modern architectural style. The carwash building is 4,752 square feet, a polishing station at 600 square feet, and a vacuum canopy at 6,014 square feet for a total structure area of 11,366 square feet. The proposed structure provides a functional design with an articulated roof design and a varied palette of masonry materials and colors. The “C” Commercial District requires five percent of the site be landscaped. The applicant is providing 13.5% of the total site in landscaping with the majority being in the front building setback and the remainder provided throughout the site. Approximately 16 cars will be allowed to queue prior to entry into the carwash tunnel. After the wash cycle has completed, vehicles will then have the option of going through an automatic car polisher or to the covered vacuum and detail stations. The applicant has owned other carwash facilities in other area cities and has experience with their operations. Hours of operation shall be from 7:00 am to 9:00 pm with earlier closing hours in winter months. There will be two to three regular employees on site during operating hours. No appeals are being requested by the applicant. The Development Review Committee recommends approval of this request for a Specific Use Permit and Planned Development Site Plan for a full service carwash in Planned Development No. 114A for Commercial uses in accordance with the conditions specified in the draft ordinance. Staff would request the applicant provide an alternative color palette for the buildings that would better suit the surrounding location.

PLANNING AND ZONING COMMISSION MEETING MINUTES OF MAY 21, 2007 Vincent Jarrard with EDG Architects, 660 Preston Forest, Ste 417, Dallas, TX stepped forward representing the case. Mr. Jarrard expressed his appreciation to staff for assisting them on this project. He reviewed the traffic flow and how the traffic would circulate around the site. The carwash exit doors would be setback to provide the visibility needed when exiting the carwash tunnel onto the access easement. He noted the building façade colors may violate some peoples’ sensibilities, but it is provided to correspond with their theme of cleaning cars to a “mint condition”. They have chosen the peppermint red and cool blue colors to provide a more modern feel that would attract customers. He asked that the Commission embrace this project and its design, and mentioned this is a great location for a carwash that would be a great asset to the community. Commissioner Murphy asked if one would stay in the vehicle while entering the tunnel, and asked why they are proposing a handicap parking space. What would this space be utilized for, and would there be an intercom system providing assistance if a handicapped person needs help. Mr. Jarrard noted everyone would remain in his or her vehicle while entering the tunnel. The handicapped space is a State mandated requirement and needs to be provided on site. He stated he is not aware of an intercom system, but there would be several attendants on site in case someone needs assistance. Commissioner Murphy asked if there are any guidelines or studies regarding the location and suitability of carwash uses. Mr. Jarrard stated carwashes have changed over the years, and by changing their architectural styles, they are being built in higher-end neighborhoods and commercial districts. This particular site has approximately 24,000 vehicle trip per day along SH-360. He stated his client hopes to capture approximately 9% of that daily traffic volume as their customer base. Commissioner Murphy asked if the success of their operation depended on the type of architectural concept proposed and on their color scheme. Mr. Jarrard replied they would like to keep the proposed peppermint colors as these colors would correspond to their theme. They want a concept that would draw attention to their facility. The red tone glazed brick is symbolic of the peppermint theme, with the blue tone glazed brick being symbolic of water and cleanliness. Commissioner Lester asked if this site would be able to handle the traffic flow pattern provided. Mr. Jarrard replied yes, they are looking at about six to seven hundred vehicles a day, and are very confident the traffic pattern would be able to handle the volume. Commissioner Ethridge asked how would the seconded tunnel would be utilized for polishing. Would it be self service or automated . 6

Mr. Jarrard replied yes, it would be an automated process that would require people to drive through the tunnel for polishing. Laurie D’Alleva, 2020 E. Pioneer Parkway, Ste 200, Arlington, TX stepped forward in support of this request. She stated she is the co-owner of the property. The color scheme they are proposing is to invite more of a diverse cliental, and they would hope to see more woman utilizing the carwash. She stated they would also be handing out mints to their customers after the car are washed. Therefore, the colors would tie into their theme. Doug Sweeney, 2014 Klondike, Grand Prairie, TX stepped forward representing the developer. He stated the internal traffic flow would not be a problem and the carwash would fit-in well at this location. Commissioner Murphy asked Mr. Sweeney how he expects the adjacent properties to be utilized Mr. Sweeney stated it would depend on the type of uses coming in the area. The adjoining tracts would be occupied by a mixture of retail, restaurant, office and hotel users, and there has been some immediate interest from restaurants and hotels chains. Commissioner Giessner noted one speaker card submitted in support for this case who did not wish to speak. Cristino Velasquez, 200 Crenshaw Drive, Mansfield, TX 76063 There being no further discussion on the case, Commissioner Austin made a motion to close the public hearing and approve case SU070402. Commissioner Murphy asked for a discussion on the motion. He noted the applicant’s design and color scheme is to emphasize a marketing concept. He encouraged the Commission to consider what would be the best use for the community. With the property zoned for commercial uses, an aggregation of restaurant uses may be a better option for this location than a carwash. There being no further discussion on the case the Commission voted.
