Dr..John.Ayres                                                                 It.was.plain.during.the.short-lived.debate.there.are.individuals.who.
                                                                               disagree. with. these. proposed. changes.. Further,. they. feel. other.
Since.this.is.my.first.report.for.the.New.Year,.let.me.start.by.extending.     procedures. ranging. from. bovine. pregnancy. diagnosis,. obstetrics.
my.good.wishes.to.the.SVMA.membership.for.a.successful.2006..                  and.even.surgery.should.not.be.restricted.to.veterinarians.only.
With. cattle. markets. improving. and. reports. of. a. strengthened.
commitment.to.companion.animals. by.many.practices. across. the.               As.with.all.legislation,.it.is.the.elected.members.of.the.legislature.
province,. I. think. the. coming. year. looks. very. bright. for. the.              who.will.debate,.alter.and.ultimately.pass.proposed.legislation.

As. most. members. are. aware,. the. SVMA. has. been.                                         their. own. goals. and. agendas. will. be. recognized.
working.with.the.provincial.departments.of.Justice.                                             in. the. legislation.. At. present,. our. Act. is. open. for.
and.Agriculture.over.the.past.several.months.to.put.                                            amendments.and.this.lobbying.effort.is.occurring..
forward. proposed. amendments. to. the. provincial.
Veterinary. Act.. . The. amended. Act. was. finally.                                             This. is. where. it. is. extremely. important. that. the.

presented.to.the.legislature.for.debate.on.November.                                            elected. members. of. the. legislature. need. to. hear.
28,.2005...Unfortunately,.debate.on.the.amendments.                                           from. the. veterinary. community.. While. the. SVMA. will.

that. veterinarians. are. the. only. professionals. with. the. requisite.      members.

and.proper.technique.that.are.able.to.perform.these.procedures.with.           With.this.in.mind,.I.encourage.veterinarians.to.be.active.in.lobbying.
an.acceptable.level.of.competency,.safety.and.attention.to.animal.             the. government. and. opposition. members. about. changes. to. the.

program.includes.individual.practice.surveys.sent.to.SVMA.practices.            declaration. form. on. time. . It. continues. that. too. many. members.
early. in. 2006,. economic. reports,. suggested. fee. guides,. associate.       misplace.these.papers...The.SVMA.currently.charges.for.duplicate.
compensation.benefits.reports,.non-DVM.wage.reports.and.individual.             dues.receipts.and.council.will.be.asked.to.consider.a.similar.charge.
practice.benchmarking.in.each.province..In.addition,.veterinarians.             for.duplicate.forms.and/or.invoices...I.also.thank.those.members.not.
employed.in.government,.industry.and.education.will.be.surveyed..               submitting.either.completed.practice.declaration.forms.or.their.fees.
What. better. time. for. Saskatchewan. veterinarians. to. address. the.         on.time...We.appreciate.the.late.payment.penalties.and.will.put.the.
current.low.rates.of.compensation.that.do.not.match.the.level.of.our.           extra.revenue.to.good.use...Thank.you......

Members. need. to. be. aware. of. this. fall’s. debate. in. the. provincial.
legislature.regarding.proposed.changes.to.our.Act...A.few.stakeholder.
groups.appear.opposed.to.changes.to.the.scope.of.practice.definition.
regarding.equine.castration.and.dentistry.to.animals...Similar.to.the.
situation.in.Alberta,.we.are.trying.to.better.define.what.is.the.practice.
of. veterinary. medicine. while. others,. mainly. cattle. producers,. are.
concerned.they.will.lose.the.right.to.treat.their.own.animals...One.
Saskatchewan.MLA,.speaking.to.the.proposed.amendments.to.the.
Act. in. the. legislature,. indicated. he. was. in. favour. of. the. changes.
meant.to.allow.the.SVMA.to.deal.more.effectively.with.delinquent.
members,. but. appears. against. those. changes. preventing. anyone.

  humans,.such.as.avian.flu.and.mad.cow.disease,.and.the.shortage.
                                                                                  Colleges.is.helping.to.recruit.and.train.more.veterinarians.in.public.
  of.veterinarians.available.to.deal.with.them.has,.according.to.this.
                                                                                  health.with.the.goal.of.training.another.400.to.500.vets.annually,.
  story,.the.American.Veterinary.Medical.Association.and.Congress.

Prudent Use of Fluoroquinolones in Veterinary Medicine
                                   Health Canada’s Advice to Veterinarians
  Many. antibiotics. used. in. agriculture/livestock. production. belong.         As. part. of. the. conditions. of. approval,. Health. Canada. requires.
  to. the.same.classes. of.antibiotics. that.are.being.used. in.human.            that. manufacturers. include. appropriate. label. directions. for.
  medicine.. Health. Canada’s.Veterinary. Drugs. Directorate. (VDD). is.          fluoroquinolones. including. WARNING. statements. on. the. label. to.
  committed. to. mitigating. any. potential. risk. to. public. health. from.      guide.veterinarians.in.prescribing.these.drugs..
  veterinary.drugs.and.classes.of.drugs.that.have.been.approved.for.
  sale.in.Canada..                                                                Health. Canada,. through. the. Canadian. Integrated. Program. for.
                                                                                  Antimicrobial. Resistance. Surveillance. (CIPARS),. is. monitoring.
  Health Canada’s Science-Based Decision & the Rationale:                         resistance. in. bacteria. to. this. class. of. drugs.. Should. there. be. an.
  The. available. scientific. evidence. indicates. there. may. be. a. link.       apparent.increase.in.this.trend,.appropriate.regulatory.action.will.
  between. the. use. of. antimicrobials. including. fluoroquinolones. in.         be.taken.to.preserve.the.effectiveness.of.this.very.important.class.
  animals.and.the.development.of.resistance.in.bacteria.of.concern.               of.drugs.to.treat.infections.in.humans..

  (including.resistant.gram-negative.bacterial.infections.and.enteric.            Fluoroquinolones.were.authorized.for.sale.to.provide.veterinarians.

  infections)..They.are.often.the.drug.of.choice.under.these.conditions,.         with.an.alternative.course.of.treatment.only.when.other.available.
  and.when.the.availability.of.alternative.treatments.is.limited..                drugs.are.not.effective,.therefore.to.limit.the.potential.development.
                                                                                  of. antimicrobial. resistance,. Health. Canada. recommends. that.
  The. development. of. fluoroquinolone. resistance. in. response. to.            fluoroquinolone.drugs.such.as.A180.(Danofloxacin),.Baytril.100.and.
  drug.use.is.significant..Available.scientific.data.shows.that.there.            Baytril.Injectable.Solution.(enrofloxacin),.be.used.only.according.to.
  is. cross-resistance. among. fluoroquinolone. drugs.. Plasmid-                  the.approved.Canadian.label..These.drug.products.should.not.be.
  mediated.quinolone.resistance,.often.associated.with.multiple.drug.             used.in.an.extra-label.manner..
  resistance,.is.also.emerging..

                              in the Fraser Valley of British Columbia
Dr..Sandra.Stephens                                                       in.other.resident.birds..From.these.samples.it.was.possible.to.
Canadian.Food.Inspection.Agency                                           isolate.the.virus.and.confirm.it.as.type.H5N2....This.was.reported.
                                                                          on.November.29,.2005..The.isolated.virus.is.most.similar.to.an.
On. November. 18,. 2005,. Influenza. A. (H5). was. diagnosed. by.         H5N2.isolate.from.turkeys.in.California.in.2002.
PCR. at. the. British. Columbia. Ministry. of.Agriculture. and. Land.
(BC-MAL).laboratory.in.Abbotsford...The.virus.was.detected.in.a.          Tracing.movements.in.to.and.out.of.the.infected.premises.during.
commercial.meat.duck.exhibiting.a.mild,.moist.dermatitis.at.a.            the.21.days.preceding.the.diagnosis.of.H5.confirmed.the.duck.
processing.plant.and.was.submitted.for.routine.diagnostics.on.            and. goose. operation. was. vertically. integrated. and. relatively.
November.15...The.duck.came.from.a.specialty.duck.and.goose.              isolated.from.the.remainder.of.the.poultry.industry.in.the.Fraser.
grower.near.Chilliwack...The.BC-MAL.Laboratory.reported.the.              Valley..An.additional.dangerous.contact.was.identified;.a.duck.
finding. to. the. Canadian. Food. Inspection. Agency. (CFIA). and.        breeder.that.supplied.hatching.eggs.to.the.Balut.egg.hatchery.
samples. were. forwarded. to. the. CFIA’s. National. Centre. for.         located.on.the.index.premise..Investigation.of.this.farm.revealed.
Foreign.Animal.Diseases.(NCFAD).in.Winnipeg.for.confirmation..      .     the.presence.of.chronic.health.problems.and.testing.for.avian.
In.accordance.with.international.standards.set.for.Influenza.A.           influenza.was.completed.on.November.26,.2005.with.negative.
viruses.of.subtype.H5.or.H7,.the.OIE.Central.Bureau.was.advised.          results.
on.November.19,.2005.of.these.preliminary.findings.
                                                                          Disease Control Actions Taken:
The.NCFAD.confirmed.the.presence.of.an.Influenza.A.type.H5.               CFIA’s.disease.control.actions.were.based.on.four.major.disease.
on.November.20,.2005....A.number.of.countries,.including.the.             control.principles:.
United. States,. closed. their. borders. to. Canadian. poultry. and.
poultry.products...After.receiving.a.report.on.the.investigation.         •..rapid.detection.of.newly.infected.flocks.(surveillance)
conducted. and. the. control. measures. put. in. place. the. USA.         •..halting.the.spread.of.the.disease.through.movement.controls.       .
limited.the.restrictions.on.Canadian.poultry.to.the.province.of.          . and.the.rapid.destruction.of.infected.flocks
British.Columbia.                                                         •.movement. controls. and. surveillance. on. high. risk. contact.     .
                                                                          . flocks.and.proximal.flocks.(within.5.km),.and.
The.index.premise.was.a.duck.and.goose.grower.and.breeder.                •.preventing.re-infection.through.the.effective.biocontainment.       .

by.engaging.in.a.course.of.conduct.dating.from.approximately.         suffered. during. tagging. including. broken. legs,. broken. necks,.
January. 01,. 1992. to. February. 15,. 2001. which. involved.         eyes.poked.out.and.how.these.deer.would.try.to.jump.through.
inappropriate. trapping,. handling,. marketing,. certifying. the.     a.fence.and.break.their.necks.as.a.result.of.being.herded...The.
health.of,.and.exporting.from.Canada.white-tailed.deer...             witness.states.when.deer.died.he.and.Dr..Murray.would.remove.

2001,.two.game.farm.operators.who.purchased.deer.from.Dr..            Dr.. Murray. was. selling. does. for. $3,000. to. $5,000. and. good.
Murray.in.1995.and.1998.and.two.CFIA.veterinarians...Testimony.       bucks,.up.to.$10,000..He.states.he.saw.large.amounts.of.US.
from.these.witnesses.dealt.with:.live.and.dead.animals.found.         cash.lying.around.Dr..Murray’s.residence.and.assumed.it.was.
on. Dr.. Murray’s. farm. during. the. search,;. conditions. and.      from.the.sale.of.deer.to.the.United.States...
temperament. of. animals. purchased. from. Dr.. Murray;. reliance.
on.Dr..Murray’s.expertise.as.a.veterinarian.and.game.farmer.to.       Several.times.during.the.video.taping.of.this.sworn.statement.
dispel.concerns.the.deer.he.was.selling.were.not.game.farmed.         the.witness.refers.to.time.he.himself.spent.in.jail.
animals;.CFIA.and.Saskatchewan.Agriculture.documents.related.

submitted.two.exhibits,.the.Crown’s.immunity.agreement.and.the.               once.for.3.months.and.once.for.2.years.followed.by.3.years.of.
criminal.record.of.the.witness.testifying.via.video.tape.                     practice. under. supervision.. He. was. ordered. to. complete. 40.
                                                                              hours.of.continuing.education.within.2.years.and.had.his.practice.
The.DC.accepted.all.evidence.presented,.most.notably.Dr..Murray’s.            monitored.for.2.years..He.was.formally.reprimanded.and.required.
guilty.plea.to.the.charge.of.possessing.unlawfully.taken.wildlife.            to. submit. a. certificate. indicating. he. has. attended. a.Workplace.
(white-tailed.deer).indicating.he.knew.deer.in.his.possession.were.           Hazardous.Materials.handling.seminar.within.6.months.at.his.own.

about. veterinary. prescription. drugs. being. sold. out. of. a.          having. recently. seen. and. without. becoming. personally.
building. located. on. a. farm. near. Saskatoon.. . The. farm.            acquainted.with.the.keeping.and.care.of.the.animals.during.
operated.a.feedlot.as.well.as.a.small.farm.supply.and.parts.              the.period.26.November.2003.to.06.April.2004,.contrary.to.
store...Following.visits.by.the.RCMP.and.the.SVMA.registrar,.             bylaw.22.9(c).and.32.11(c)(2);
it.was.learned.prescription.drugs.being.sold.at.this.farm.were.
purchased.from.a.feedlot.practice.in.Alberta...                           2.. failed. to. produce. original. medical. records. related. to.
                                                                          his. care. and. treatment. of. the. animals. belonging. to. the.
The. ensuing. investigation. revealed. the. feedlot. owner. had.          Saskatchewan.feedlot.for.which.he.prescribed.and.dispensed.
visited.the.offices.of.the.practice.in.Alberta.on.November.20,.           various. prescription. drugs,. contrary. to. Bylaws. 22.9(d). and.
2003.where.he.met.with.the.practice’s.veterinarians.and.was.              Bylaw. 36.8. related. to. the. SVMA’s. 2004. Practice. Standards.
provided. information. on. the. practice’s. health. management.           for.Medical.Records;
programs. and. services,. including. a. client. handbook.. . One.
week. after. this. visit. the. feedlot. practice. began. supplying.       3.. failed. to. confirm. the. pharmaceutical. and. biological.         .
equipment,. materials,. biologics. and. pharmaceuticals,.                 products.sold.or.supplied.to.the.Saskatchewan.feedlot.by.his.
including. prescription. drugs,. to. the. feedlot. and. continued.        practice.were.being.used.for.the.treatment.of.animals.resident.
to.do.so.until.the.end.of.December.2004.when.the.practice.                in. that. feedlot. or. cow. herd. with. the. result. being. certain. of.
severed.its.relationship.with.the.feedlot.                                the.drugs.were.being.resold.and/or.offered.for.resale.to.the.
                                                                          general.public,.contrary.to.Bylaw.32.12..
During.the.13-month.relationship.only.three.of.approximately.
eight. veterinarians. working. for. the. feedlot. practice. were.         At. the. hearing. the. registrar. and. the. RCMP. officer. testified.
licensed. members. of. the. SVMA;. one. of. those,. Dr.. Eugene.          regarding. their. visits. to. the. feedlot. and. their. conversations.
Janzen,.visited.the.feedlot.three.times...A.second.veterinarian.          with. the. owner. and. his. staff.. .The. RCMP. officer. stated. the.
from. the. feedlot. practice. visited. the. feedlot. once;. however,.     feedlot. owner. claimed. he. did. not. know. he. could. not. sell.
that.veterinarian.was.not.a.member.of.the.SVMA.at.the.time.               prescription.drugs....
of. the. visit.. .The. unlicensed. veterinarian’s. visit. occurred. in.
late.December.of.2003.while.Dr..Janzen’s.first.visit.occurred.            The. feedlot. owner’s. testimony. confirmed. his. visit. to. the.
April.07,.2004.with.the.other.two.visits.occurring.in.July.and.           feedlot.practice.in.November.2003.and.the.December.2003.
November,.2004..                                                          visit. to. his. feedlot. of. the. unlicensed. veterinarian. who. took.
                                                                          photographs. of. the. feedlot. and. looked. at.a. downer.animal,.
The. investigation. also. revealed. no. information. that. could.         diagnosing.ITEME..The.owner.testified.Dr..Janzen.was.never.
be. considered. medical. records. relating. to. the. incidence. of.       in.the.area.of.the.building.housing.the.drugs.being.offered.for.
disease.or.treatment.of.animals.had.been.submitted.to.the.                sale.and.whenever.veterinarians.from.the.feedlot.practice.were.
Alberta.practice.by.the.feedlot.during.the.13.month.period.the.           scheduled.to.visit.the.prescription.drugs.were.removed.from.
practice. was. providing. service. to. the. feedlot.. .The. practice.     sight..The.owner.also.described.the.computerized.system.the.
indicated. the. failure. of. the. client. to. submit. computerized.       feedlot.practice.uses.as.being.a.biological.accounting.system.
records. and. data. contributed. to. their. decision. to. sever. its.     working.off.a.chute-side.computer.integrated.with.a.weigh.
relationship.with.the.feedlot.                                            scale. and. thermometer. that. sorts. incoming. cattle. by. body.
                                                                          temperature.with.processing.and.treatment.protocols.based.
As.a.result.of.the.investigation.Dr..Janzen.was.charged.with.             on.temperature.ranges.and.also.gathers.or.stores.information.
unprofessional.conduct.when.he:.                                          on.each.animal’s.ear.tag.number,.weight,.origin.and.health.

listed.under.Schedule.F,...Part.1.of.the.Regulations.of.Canada’s.         visit.to.the.feedlot.that.indicated.no.data.had.been.stored.in.
the.computer.system.as.the.computer.was.not.hooked.up.                     farm.visits.there.was.only.one.record.produced.by.Dr..Janzen,.
In.considering.the.three.charges.against.Dr..Janzen.and.after.             that. being. a. half. page. memo. dated. July. 8,. 2004. while. the.
reviewing.the.evidence,.the.Discipline.Committee.concluded:                feedlot.owner.provided.hand.written.farm.treatment.records.
                                                                           beginning.in.November.2004..
1..Dr..Janzen.was.guilty.of.distributing.prescription.medications.
without. a. valid. veterinary/client/patient. relationship.. While.        3.. Dr.. Janzen. was. found. not. guilty. of. allowing. the. resale. of.
a. veterinary/client. relationship. was. established. when. the.           pharmaceutical.and.biological.products.to.the.general.public..
feedlot.owner.visited.the.practice’s.headquarters.in.Alberta.on.           The.evidence.did.not.support.a.contravention.of.Section.33.12.
November.20,.2003,.the.evidence.clearly.showed.prescription.               of. the. SVMA. Bylaws.. Evidence. given. by. the. feedlot. owner.
drugs.were.delivered.on.November.26,.2003,.well.in.advance.                indicated.he.was,.in.fact,.selling.prescription.drugs.without.the.
of.any.veterinarian.visiting.the.feedlot;.thus.the.practice.failed.        knowledge.of.Dr..Janzen.or.the.feedlot.practice...In.addition,.
to. establish. a. patient. or. herd. relationship.. .The. veterinarian.    the. volumes. of. prescription. drugs. sold. to. the. feedlot. by. the.
who.visited.the.feedlot.in.December.of.2003.and.was.not.a.                 feedlot.practice.were.not.large.and.not.suggestive.of.an.active.
