The following information in this packet is provided to help guide you
through the permit application process. This packet will also provide you
with information regarding approved fence heights, locations and
minimum construction requirements.

Fence Permit Guide:
This guide was developed to help direct you through the permit application process. Following the steps
below will help to expedite the issuance of your building permit.

1. Completely fill out the Attached Building Permit Application.
Provide a detailed description of all proposed work. Owners may obtain permits for construction projects
if the house is owner occupied. All contractors shall include their Dwelling Contractor Certification and
Dwelling Contractor Qualifier Certification numbers from the State of Wisconsin Safety and Buildings
Division. Our office is required by the State of Wisconsin to verify these certifications prior to issuing
permits to contractors performing work on one and two family dwellings.

2. Provide 2 Site Plans.                                               Sample Site Plan
The plans shall be drawn at 1 inch =
20 ft. or larger scale and shall include
the following (see the sample site
plan):

□ All streets, North arrow and
graphic scale.
□ Exterior boundaries of the property
including dimensions of property
lines.
□ Location of existing and proposed
structures.
□ Dimensions of setbacks from prop-
erty lines and between structures.
□ Location, dimension and purpose
(i.e. water, sewer, etc.) of all ease-
ments.

     NOTE: If you do not have a scaled site plan you may purchase one from the City Planning Services Division, Room

4. Permit Fees
Submit the applicable Permit Fees. Permit fees are based upon the “fair market value” of the project. This
value is to be provided on the building permit application and is required to include both material and labor
values even if no labor is being charged for your project. Typically if you do not have a labor value the
general rule of thumb is to double the material value for the job. The fair market value is required to provide
uniformity in applying Permit Fees to both citizens that hire a contractor and citizens who do their own
construction.

 * Fees must be paid by check or money order to the City of Oshkosh. Cash is only accepted if you are present when
                          the permit is being issued. The City of Oshkosh does not accept credit cards. *

5. Apply for the Permit
Please plan ahead and pick one of the following methods to apply for your permit. We suggest that you apply
for the permit a minimum of 2 weeks prior to your start date. Make sure all of the required information listed
above is included and submit it to the Inspection Services Division using one of the methods listed below:
In Person with an Inspector:
This is the best method to discuss the specifics of your project with an inspector. Typically if all the required
information is submitted, and the information is found acceptable, the permit can be issued at that time.
Inspectors are available for consultationn and Permit issuance 7:30am-4:30pm Monday through Friday.
By Fax:

Drop Off:
Completed applications may be dropped off at the Inspection Services Division anytime Monday through
Friday from 7:30am-4:30pm. The inspectors will review your submittal and contact you if further information
is required. If your submitted application is approved we will send the permit to you in the mail. No work
may commence until the permit is issued and the Building Placard is posted.
 This handout was developed by the City of Oshkosh Inspection Services Division as a basic plan submittal guide. It is not intended to cover all circumstances.
                                      Check with the Inspection Services Division for additional requirements that may
                                                               apply to your specific project.

*These two credentials are required by the State of Wisconsin Safety and Buildings Division for any contractors
conducting work on residential property.

*The value for both materials and labor is required to ensure consistency in assessing permit fees for all applicants

            Zoning Code Requirements

                                      Zoning Code Requirements:
Fences Located on a Corner Lot:
No fence or hedge more than 30% solid or more than 30
inches high from the established sidewalk elevation may
be located within the intersection sight distance triangle,
except for intersections controlled by four-way stop
signs.

In the case of 90 degree intersecting streets, the inter-
section sight distance triangle is the triangle formed by
connecting the following three points: the point of inter-
section of the property lines adjacent to the lot of the
intersecting streets, a point 20 ft. from said point of in-
tersection along one lot line, and a point 20 ft. from said
point of intersection along the other lot line. In the case
of all other intersecting streets, this triangle shall be as
defined by the Department of Community Development
after a review of the subject intersection has been com-
pleted.

Fences Located in The Front Yard:
Fences and hedges less than 4 ft. high may be located
within the required front yard, except fences that are
more than 50% solid shall not be permitted within 15 ft.
of a front lot line.

If a house is closer than 25 ft. to the front lot line, then
the 4 ft. fence height limitation applies only to the area
between the front plane of the house and the front prop-
erty lines.

Fences constructed within the 15 ft. setback (less than
50% solid) are required to be of uniform construction
throughout -- that is, solid materials shall be evenly dis-
tributed along the entire length of the 15 ft. setback area.

Fences Located in the Side or Rear Yard:
Fences 6 ft. high or less may be erected on those parts of a lot that are as far back or farther back from a
property line than the principal structure. Fences 6 ft. high or less may be installed on any part of the lot

that is at least 25 ft. from the front lot line. If a house is closer than 25 ft. to the front lot line, then a 6 ft.
high fence may be installed on any part of the lot that is as far back from the front lot line as the front of
the house.

Fences greater than 6 ft. in height may be erected if they meet the setback requirements of the principal
structure which are (25 ft. setback for the front/street and rear yard, and a 7.5 ft. setback for the side yards).

Fences 6 ft. in height may be constructed in the front yard on the long side of corner lots provided they
have a setback equal to that of the existing principal structure, or what would be required for new construc-
tion of a principal structure based on the lot dimensions, whichever is greater.

Fences Used for Kennels:

Any kennel that is unattached to the principal structure (house) must comply with the minimum rear and
side yard setbacks of 2.5 ft. NOTE: Unattached means that there is at least 5 ft. between the primary resi-
dence and the dog kennel.

Any kennel that is attached to the principal structure (house) must comply with the minimum rear and side
yard setbacks of the principal structure. The side yard setbacks for kennels that are attached to the princi-
pal structure are a minimum of 7.5 ft. The rear yard setback is a minimum of 25 ft.


                                             Things to Consider:
   The height of a fence shall be measured from the established grade.

   The building code does not establish minimum depth requirements for installing fence posts. A general
     rule of thumb is to place the posts into the ground a minimum of half the height of the fence. Please
     note that the minimum frost depth for this area is 48”.

   The City of Oshkosh does not require the “good side” of the fence to face neighboring properties.

   The City of Oshkosh does not provide surveying services for the location of property irons.

   Fences are allowed to be placed up to the property lines but in no case can the fencing extend over the
     property line. It is recommended that the fence be constructed off the lot line if maintenance will need
     to be done to the fencing without going onto the neighboring property.
