*** YORK TOWNSHIP PLANNING COMMISSION Tuesday, March 17, 2009 6:00 p.m. The regularly scheduled meeting of the York Township Planning Commission was called to order at 6:10 p.m. by Vice-Chair Denise Roe. Those in attendance were: Denise Roe, Vice-Chair James Norton, Secretary Timothy Salvatore, Member Jeff Sholly, Township Engineer MINUTES A correction was made to the first paragraph on page one to reflect the meeting was called to order by Chair Jodi Grove. A motion was made to approve the minutes of February 17, 2009, as corrected. MOTION MADE BY: Timothy Salvatore SECONDED BY: James Norton MOTION PASSED UNANIMOUSLY YORK TOWNSHIP ZONING ORDINANCE AMENDMENT With regard to the proposed ordinance to amend the York Township zoning ordinance to repeal the traditional neighborhood development overlay guidelines for a second time, I move that we recommend to the Board of Commissioners that the Board follow the advice of its counsel in enacting the amendment. 3 York Township Planning Commission Tuesday, March 17, 2009 Page 3 SUBDIVISIONS AND LAND DEVELOPMENTS P2008-12-2: Lebo Skin Care Final Reverse Subdivision Plan Present: Mark Deimler In regards to York Township File P2008-12-2, a Final Subdivision Plan for Lebo Skin Care Center on Powder Mill Road, I make a motion the plan be approved subject to the comments and conditions of the Township Engineer’s letter of March 13, 2009. In regards to the four waiver requests, which are for relief from the requirement for a hydrological report, traffic evaluation report, wetland report, and an erosion and sedimentation control application, I make a motion that all four of these be deferred to the land development stage. MOTION MADE BY: James Norton SECONDED BY: Timothy Salvatore MOTION PASSED UNANIMOUSLY LD2008-12-1: Lebo Skin Care Final Land Development Plan Present: Mark Deimler With regard to the Lebo Skin Care Center Final Land Development Plan, York Township File No. LD2008-12-1, I move that we recommend to the Board of Commissioners approval of the plan as presented subject to the resolution of the issues, conditions, and requirements set forth in the Township Engineer’s letter of March 13, 2009. With regard to the requested waivers for Section 609.3.B and 403.E.3.C, I move that we recommend approval of the waivers as requested. 4 York Township Planning Commission Tuesday, March 17, 2009 Page 4 LD2009-1-1: Dallastown Medical Assoc Final Land Development Present: Jim Barnes In regards to York Township File LD2009-1-1, Land Development Plan for Dallastown Medical Associates, 1010 Blymire Road, I make a motion the plan be approved subject to the comments and conditions in the Township Engineer’s letter of March 13, 2009. In regards to the waivers, waiver one, Section 609.A.3.B, requiring a 10foot separation between parking and the building, I make a motion that that be approved. Waiver number two for Section 609.A.3.B, in regards to parking lot landscaping, I make a motion that that be approved. Waiver number three, Section 603.B.1, requiring sidewalks, I make a motion that that be approved due to the fact that the nearest sidewalks are 2,000 feet away. Waiver number four for Section 404.B.1.A, connection to public sewer, I make a motion that that be approved but note that should the existing onsite system ever fail that connection to the public sewer will be required at that time. Waiver number five for Section 403.E.3.C, requesting relief from a wetland study, I make a motion that be approved, and would also note that waiver number six has been withdrawn by the applicant. 5 York Township Planning Commission Tuesday, March 17, 2009 Page 5 With regard to the Southfield Lot 4A Revised Final Subdivision Plan, York Township File No. P2009-2-1, I move that we recommend to the Board of Commissioners that approval of the Final Subdivision Plan only be granted if the Board deems the settlement agreement between the developer and York Township Water and Sewer Authority to be in the best interest of the township and the Final Revised Subdivision Plan to be in conformity with the settlement agreement.
