       REPORT OF HEAD OF ENVIRONMENTAL AND CONSUMER PROTECTION
                               SERVICES

      ON APPLICATION FOR A PREMISES LICENCE FOR THE PREMISES KNOWN
      AS PURDY’S, 28-30 STATION ROAD, POOLE BH14 8UB SITUATED WITHIN
                              PARKSTONE WARD.

1.0    Introduction
1.1    An application has been received for the granting of a Premises Licence for the
       premises known as Purdy’s, 28-30 Station Road, Poole. Following receipt of
       representations this matter is brought before the Licensing Committee for
       determination.
2.0    Background
2.1    The Licensing Act 2003 enables the Licensing Committee to consider the granting of
       licences where representations are received from responsible authorities or interested
       parties.
       The Licensing Act 2003 gives the Licensing Committee the power to grant the
       application, refuse the application, or prescribe terms, conditions and restrictions to the
       premises licence or club premises certificate. These conditions must relate to the four
       objectives of the Licensing Act 2003;
       1. prevention of crime and disorder
       2. public safety
       3. the prevention of public nuisance; and
       4. the protection of children from harm
2.2    Following the outcome of the committee hearing, all parties to the application have the
       right to appeal to the magistrates court within the period of 21 days beginning with the
       day on which the appellant was notified by the licensing authority of the decision
       appealed against.
3.0    Matter for consideration
3.1    Committee members are reminded that Purdy’s is located in Station Road situated
       within Parkstone ward. The premises is surrounded by commercial and residential
       premises.
       A location map is attached as Appendix A.
3.2    The proposed application is as follows:
             The proposed opening times are as follows;
              Monday to Saturday – 08:00 hours until 00:30 hours
              Sunday – 10:00 hours until 00:30 hours
              On New Years Eve from 08:00 hours until end of permitted hours on New Years
              Day each year.
      To permit films, indoors only, at the following times;
       Monday to Saturday - 08:00 hours until 24:00 hours
       Sunday – 10:00 hours until 24:00 hours
       On New Years Eve from 08:00 hours until 02:00 hours on New Years Day each
       year
      To permit live music, indoors only, at the following times;
       Monday to Sunday – 12:00 hours until 24:00hours
       On New Years Eve from 10:00 hours until 02:00 hours on New Years Day each
       year
      To permit recorded music, indoors only, at the following times;
       Monday to Sunday – 10:00 hours until 24:00 hours
       On New Years Eve from 10:00 hours until 02:00 hours on New Years Day each
       year
      To provide entertainment of a similar description, indoors only, at the following
       times;
       Monday to Sunday - 12:00 hours until 24:00 hours
       On New Years Eve from 12:00 noon until 02:00 hours on New Years Day each
       year
      To provide facilities for making music, indoors only, at the following times;
       Monday to Saturday - 08:00 hours until 24:00 hours
       Sunday – 10:00 hours until 24:00 hours
       On New Years Eve from 08:00 hours until 02:00 hours on New Years Day each
       year
      To provide late night refreshment, indoors only, at the following times;
       Monday to Sunday – 23:00 hours until 24:00 hours
       On New Years Eve from 23:00 hours until 02:30 hours on New Years Day each
       year
      To supply alcohol, on and off the premises, at the following times;
       Monday to Sunday – 10:00 hours until 24:00hours
       On New Years Eve from 10:00 hours until end of permitted hours on New Years
       Day each year
The applicant has identified a number of steps in order to promote the licensing
objectives associated with the representations, namely the prevention of crime and
disorder and the prevention of public nuisance and these are:
A proof of age scheme will be operated on the premises.
A closed circuit television system will be installed at the premises with cameras both
inside and outside the premises.
The applicant will undertake to implement any additional measures that are agreed in
writing from time to time between the Police and the applicant and subsequently
notified to the Licensing Authority.
Whenever music (save background music) is played in the premises the entrance
doors at the premises shall be kept closed save for access and egress.
       As the music will generally be background music it is not considered that any further
       measures are necessary at this time. However, the applicant will implement any
       measures agreed between the applicant and the Environmental Health Officer and
       subsequently notified to the Licensing Authority.
       Glass bottles will only be emptied into bins external to the premises between the hours
       of 08:00 and 19:00 each day.
       The application is attached as Appendix B.
3.3    Consultation has been carried out in accordance with the Licensing Act 2003. The
       application has been advertised in the form of a premises notice and a newspaper
       advertisement and the relevant responsible authorities have been consulted with.
3.4    Representations have been received from the Police regarding the potential for crime
       and disorder and from Environmental Health regarding the prevention of public
       nuisance.
       The representations are attached as Appendix C.
3.5    4 letters of representation have been received from interested parties. The
       representations refer to:
             Noise from the premises
             Noise from customers outside the premises.
       The representations are attached as Appendix D.
4.0    Conclusion
4.1    The Committee members are asked to consider the application, representations and
       the evidence that is given before them and to make their decision. The Committee
       members must bear in mind when making their decision the Borough of Poole
       licensing policy, the guidance as set out by the Secretary of State, and the licensing
       objectives as set out in the Licensing Act 2003, the most relevant of which here is the
       prevention of public nuisance and prevention of crime and disorder.
5.0    Recommendations
5.1    The Committee is recommended to have notice of the representations made and
       determine whether or not the Premises Licence should be refused, granted or granted
       with prescribed terms or conditions.
