This rental agreement between Guest (named below) and William and Teresa Carter (“Owners”) is for use of the vacation home and/or float house located at 8169 Bridger Trail Road, Harrison, Idaho, for the dates specified herein.

By renting this property the Guest agrees to the following terms and conditions: 1. Reservations: The property is reserved upon receipt of a reservation payment in the amount of ½ the total due and the signed Vacation Home Rental Agreement. No reservations will be confirmed or guaranteed until such receipt. The balance of the total due must be paid at least two weeks prior to occupancy. Cleaning deposit: A cleaning deposit of $75 will be retained until Owners’ verification that the vacation home was left in reasonably clean condition. If unusual cleaning is necessary, a charge will be deducted from the cleaning deposit. If necessary to return the vacation home to its condition previous to this rental period, an additional charge will be deducted from the security deposit. Kitchen must be left in the clean condition it was found. It is your responsibility to wash all dishes prior to departure and to unload clean dishes from the dishwasher. Any garbage in excess of trash cans provided must be taken to the dumpsters at the intersection of Hwy 97 and I-90 (just north and east of the freeway on Hwy 97) upon your departure. 3. Security deposit: The Guest is responsible for the care of the premises, appliances and furnishings and for any and all damage by negligent or wrongful acts caused by the Guest or invitees of the Guest. Guest agrees that Owners may deduct charges for any damages from the security deposit. Security deposit will be refunded upon inspection and cleaning of the property no later than one week from date of departure, unless a claim for damages is made, in which case Guest will be advised of such by registered mail. 4. Cancellation policy: The reservation payment is refundable, less a $100.00 cancellation fee, if cancelled 60 days prior to Guest’s scheduled arrival. No refunds are given if cancellation is received less than 60 days prior to arrival date, unless Owners are reasonably able to rent the home to another party for the dates and price confirmed to Guest. If the home is re-rented, reservation payments less a $100.00 cancellation fee will be returned to Guest. Owners are not responsible for conditions not under their power to control, including but not

limited to inclement weather, road access limitations due to weather, and air quality. No refunds will be granted for those conditions not under the Owners’ power to control. If conditions exist that could render the rental property unsuitable for occupancy, such as damage to the property, or facilities in non-working condition, refund will be limited to any reservation payments and prepaid rents already received. 5. Accommodations and Furnishings: Kitchen is stocked with basic cookware and dinnerware. A few spices or other staples may be available (confirm with owner). Bed linens, pillows, bathroom paper products and bath towels are provided. Occupancy: Guest agrees that the vacation home is to be used by the agreed-upon number of persons. Inclusion of additional persons beyond the specified maximum could result in extra charges and could, at the Owners’ discretion, result in early termination of your rental period without refund of rental fees paid. Pets: Owners do not allow Pets without prior written permission. Smoking: Smoking is not permitted anywhere on the property. Safety: Guest is solely responsible for personal and property safety for themselves and their guests. Guest shall use the rental property in a safe manner and shall require its guests to do the same. Children shall be monitored at all times during the rental period. Please make sure that an adult always accompanies children while near the water and dock. Adults should also watch children closely near the hillside and on the path and stairs that lead to the water. The hillside is steep and the path may contain natural trip hazards or may be slippery. No running on the path, stairs or dock, please. Children must wear lifejackets at all times when they are near the water. Please be aware that swimming is at your own risk, so it is up to you to make sure everyone swims safely. Please feel free to enjoy a small campfire down by the water’s edge, but make certain that the fire has no contact with hillside vegetation, is never left unattended, and is extinguished completely before leaving. If conditions are dry, no fires are allowed. Check with to determine whether there are burn bans in effect. 10. Keys: A house key(s) will be provided before or upon arrival. There will be a $10.00 fee for any keys not returned. There will be a $75.00 fee for providing entry to guests who lock themselves out of the vacation home. 11. Liability and damage: Guest shall indemnify and hold Owners free and harmless from any and all liability, claims loss, damage or expenses arising by reason of any injury, death or property damage sustained by any person including Guest or any agent or invitee of Guest where such injury, death or property damage is caused by a negligent or intentional act of Guest or any invitee of Guest. 12. Repairs and Service Calls: Please notify Owners immediately if damages are noticed or a repair is in order. All efforts will be made to expedite needed repairs, but no refunds will be made for mechanical failures of appliances/electronics, interruption/loss of utilities. Authorized repairpersons have the legal right to enter the property as required to accomplish needed repairs even if the service call was made prior to Guest’s arrival. 13. Personal Items Left Behind: Items left by Guest upon departure are not the responsibility of Owners. If items are discovered, they will be returned if Guest requests so, understanding that Guest will pay all shipping costs and liability associated with the return of the items. 14. Noise/nuisance: Guest shall not disturb neighbors with loud noise or music, or unlawful, unsafe or pollution-causing behavior. Guest must be reasonable in his/her use of the property so that all guests may enjoy their stay. Guest and all invitees of Guest must conduct themselves in a manner not offensive to other tenants or to neighbors. Please respect “quiet hours” of 10pm to 8am toward that aim.

Owners reserve the right to evict any guests whose actions disrupt neighbors or other tenants’ enjoyment, at the Owners’ discretion, without refund of any rental fees or security deposits paid. 15. Illegal use: Use of firearms, illegal controlled substances or other illegal activities is not allowed on the rental property. 16. Neighbors and other tenants on property: Guest understands that this rental home shares a dock, waterfront area, parking area and path access with a second rental home on the same property address. This second rental home is not available for use by Guest, and may be rented by another tenant at the same time Guest is on the premises. 17. Boat Dock: The boat dock is for the enjoyment of Guest and other tenants only. No watercrafts other than those pre-arranged with Owners will be allowed to use the dock. 18. Property security: The vacation home must be locked and secured when unoccupied. Guest shall reimburse Owners for theft of Owners’ items resulting from Guest’s failure to keep the property secured. 19. Parking: Parking is limited to two vehicles unless prearranged in writing with Owners. No motor homes, campers or tents are allowed on the rental property unless prearranged in writing with Owners. 20. Owner right of entry: Owners or their agent shall have the right to enter the property at reasonable hours for the purpose of making repairs or inspections, or to investigate complaints from or regarding Guest. 21. Default by Guest: This agreement imposes an obligation of good faith in its performance and enforcement. Guest understands that upon violation of any conditions, agreements, restrictions, covenants, and obligations of this Vacation Home Rental Agreement, Owners may terminate this Vacation Home Rental Agreement and enter the property by force or by statutory proceedings, in which case any and all monies paid by the Guest to Owners will be forfeited by Guest as liquidated damages in addition to, but not in lieu of, any other right or remedy available under law. 22. Assignment: This agreement to rent the vacation home is not assignable or transferable by the Guest without written consent from Owners.
