Musician’s Work For Hire Agreement DATED: _________________, 2009 Dear ______________________, This will confirm the agreement between you and the musical band _____________ (“Band”) with regard to your services as a musician in connection with the creation of the master sound recording currently entitled “_________________________” (“the Master”). For good and valuable consideration of $_________ per day, with the first day’s payment due and payable upon execution of this Agreement, as well as credit in conformity with industry standards, you agree to the following: 1. You agree that from the inception of the recording of the Master, Band shall own the entire worldwide right, title and interest, including, without limitation, the copyright in and to the Master, and the performances embodied therein and the results and proceeds of your services hereunder, all so-called moral rights therein, as Band’s “work-for-hire” for all purposes of the applicable copyright laws, free of any claims by you or any person, firm or corporation. Alternatively, you grant to Band the entire worldwide right, title and interest derived from you, including, without limitation, the copyright, in and to the Master. 2. You further agree that Band and/or its designees shall have the exclusive right to manufacture, sell, distribute, and advertise phonograph records or other reproductions (visual or nonvisual) embodying the Master under any trademarks, tradenames, or labels, to perform such phonograph records or other reproductions publicly, and to permit the public performance thereof by radio or television broadcast, or any other medium now known or hereinafter devised, all upon such terms and conditions as Band may approve, and to permit any other person, firm, or corporation to do any or all of the foregoing, or Band may refrain from doing any and all of the foregoing. 3. You further agree that Band shall have the right, without limitation, to use your name, voice, and likeness in connection with the exploitation of the Master including, but not limited to, any other reproduction (visual or nonvisual) embodying the Master.
