6th SENIOR OFFICIALS MEETING ON TRANSNATIONAL CRIME (SOMTC) DENPASAR-BALI, 5-10 JUNE 2006 Background ASEAN (SOMTC) is Senior a Official Meeting forum on of Transnational ASEAN Crime in cooperation countries eradicating transnational crimes. Page 1 of 32 The 6th SOMTC Meeting is now combined in series with the SOMTC+1 meeting, namely +China, +Japan, + South Korea and +Australia and SOMTC+3 namely +China, Japan and South Korea. Before commencement of SOMTC agenda, Workshop and Working Group activities were conducted first on 5th-6th June 2006, namely: 1. Workshop on Collection of Data and Statistics on trafficking in persons and, before conclusion of the 6th SOMTC, book launching took place relating to data of trafficking in persons 2. 3. 4. Working Group on Counter Terrorism. Working Group on Trafficking In Persons. Working group on Finalization of SOMTC+3 Work Program Workshop on Collection of Data and Statistics on trafficking in persons Pre SOMTC was begun with Workshop on Collection of Data and Statistics on trafficking in persons on 5th June 2006. The Workshop was opened by Chief of CID of INP as the chairman of SOMTC Indonesia. Twelve recommendations were generated in this workshop, namely: a. The destination country shall inform immediately the Embassy or Consulate of the originating/dispatching country in order to take actions against any alleged violence, offenders and victims in accordance with the international mechanism. Page 2 of 32 b. Conducting prosecutors training and to law in enforcers, order to police, improve judges sensitivity to violation issues against women and children. c. Criminalizing all forms of sexual exploitation including trafficking in persons in accordance with ASEAN Declaration on Fighting against Trafficking in Persons particularly against Women and Children and UN Convention including its Protocols on Fighting against Organized Crimes. d. Providing protection to witnesses and victims of trafficking in persons through effective steps in order to facilitate access and to repatriation, relocation rehabilitation camps, legal and processes, assistance health, psychological, social economic assistances, and possibility of receiving compensation on the losses suffered. e. Facilitating cooperation on exchange of information and intelligent, Mutual Legal Assistance in Criminal Matters, legislation development, investigation assistance and signing of bilateral and multilateral arrangements in accordance with their respective national Legislation. f. Defining definition and parameters of “trafficking in persons” with reference to the Palermo Protocol that can be used as Regional Standard for data gathering at national level. Page 3 of 32 g. Establishing cooperation with other regional processes, such as Bali Process, Inter-Governments Asia Pacific Consultation (APC) concerning refugees, migrants and derelict people, Budapest Process, and Coordinated Trafficking Mekong Ministerial Initiatives against in order to increase ASEAN (COMMIT), efforts in abolishing trafficking in persons. h. Forming a qualitative and quantitative data gathering mechanism in order to prevent trafficking in persons, particularly women and children and to prevent them from becoming victim again. i. Improving coordination and cooperation on data gathering in regional level by establishing focal points of data gathering on trafficking. The focal points also serve as contact persons in projects related to trafficking in the framework of improving the data gathering. j. Developing contains data gathering in ASEAN format or pattern with that the of information need of accordance in the operational framework combating the trafficking in persons. k. Improving more practical and sustainable cooperation with ASEAN dialogue partners, such as Training of Trainers supply (TOT), of construction of relocation camps, technical assistance, intelligent Page 4 of 32 cooperation, establishment of hotline, identifying root causes and formulating action plans. l. Working Group on Counter Terrorism Working Group on Counter Terrorism was implemented on 6th June 2006. Brigjen Pol Drs. Bekto Suprapto, Kadensus 88 AntiTeror Bareskrim Polri, was appointed as Chairman of Working Group Meeting. In this working group, the ASEAN Secretariat described three concept papers, namely: 1. Concept paper of Japan concerning the ASEAN-Japan Dialogue on Counter-Terrorism, the dialogue of which was recommended to be conducted on 27th - 28th June 2006. The dialogue activity has been decided in the ASEAN SOM meeting in Karambunai, Malaysia 16th May 2006. 2. Concept paper concerning the project proposal ASEAN Comprehensive Plan of Action on Counter-Terrorism. ASEAN member countries agree to submit inputs and responses to such a proposal not later than on June 2006. 3. Concept Roundtable paper Plan concerning of the Working of Level and Organization Security Page 5 of 32 Cooperation in Europe (OSCE). The ASEAN was invited to participate in such a meeting. The working group also discussed Working Draft on the ASEAN Convention on Counter-Terrorism as mandated by the 5th AMMTC and ASEAN SOM. Upon instigation of issue on legal power of the Working Draft, it was recommended to establish a “Joint Expert Working Group” consisting of representatives of SOMTC, SOM, and ASLOM in order to discuss and formulate development of guidelines and term of reference of the ASEAN Convention. Indonesia was asked to follow-up such a recommendation and the meeting will expectably be realized in 2006. Indonesian delegate presented three project proposals on combating terrorism, namely: ASEAN Workshop on Anti-Terror Units, Promotion of the Role of the Media in Anti-Terrorism Knowledge Awareness and Workshop on Bio-Terrorism. The ASEAN Workshop on Anti-Terror Units will be proposed to the SOMTC +China meeting will for be funding, endeavored whereas for its other funding two project other proposals from dialogue partners and ASEAN member countries are requested to give responses and inputs to the two project proposals at the latest at the end of June 2006. Ad-Hoc Working Group on Trafficking In Persons On the same day, 6th June 2006, Working Group on Trafficking In Persons was conducted. Mr. Melchor P. Rosales, Under Secretary for Peace and Order and Transnational Crime of Page 6 of 32 the Philippines, was appointed as the Chairman of Ad-hoc Working Group on Combating Trafficking in Persons. The Ad-Hoc Working group consulted with European Union (EU) and also presented AUSAID presentation on ARCPPT project. In consultation with the EU, it was presented that the EU has developed a number of programs, such as, prevention of trafficking permit, in persons, compensation and to the on victims, causes stay of border supervision study root trafficking in persons. Ms. Anne Gallagher, the Team Leader of ARCPPT Project, presented seven key elements of effective Judicial System in combating capacity trafficking building, in persons, namely: legal framework, quick and training, specialize justice, accurate data, establishment of communication procedures, and the cooperation in border management. The ARCPPT agreed with the Indonesian plan to hold Seminar and Training on handling of trafficking in persons for the related law enforcers in ASEAN region. The Ad-Hoc working group approved the establishment of ASEAN Ad hoc Inter-agency Working Group in order to formulate Regional Work in Plan to implement ASEAN Declaration Women and against Trafficking Persons particularly Children. Philippines was asked to prepare concept paper. Working Group on Finalization of Work Program of SOMTC+3 (SOMTC+China, Japan and South Korea) Page 7 of 32 In the Working Group on Finalization of Work Program of SOMTC+3 that was conducted on 6th June 2006, the ASEAN Secretariat as Working Group Chairman pointed out that the revision on Work Programme to Implement ASEAN Plan of Action to Combat Transnational Crime is the agreed result of the 5th AMMTC meeting in Hanoi, the Vietnam, in November timing 2005. and The participants discussed activities, funding sources expected from the SOMTC+3 dialogue partner countries. In this meeting, Indonesia submitted a proposal on cooperation in combating trafficking in fauna and flora, but no agreement was reached among the participants because such a crime is beyond the SOMTC scope. This Working Group ratified the Work Plan ASEAN+3 in combating transnational crimes 2006-2007. Some Action Plans on respective important issues are, among others: 1. Security Training on VIP (Plan 2007) Workshop on improvement of cooperation and coordination in law enforcement and exchange of intelligent 2007). i. The 6th SOMTC economic 2006, The 6th SOMTC was held on 7th-8th June 2006 in Denpasar, Bali, that was opened officially by the Deputy Chief of INP Comm. General of Pol. Drs. Adang Daradjatun. In his message, the Deputy Chief of INP representing the Chief of INP presented a keynote speech that essentially invites all of ASEAN member countries to increase cooperation in eradicating transnational crimes. Corruption, illegal logging, illegal fishing, illegal mining and illegal trafficking in fauna and flora are issues that require more serious attention in ASEAN region because these crimes seem significant. The elected Meeting Chairman for the 6th SOMTC was Comm. General of Pol. R. Makbul Padmanagara, Chief of CID of INP, whilst Pol. Col. Sinthavong Sayakone, the Permanent Secretary of Ministry of Public Security, Lao PDR as its Vice Chairman. In the first day of meeting, each of the Head of delegation presented their brief description, essentially as follows: 1. Brunei Darussalam Brunei January Darussalam 2006. In combating drug crime, Brunei Darussalam has established Task Forces, namely: Task Force 1 – Civic Awareness, Task Force 11 – Demand Reduction and Task Force 111 – Enforcement. In addition, Brunei has also had a new Law concerning trafficking in persons, in which the punishment to the offender of this crime is a fine of maximum $1,000,000 and 30 years imprisonment and whipping sentence. Brunei will replace the old system of passport making with biometric system. 2. Cambodia In 2005, Cambodia has succeeded in revealing drug smuggling through postal services, sport equipment and food containers to disguise the drug. From 74 ATS abuse cases young (ecstasy, people, Amphetamine, 2053 Meth-amphetamine) have been by the offenders arrested consisting of 42 women and 2011 men. 1365 of them have been 5176 sent drug to care and rehabilitation centers. Totally users have been arrested, 177 of them are women. Throughout revealed 2005, with 363 ATS cases have been successfully evidences of 381,931 Meth-amphetamine tablets, 5123 kg amphetamine and 1931 ecstasy, 8762 kg heroin, 2,10 kg opium alkaloid, and 103,109 kg dried marijuana. 3. From the investigation, it was revealed that explosives and arms owned by the offender network are used to disturb the community security. Illegal trafficking in arms is also conducted by terrorists, they smuggle weapons and various explosives in large quantity from south Philippines and Malaysia Tawau, through General Palu. Santos, A Tawi-tawi, of other Sandakan, involved Nunukan and number groups use the smuggled arms in conflict areas. These are revealed from the investigation and examination that has been conducted jointly with related authorities of the bordering Thailand. A number of operations that were performed by Special Detachment 88 Anti Teror succeeded in raiding the hiding place of Dr Azahri and Noordin M. Top. On 9th November 2005, the Special Detachment 88 Anti Teror raided the hiding places of Dr Azahari in Batu City East Java. In that raid, Dr Azahari was shot death. On 28th April 2006, again, the Special Detachment 88 Anti Teror reached a brilliant achievement when raiding the hiding place of Noordin M. Top in Wonosobo Central Java. In such a raid two terrorists were killed and other two were arrested. Based on examination, it was revealed that their group has planned attacks to D8 Summit in Nusa Dua, Bali as well as the memorial ceremony of Waisyak day in Borobudur Page 15 of 32 countries, namely, Malaysia, Philippines and Temple. Number of financial transaction reports made by financial institutions has increased rapidly, thus until May 2006 over 1.7 millions transaction reports have been recorded. When and the Indonesian Center Transaction Reports Analysist (INTRAC) and financial authority conducted socialization, financial institutions started to improve their awareness in their responsibility. Until nowadays, there are more than 400 cases recommended by the INTRAC to be followedup by INP and the Attorney General Office. From these cases, litigation banking for fraud, various indictments, namely and terrorism, corruption, embezzlement money laundering, have been filed. Laos Laos is very serious in fighting against drug crimes, particularly opium. Since 1989, with assistance of UNODC, WFP, USA, China, Luxembourg, GTZ, EU, IFAD, NCA, NORAD, JICA, CIDSE, Consortium, ADB, World Bank, etc., Laos has Page 16 of 32 implemented 35 opium eradication projects in 10 northern provinces. Laos officially eliminated opium planting on 14th February 2006. In handling narcotic addiction victims, the Government of Laos has established care and rehabilitation centers by using normal and traditional medicines in Oudomxay, Vientiane Capital, Savanhnakhet and Champasack provinces. 5. Malaysia Malaysia has amended its Civil Code (KUHP) in order to criminalize terrorism activities, terrorism funding and hostage-taking. Amendment was also made to jurisdiction expansion so that able of covering the offenders who perform their action outside Malaysia. Singapore In countering transnational crimes particularly terrorism, the institutions involved are Singapore Police Force, Central Narcotics Bureau, Immigration and Checkpoints Authority and Internal Security Department. Singapore ha signed 7 of 13 UN conventions and its protocol concerning terrorism eradication. In March 2006, a Workshop Regional Bio-terrorism has been held together with ICPO-Interpol. In March 2006, Singapore amended Drug Abuse Law in order to give more hard legal sanction to the offenders. Synthetic narcotic of ketamine type was upgraded from class B to class A, so that ketamine is at the same level with ecstasy and methamphetamine. Thailand In “the High-Level Plenary Meeting of the UN General Assembly” 14th – 16th August 2005, Thailand signed the International Convention for the Suppression of Acts of Nuclear Terrorism 2005, that will be ratified in next to no time. Thailand also signed an MOU with USA in March 2004 concerning Personal Identification Secure Comparison and Evaluation System (PISCES) to trace people movement through borders. On 16th – 18th February 2005 Thailand convened the third meeting of Working Group Dialogue Thailand - Israel in order to increase cooperation and information exchange through Israel’s Emergency & Crisis Management Centre. In combating drug crimes, Thailand together with China, Myanmar, Lao PDR, and Hong Kong SAR revealed drug syndicate Han Yong Wan during January – November 2005. In such a period, 70 offenders have been arrested in China, Myanmar, and Lao PDR, with evidences 726 kg heroin. Until April 2006, AMLO (Anti Money Laundering Office) has signed MOU with 24 countries, namely Belgium, Brazil, Page 22 of 32 Lebanon, Indonesia, Romania, United Kingdom, Finland, Republic of Korea, Australia, Portugal, Andorra, Estonia, Philippines, Monaco, Poland, Mauritius, Bulgaria, Netherlands, St.Vincent Georgia, and the Malaysia, Grenadines, Ukraine, Myanmar, and Nigeria. 10. Vietnam Compared with those of 2004, in 2005, the drug decreased in cases but increased (-2.45%); in types in which there arrested were (- 11,772 cases 17,700 offenders 2.53%); confiscated 287 kg heroin (+ 19.8%), 59 kg Opium (0.04 kg), 210.000 tablets (+ 43.20%) and 1.46 kg synthetic narcotics (+ 35.5%), 5,894 ampoule psychotropic substances (+ 6.6%), 3,368 kg cannabis (+ 98%). Vietnam fully supports the cooperation in combating terrorism. Until nowadays, Vietnam has signed 8 of 12 UN Conventions and its protocols on combating of terrorism. Whereas other 4 conventions are still under study for handling. In 2005, Vietnam investigated 11,134 economic crime cases (40% higher than in 2004), in which 1,051 cases are IPR violations, and 10,083 smuggling cases and fraud and abuse of documents. The 6th meeting of SOMTC has ratified the results of activity conducted on 5th – 6th June 2006, namely: Page 23 of 32  Workshop on Collection of Data and Statistics on trafficking in persons and book launching relating to data of trafficking in persons.    Working Group on counter terrorism. Working Group on trafficking in persons. Working program As to the Projects or Activities that have been approved to be implemented are: a. ASEAN-Denmark Cooperation on Combating Transnational Crime (done) b. c. ASEAN-US Project on Counter-Terrorism (done) ASEAN-US Pilot Project on the Improved Collection of Data and Statistics on Trafficking in Persons (done) d. e. SOMTC Workshop on Small Arms Control (still ongoing) Basic Training Course on Investigation in Anti-Drug Money Laundering for ASEAN Law Enforcement Officers: 2nd Course (still ongoing) f. Asia Regional Trafficking in Persons Projects (still ongoing) g. ASEAN-US Workshop on Maritime Domain Awareness (will be implemented) group on finalization of SOMTC+3 working Page 24 of 32 h. ASEAN-EU Project on Border Management and Document Security under Regional Indicative Programs (RIP) 2005-2006 (will be implemented) In this 6th SOMTC, Indonesia has presented: 1. Description of corruption combating and proposed that corruptions are incorporated into the transnational crime issues and brought forward to the AMMTC meeting in Brunei Darussalam 2007. Other delegates responded that corruption issues are not necessary to be brought forward to the AMMTC, but to be discussed again in the 7th SOMTC in Laos. In order to prepare such a proposal, Indonesia was asked to hold a meeting of experts in order to probe possibility that corruptions is to be discussed in the next SOMTC. 2. Concept paper, by which the ASEAN Secretariat will seek dialogue partners for its funding, includes: a. b. ASEAN Workshop on Anti-Terror Units Promotion of the Role of the Media in Anti-Terrorism Knowledge Awareness c. d. e. f. 3. Workshop on Bio-Terrorism Workshop Control Delivery of Narcotic Training on CETS Training on Cyber Crime investigation Proposal that illegal trafficking in wildlife (fauna and flora) to be discussed and possibility to be incorporated Page 25 of 32 in the transnational crime issue was responded by the meeting attendants that such a crime should not be included in the transnational crime issues that has been agreed by both the ASEAN SOMTC and the AMMTC. In addition, there has been a forum of ASEAN Ministerial Meeting on Forestry and Agriculture and ASEAN WEN that specifically deal with such an issue. Whereas 4 (four) forums outside ASEAN that presented description in the 6th SOMTC are as follows: 1. CARDNO ACIL from ARCPPT presented Asia Regional Trafficking in Persons Project that will be started in August 2006. The four ASEAN countries to be involved are Thailand, Cambodia, Myanmar and Laos. Indonesia proposed to be involved in that project. 2. ICPO-Interpol Efforts in described presentation Transnational on Interpol’s Crime. Suppressing Organized ICPO-Interpol will discuss further the cooperation with ASEAN. 3. Microsoft described their participation in combating sexual crime against children. Microsoft projects to be implemented include: Capacity building including internet investigation and computer forensics, Technology tools and technical support: Child Exploitation Tracking System (CETS) that was developed together with Canadian Police Page 26 of 32 (RCMP) and Toronto Police, and Economic Opportunity for vulnerable populations and victims. 4. International Committee of the Red Cross (ICRC) described their participation areas that in dealing with the to victims Human in conflict are vulnerable Right violations and exploitation in transnational crimes. The ICRC has conducted some trainings in Malaysia, Indonesia and Philippines covering: Capacity building of police and training institutions, Pre-deployment briefings Roundtable discussions or Assessment workshops As to the results of SOM Leaders Retreat are as follows: 1. Regarding with the Agreement on Information Exchange and Establishment of Communication Procedures. The meeting agreed the importance to increase cooperation among the ASEAN countries in procedures for information exchange. Such an Agreement, that has been signed by Indonesia, Philippines and Malaysia in 2002 and has been accessed by Thailand, Cambodia and Brunei Darussalam, can be made a model in the framework of information exchange. 2. ASEC has presented the importance to conduct streamlining and make effectiveness of ASEAN meetings, including the role that of the SOMTC Chairman. ASEAN Secretariat pointed out SOMTC but Chairperson also should not merely lead in meetings could represent the SOMTC ASEAN various activities that involve SOMTC. To this relation, Page 27 of 32 the meeting recorded reports of the ASEAN Secretariat concerning ASC resolution assigning the ASEAN Secretary General to prepare guidelines for ASEAN Chairmanship. SOMTC + Australia In the SOMTC+Australia consultative meeting, agreements have been reached, as follows: 1. Australia Commitment to assist the ASEAN countries in combating terrorism. For that purpose, Australia offered a new package of funding amounting to to AS$ 100 in the framework particularly cooperation that overcome to border terrorism, management, those relate training, and improvement of system/infrastructures such as computerization in assisting with overcoming terrorism issues. 2. Japan has agreed such a proposal and asked Indonesia to submit concept paper concerning the activity in question. The meeting also noted the plan to held ASEAN-Japan Counter Terrorism Dialogue in Japan Page 30 of 32 on 27th – 29th June 2006 and 3-4 participants from related authorities of each country will be invited. 3. During the meeting break, bilateral meeting of Delri (Foreign Affair Ministry and Water Police Unit) has been conducted, discussing realization of assistance for procurement of three patrol boats by Japan, their hopes for cooperation on PSI, and status of Regional Cooperation on Combating Sea Piracy and Armed Robbery at Sea. In the field of illicit drug trafficking, Korea has established cooperation with Laos and Vietnam. 2. The government of Korea agreed to finance the cooperation project for combating narcotics in the amount of US$ 1 million until 2009. This Project is targeted to narcotic unit of the police of ASEAN member countries. 4. The meeting also discussed the progress of ASEAN and Korea cooperation not only in the field of illicit drug trafficking and cyber crime but also expected in other sectors. In this relation, Korea was expected to prepare a Work Plan on ASEAN and Korea cooperation in combating transnational crimes. SOMTC + 3 (China, Japan and South Korea) ASEAN+3 Consultative Meeting was held on 9th June 2006. The subjects of discussion in the ASEAN+3 consultative meeting are as follows: 1. The meeting has ratified the ASEAN Plus Three Work Plan to Combat Transnational Crime that specifies activities to be implemented by ASEAN and Plus Three in the field of cross-border crime for years 2006-2007. 2. In that meeting, Indonesia submitted proposal on the importance to develop cooperation that involves ASEAN and three countries jointly. In this relation, Indonesia proposed activities on bio-terrorism under the auspice of work plan on transnational crime cooperation. Page 32 of 32
