As I read the 12th Amendment, it wouldn't be Biden. IF Obama wins, and his electors are disqualified in Congress on 1/6/2009, and no other candidate has any electors, the choice for the House of Representatives would be McCain, and only McCain.
But they needn't choose. ýMcCain needs a majority of the state delegations, with 2/3 of them being a quorum. ýIf Democrats controlled 17 state delegations, those delegations could just absent themselves, forcing the vote to the Senate (for VP).
And Biden still wouldn't be President.
Why not? On January 3, we are supposing that the Congress invalidates all electoral votes for Obama. McCain doesn't have a majority, so the issue would go to the House, which is set to vote by state delegation. Only McCain is on the list, so 17 state delegations controlled by Democrats absent themselves and the House has no quorum. The Senate then votes for the Vice President, choosing between Biden and Palin. I think we can assume that the Democrats would have a majority in the Senate, so they elevate Biden. On January 20, he would be the sitting Vice President, and there would be a vacancy in the office of the President. Biden would then become President. What am I missing?
