RULES AND REGULATIONS

These Rules and Regulations may be amended by a vote of the Board. They supplement the recorded Covenants, Conditions and Restrictions (“CC&R(s)”). 1.0 1.1 FINES The first violation of a Rule, Regulation, By-Law, or CC&R will result in a fine up to $100.00 when the Board votes to impose a fine following the hearing process with the owner. Second and subsequent fines for the same offense will be $100.00 - $300.00. Unresolved violations may result in the loss of common-area privileges and voting rights. The cost of corrective action, liens or legal services may also be charged to the voting owner. ENFORCEMENT All Association members will be allowed two (2) written warnings for a particular violation within 12 months prior to enforcement action being taken against them, unless otherwise described below. Upon the third written warning, a fine will be levied against the Owner per the hearing process. The matter may also be turned over to the Association’s legal counsel for enforcement action. Observed violations of Rules, Regulations, By-Laws or CC&Rs should be reported in writing to the Board of Directors in care of the property manager, which will then take the appropriate action. Owners are responsible for their tenant or lessee’s compliance with Rules, Regulations, By-Laws and CC&Rs. Compliance fines or legal action that are a result of tenant or lessee actions are the responsibility of the Owner. REMEDIES If the warnings enumerated in Section 2.0 do not remedy a violation, a hearing may be called and/or the matter may be referred to the Association’s legal counsel for action. Related legal fees will be charged to the owner. Owners are responsible to attend a hearing with the Board of Directors that is a result of their tenant or lessee’s violations. The panel will hear both sides of the reported violation and make a recommendation to the Board of Directors. Failure of the Owner and occupant to appear at the hearing shall not impede the obligation of the Board of Directors to exercise compliance fines or legal action against the Owner. In accordance with California Civil Code 1363, the Board of Directors shall make reasonable effort to deliver to the Owner violation notices and notices of a scheduled hearing. A notice of a hearing shall be delivered by first class or certified mail to the Owner’s current address. In the event that the Owner cannot be located, the Board of Directors shall exercise the right to pursue compliance fines or legal action against the Owner. All hearings and notices will be given in accordance with the California State Law and the ByLaws of the Association (Article 11).

PARKING AND AUTOS (Vehicles are defined in Section 16 of Article XI of the CC&Rs) “TEMPORARY PARKING” (located in the front of the building) which does not interfere with the other owners/tenants will be permitted for delivery trucks, service vehicles, and the parking of occupant vehicles for loading and unloading purposes only as long as the vehicle is attended. Temporary Parking is restricted to twenty minutes unless expressly permitted by the on-site property manager or Board of Directors. 4.1.1 “Temporary Parking” hours are as follows: Monday – Sunday -- 9:00 AM – 9:00 PM “Visitor Parking” hours are as follows: Monday – Sunday -- 9:00 PM – 9:00 AM “Visitor Parking” will be on a first-come first-serve basis

“VISITOR PARKING”. Parking hours in front of the building between 9:00 PM – 9:00 AM are for visitors and guests only. All owners and occupants are prohibited from parking during Visitor Parking hours, except for loading/unloading as described above. Any owner or occupant who parks in the front during Visitor Parking hours is subject to two written citations and then subject to tow on the third citation, within a 12-month period.   Visitor Parking Hours: 9:00 PM – 9:00 AM Visitor(s) may not park in Visitor Parking anywhere in the complex for more than five (5) times in a thirty (30) day period.

Vehicles belonging to owners, occupants or guests shall not be parked in such a manner as to impede or prevent ready access to any garage or driveway. Vehicles parked in “No Parking” or “Restricted Parking” areas are subject to immediate tow-away at the vehicle owner’s expense, subject to LACC 15.64.270 and Cal. Vehicle Code 22658. Storage in parking spaces of equipment, bicycles, furnishings, auto parts, tools, storage boxes or any other items is prohibited Parking spaces must be safe, neat and clean at all times. Washing, repairs or other work on vehicles is not permitted in the parking areas, parking spaces or common areas. Minor maintenance work is permitted only within assigned owner parking spots. Vehicles in inoperable condition shall not be parked on Association premises at any time, and are subject to tow at vehicle owner’s expense. Prohibited vehicles (as defined in the CC&Rs) parked within Association property are subject to two (2) written warnings prior to tow, except where described in the Rules and Regulations. Owners are responsible for violations of CC&Rs, ByLaws, or Rules and Regulations committed by their tenants, lessees and guests. Any substance spilled or leaking from any vehicle or container will be the responsibility of the occupant for prompt clean up. The Association in its sole discretion may clean up such areas

immediately or if the responsible occupant has not cleaned the area in an acceptable within 48 hours of being notified by the property manager. The cost of such cleanup shall be billed to the Owner. Owners are responsible for damage or spills created by vehicles of guests, lessees and tenants. 4.10 4.11 The speed limit within the community is 5 MPH at all times. Dirt bikes, dune buggies, all-terrain vehicles, motorized scooters or other motorized vehicles, which are not licensed for street use, shall not be operated within the community at any time. Illegally parked vehicles, i.e. blocking driveways and fire lanes, will be towed without prior warning. The Board of Directors and Property Manager are authorized to have violating vehicles towed away at cost to the vehicle owner. Vehicle owners will be required to pay all fees to the towing company in order to recover their vehicle(s). Persons who believe their vehicle has been wrongfully towed may submit a written response to the Board for consideration. The Board will respond to the owner in writing within a reasonable period of time. The following vehicles are prohibited from the property: • Commercial moving vans, Uhaul trucks, Delivery trucks, buses, trailers, campers, boats, recreational vehicles, and mobile homes. 4.16 4.17 Caution must be taken when entering and exiting parking gates. The Owner is liable for the cost of repairs to damaged property. Pursuant to the addendum that Owner’s signed at time of purchase, it is the Owner’s signed understanding that the garage leaks. While the Association may make repairs to mitigate this problem, it is the occupant’s sole responsibility to insure vehicles and property do not incur damage from leaks in the garage. Neither the Association, the Board of Directors nor Association assigns or employees are liable for damage caused by garage leaks. All vehicles parked on Park Encino property are parked at the vehicle owner’s risk. The Association, Association employees, or the Board of Directors are not liable for any damage or theft to owner, occupant or guest vehicles or property. GENERAL COMMUNITY Noise and Nuisances (Refer to Article XI, Section 20, 24 and 25, of the CC&Rs) 5.1.1 Volume on televisions, radios, stereos, car stereos, musical instruments and other sources of noise must be kept at a level which will not disturb other occupants or neighboring buildings, whether the equipment is in the interior or exterior of the unit, in the common area, or in a vehicle. Special courtesy for other occupants is required before 9:00 A.M. and after 10:00 P.M. Construction and maintenance noise is limited to the hours between 7:00 A.M. and 7:00 P.M. weekdays and 9:00 A.M. and 7:00 P.M. weekends. Violations

should be reported to the Board of Directors through the property manager or the Park Encino Association email address. 5.1.2 No owner, occupant or guest shall obstruct or interfere with the right of quiet enjoyment of other occupants. Barking dogs and other unreasonable pet noises are prohibited at all times. Car horns should be used ONLY in emergency situations. The use of car horns to signal a occupant, guest or tenant for any other purpose is strictly prohibited. The Association reserves the right to determine whether repeated false car alarms constitute a nuisance. Parties, loud behavior or other gatherings may constitute a nuisance if reasonable and considerate volume, behavior and time of day/night are not maintained. Such violations will be treated and fined as a Nuisance and may be reported to law enforcement.

Common Area Conduct 5.2.1 Each owner will be responsible for any damage to the common areas that may be sustained by reason of negligence or willful misconduct of the owner, occupants, guests, or agents of the aforementioned. Obnoxious or offensive activities or activities that are a nuisance to others are not permitted. Skateboarding, scooters (motorized or not) rollerskating and rollerblading are not permitted within the common areas, except as incidental to entering or leaving the community. Bicycles and skateboards must not be parked or left unattended in common areas. Bicyclists must follow all rules of the road applicable to motor vehicles. Equipment or property shall not be removed or relocated from the common areas by a Owner, occupant or guest. Explosive or flammable fluids in unsafe containers shall not be brought into or upon the common areas. Fireworks, firearms or weapons of any type, including air rifles/guns and BB guns, slingshots, paintball equipment, or bow and arrows shall not be discharged or displayed anywhere within the Park Encino community occupantial, recreational or common areas. Street, alleys, driveways, sidewalks, and planted areas of the common area are not to be used as recreation areas. Portable or fixed basketball hoops, trampolines or “jumpers/bounces” are prohibited. Occupants shall be responsible for the action of their children and guests at all times.

5.2.10 Owners, occupants or guests are not permitted upon any roofs, walls, fences, trees or Association-maintained slopes at any time.

5.2.11 No alterations can be made to a Unit’s front door unless approved by the Board of Directors. Doorknockers are not permitted. 5.2.12 The building key will be issued to the owner of each unit. A fee of $75.00 will be charged for replacement of a lost key. 5.2.13 Cigarettes and other smoking items are to be disposed of in designated common area ashtrays only. 5.2.14 Public displays of nudity or indecency are prohibited in common areas and from any location that can be viewed from a common area. Such behavior will be treated and fined as a Nuisance and shall be reported to law enforcement. 5.2.15 Garage sales, patio sales, or similar sales activities are prohibited on the property. 5.2.16 No owner, occupant, guest (or their agents) shall tamper with or attempt to adjust any operating piece of equipment, security camera, lock, valve, electrical, gas or water connection within common areas. 5.2.17 Planting flowers, foliage or vegetation of any sort in the common area is prohibited. 5.3 Exterior Appearance 5.3.1 External items, such as, but not limited to, television and radio antennae, flagpoles, and clotheslines will not be permitted. Drying or hanging of apparel, towels, sheets or rugs is not permitted on balcony/ patio walls or anywhere that may be visible from the common area. Balcony, patio or porch light bulbs must be clear or white and not exceed 60 watts. The bulbs must not exceed the light fixture manufacturer’s recommended wattage. Exterior light fixtures must be clean and free of cobwebs and manufacturer labels. One professionally lettered “For Rent” or “For Sale” sign per unit, not larger than 18”x24” may be placed in one unit window only. One “Open House” sign, no larger than 18”x24”, showing the unit address may be placed at the outer perimeter entrance. No flags will be permitted. Only curtains, drapes, blinds, shutters, and shades may be installed as window coverings. Temporary window coverings are allowed for a period of sixty (60) days from close of escrow. No window will be covered (even as temporary) by paint, foil, newspaper, or similar items. Exterior painting or alteration of any common area, including building walls, is not permitted.

Satellite dishes and similar devices are permitted only on patios or balconies, provided that they are not visible from common areas or the street. Satellite dishes and similar devices are not permitted on the building roof or in any common area.

5.3.10 Bulletins, notices, and postings are permitted only in designated posting areas. The Board and the property manager retain the right to remove notices that are not posted in designated areas or notices that are deemed by the Board as inappropriate. 5.4 Owner Responsibilities when Renting or Leasing Property 5.4.1 All leases for the renting of units within the development will be in writing and will contain a provision that the lease is subject to the Association’s CC&Rs, Articles, Bylaws, and Rules and Regulations. The lease or rental agreement will also provide that any failure by the lessee/tenant to obey the Rules and Regulations, CC&Rs, Articles, and By-laws of the Association will be deemed a default under the lease or rental agreement. Any owner who shall lease or rent his unit will notify the Board of the intent to lease or rent first and, upon Board approval of compliance, provide the Board a copy of the lease or rental agreement thereof. In addition, the owner will provide the Association with the tenant or lessee’s name and phone number within ten days prior to occupancy by the tenant or lessee of the unit. All tenant or lessee violations of the Association CC&Rs, By-laws, Articles, and Rules and Regulations. are the responsibility of the owner. Owners must furnish a copy of Association CC&Rs, By-Laws, Articles, and Rules and Regulations to all tenants and lessees. The owner of a unit will be wholly responsible for insuring that his or her lessee/tenant complies with the Association CC&Rs, By-laws, Articles, and Rules and Regulations. The Board of Directors reserve the right to reject leases, rental agreements and roommate occupancy that are not in full compliance with the CC&Rs, By-Laws, Rules and Regulations, city, county, state and federal laws.

Hazardous Storage Flammable material of any nature may not be stored in any part of a dwelling unit, storage cabinet, garage, or any area attached to a dwelling unit. Common household items are accepted.

6.0 6.1

PETS Illegal breeds (refer to CC&R’s Article XI, Section 6 ) The following breeds of dogs shall not be brought onto Park Encino Condominium premises: Straffordshire Terrier (Pit Bull), Rottweiler, Doberman, German Shepard, Akita, Chow, Presa Canario, Rhodesian Ridgeback, Wolf or Wolf hybrid or any mix of any of the foregoing breeds. Violation will be strictly enforced and subject to the hearing process, compliance fines and legal action up to removal of the animal. County ordinance pertaining to pets will apply to this Association. All dogs must be kept on a leash or confined within the occupant’s unit at all times. All animals are the responsibility of the occupant and owner. The occupant responsible for the pet’s presence must clean up the animal’s

waste immediately. Owners are liable for the cost of repairs that result from animals that they or their tenant/lessees bring onto the property. 6.3 Pets are to be curbed in the following locations only:   The designated dog walking area on the north perimeter of the building Off Park Encino property in the curbside grass in front of the building.

Pets may not leave defecation or urination anywhere in common area landscaping, walkways, or grass. 6.4 6.5 Dogs, cats or other pets are not allowed within the pool area and elevators. If the Board determines that a pet unreasonably disturbs, or is a danger to other individuals it may take action to resolve the matter up to requiring removal of the pet from the community. Every person bringing an animal upon or keeping an animal at the Association will be wholly liable pursuant to the laws of the State of California to each and all persons for any injury or damage to persons or property caused by such animals. INDIVIDUAL PORCHES, BALCONIES AND PATIOS In order that the buildings retain a uniform and desirable appearance, all porches, balconies and patios are to be kept in a clean and neat condition. The lists of acceptable and unacceptable furnishings shown below shall apply. 7.1.1 Acceptable Patio, Balcony and Porch Furnishings:         Patio Chairs Chaise Lounges Patio Tables Barbecues (BBQs) if they are covered with an opaque (not see-thru cover) Storage boxes for patio and BBQ equipment not larger an 3x3x4 BBQs must be gas or propane fueled. Charcoal burning BBQs are not permitted Plant material in containers All items are to be kept in good repair, well painted and/or finished and generally maintained in an attractive manner

Potted plants are permitted only so long as they are maintained in a healthy and attractive state. Potted plans must be in waterproof containers. They must not be allowed to overflow onto deck surface as this causes staining.

OCCUPANT UNITS The occupant or owner is responsible for all maintenance and improvements inside the occupant’s unit and on balconies and porches, including but not limited to:           Appliances, garbage disposals and related plumbing Bathroom, showers and related plumbing Windows, ceilings and interior walls Carpets and flooring Electrical issues Pest control Security, doors and door locks Furnishings Telephones and cable Mold and mildew remediation

PARK ENCINO EMPLOYEES The Association employs a property manager and maintenance staff. Park Encino employees work for the Association and the Board. Park Encino employees are not permitted to work on an Owners’ unit, except on official Association business, without express permission of the Board or as provided for by the CC&R’s. Any mistreatment of Park Encino employees, Board members or hired contractors by owners, occupants or guests, including physical mistreatment or abusive language, is in violation of the CC&R’s and will result in a hearing process and will be subject to a compliance fine, legal action and police action. Owners, occupants and guests shall not enter Park Encino employee vehicles, workshops, custodial areas or storage areas. Abuse, excessive or inappropriate calls to the property manager or emergency phone number constitutes a nuisance and is not permitted.

SANATATION / DISPOSAL Unit garbage shall be disposed of only in the following locations   Designated garbage chutes found on each floor Garbage dumpsters found in the garage

Large bulk items, such as sofas, appliances etc may not be placed in common areas, parking areas, streets or back alleys. Occupants are required to arrange for appropriate disposal services to pick up large items. In the event that the Property Manager must coordinate disposal of large items, charges and fees for such disposal will be assessed to the owner. Garbage may not be left outside of Unit front doors or on patio/balconies. Cigarettes, cigars and associated smoking items shall not be disposed of in common areas, halls, parking areas, the pool area or in property landscaping. SCHEDULING MOVE-IN / MOVE-OUT The on-site Property Manager must be given a minimum of 72 hours notice of anyone moving in or moving out Moving must occur between the hours of 9:00AM and 8:00PM. If possible, moving should not be scheduled for Saturdays or Sundays. All occupants and owners (and their agents) shall take due care to protect Association property from damage or abuse during move-in or move-out. Owners will be liable for any damage or abuse caused by Owner, his/her tenant/lessee, or their agents during moving. Vehicles, owners, occupants or their agents shall not interfere with the driveways, walkways or quiet enjoyment of other occupants or owners. Moving vehicles, trailers, Uhauls or other utility vehicles are not permitted on the property. Such vehicles shall be parked in the street or back alley and are subject to all parking ordinances and rules that apply. Use of elevators for moving shall not interfere with the quiet enjoyment of other owners, occupants, guests or agents. SECURITY Garage doors, gates, roof doors and all doors to the outside are to be closed and locked when not in use. Propping doors or gates open is a security risk and is prohibited. Please report broken lights, cameras, damaged property or other safety hazards to the Property Manager or Board immediately.

Pool & Recreation Area Rules

THERE IS NO LIFE GUARD ON DUTY AT THE POOL. ALL PERSONS USING THE FACILITY DO SO AT THEIR OWN RISK. The Association shall not be responsible for any accident or injury to members, their families, guests or other persons using this facility, nor for any articles lost, stolen or damaged. Association employees or the Board of Directors (and their agents) have the authority to restrict the use of this facility to anyone who does not comply with the facility rules or is not in good standing with the Association. Children under the age of 16 years are not allowed in the pool unless accompanied by a responsible adult. In order to reduce costly Association liability, the following is prohibited from the pool area:         Glass, bottles, cans or sharp objects Diapers, soap, bath oils, cigarettes, or cigars. Drug use, alcohol use, drug-induced behavior, or alcohol-induced behavior Running, pushing or other dangerous activity Advertising or posting of notices Wheeled toys or vehicles including skateboards, roller blades, roller skates, or bicycles. Games, recreational equipment or toys shall not interfere with other individuals’ enjoyment of the pool and pool area Alcoholic beverages or food Animals or pets

All devices and persons shall maintain a reasonable volume that does not disturb other users or occupants. If requested by other individuals, volume of devices or persons must be lowered. The quiet enjoyment of the area by other individuals shall not be disturbed. Guests must be accompanied by the hosting owner or occupant. The maximum number of guests is six per residence. Occupants have priority in use of facilities. When many occupants are using the facilities the number of guests musts be reduced or excluded if necessary. Please use good judgment and courtesy. Use of the pool by an intoxicated person(s) is prohibited

If the pool area is left unclean or damaged, a fee may be assessed to the responsible owner. Owners are liable for all tenant/lessee violations and fines. Only Coast Guard approved floating devices are permitted in the pool. Appropriate bathing attire must be worn. Cut offs are not allowed. The instructions of a Board Member, Association Manager, Security Officer or Pool Monitor hired by the Association must be obeyed at all times. The presence of Association personnel or a Pool Monitor, if any, does not relieve parents or guardians of supervising their children at all times. Individuals with communicable or contagious diseases, which would endanger the health of others, may not use the pool. Tampering with pool heating devices and equipment is prohibited.

Barbeque Area Rules
1. The barbeque area is for use by occupants and accompanied guests only on a first-come-firstserved basis. The barbeque may only be reserved for private functions with the property manager 48 hours or more prior to date of intended use. Use time may not exceed one hour per residence or group of occupants. The barbeque and surrounding area must be left clean and all trash and debris placed into trash containers or removed from the area. The grilled surfaces should be brushed clean after cooking. Children under the age of 18 may not use the barbeque unless supervised by a responsible adult at all times. The barbeque is gas fueled and proper safety procedures and caution must be used when operating it. Be sure all valves are turned off and closed when you are done cooking. If you smell gas in the area before lighting the barbeque do not attempt to light or use it. Report any gas leaks to the gas company and the property manager immediately. Report any damage to the barbeque or safety concerns to the property manager immediately. Failure to comply with these Rules and Regulations and the instructions of Association personnel may result in loss of use privileges and/or fines.

Gym Rules
1. The Association, Board of Directors, Association assigns and employees shall not be responsible for any accident or injury to members, their families, guests or other persons using this facility, nor for any articles lost, stolen or damaged.

Earphones must be used at all times with radios, cassette/CD players, and similar devices. If requested by others, the volume of music devices and the television must be lowered. The quiet enjoyment of the area by other individuals shall not be disturbed. Guests must be accompanied by the hosting owner or occupant. Children under the age of 18 may not use the gym unless supervised by a responsible adult at all times. The Gym area and equipment must be left in clean, working order. Please report broken or missing equipment to the property manager. Inappropriate or offensive media content or behavior is not permitted. Exercise equipment is for use by occupants and accompanied guests only on a first-come-firstserved basis. The gym and its equipment may not be reserved or monopolized. Use time of any equipment may not exceed one hour per residence or group of occupants. Food is not permitted in the gym. Bottled non-alcoholic beverages are permitted, and must be disposed of in a proper trash receptacle by occupants and accompanied guests. Appropriate attire must be worn at all times. Failure to comply with these Rules and Regulations and the instructions of Association personnel may result in loss of use privileges and/or fines.

Recreation Area
1. “ RECREATION AREA” is defined as, but not limited to, the living room/kitchen common area on the first floor and the recreation and game areas on the ground floor.

Reserved private use of the recreation areas must be scheduled at least 48 hours prior with the onsite property manager. The property manager and Board of Directors retain the right to refuse or cancel owner reservations or dissolve owner gatherings in common areas that are not in compliance with the CC&Rs and Rules and Regulations. The maximum number of guests permitted is six per residence, unless otherwise approved by the Property Manager or Board of Directors prior to the engagement. Occupants have priority in use of facilities. When many occupants are using the facilities the number of guests musts be reduced or excluded if necessary. Please use good judgment, fairness and courtesy. The Association, Board of Directors, Association assigns and employees shall not be responsible for any accident or injury to owners, occupants, their families, guest or other persons using this facility, nor for any articles lost, stolen or damaged.

All devices and persons shall maintain a reasonable volume that does not disturb other users or occupants. If requested by other individuals, volume of devices or persons must be lowered. The quiet enjoyment of others shall not be disturbed. All doors leading out to the pool area must remain closed after 10:00pm in order to not disturb others. Guests must be accompanied by the hosting owner or occupant. Children under the age of twelve (12) must be supervised by a responsible adult at all times. The Recreation area and equipment must be left in clean, working order. Please report broken or missing equipment to the property manager. The responsible owner will be charged a fee if the recreation area is left unclean and/or damaged. Inappropriate, loud or offensive behavior is not permitted. Please be considerate of neighbors. Recreation Areas and equipment are for use by owners, occupants, tenants and accompanied guests on a first-come-first-served basis. These areas may not be reserved or monopolized, unless scheduled with the property manager or Board of Directors at least 48 hours prior to the engagement. Use of any recreational equipment may not exceed one hour per residence or group of occupants if other individuals are waiting to use the equipment. Food and beverages must be disposed of in a proper trash receptacle by occupants, and accompanied guests. Alcohol may be consumed discreetly in a mature manner. Violations may result in a clean-up fee assessed to the Owner. Failure to comply with these Rules and Regulations and the instructions of Association personnel may result in loss of use privileges and/or fines. The property manager and Board of Directors reserve the right to break up or prohibit any engagement that is in violation of these rules.
