The Western Australian Planning Commission (“WAPC”) is the authority responsible for the
determination of subdivisions in this state.

GREEN TITLE, SURVEY STRATA OR STRATA – WHAT IS THE DIFFERENCE?

Both green title and survey strata subdivision allow for the creation of vacant blocks whereas
strata subdivision may only be used to subdivide land that has existing buildings or structures.
Also, a strata title covers land that is shared by owners of adjoining strata titles (such as a
common driveway).

In terms of vacant land, the primary difference between a green title subdivision and a survey
strata subdivision is the nature of the titles created – green title allows the creation of individual
land titles for each lot, while survey strata creates individual land parcels on one title (eg. units or
villas).

It is important to note that the WAPC will assess these applications the same and therefore must
comply with Local Government requirements and any other relevant planning policies (eg.
Residential Design Codes).

CAN I SUBDIVIDE?

The potential to subdivide land is dependant on a number of factors including the zoning of the
land, the size of the lot and any site issues which may require assessment. All land within the
Shire of Serpentine Jarrahdale has been zoned under Council’s Town Planning Scheme No.2.
This zoning will help to determine the minimum lot size and lot yield that may be able to be
obtained as well as the requirements that may need to be met.

Prior to lodging a subdivision application, it is recommended that you discuss the potential for
subdivision with one of Council’s Planning staff.

RESIDENTIAL SUBDIVISION

If the land subject to subdivision is zoned Residential or Urban Development under Council’s
Town Planning Scheme, then it will be subject to design requirements under the Residential
Design Codes. Land within the Byford Structure Plan area will be subject to subdivision and
development requirements as stipulated by the Byford Structure Plan, any adopted Local
Structure Plans and the Byford Townsite Detailed Area Plan. Please contact the Shire of

WHAT DO I NEED TO SUBMIT WITH MY APPLICATION?

To apply for subdivision, a Form 1A “Application for Approval of Freehold (green title) Subdivision
or Survey-Strata” must be submitted. These forms are available both from the Department for
Planning and Infrastructure (“DPI”) (www.wapc.wa.gov.au) and the Council (see attached). In
addition, the following information must be submitted with the Form 1A:

     1. 8 copies of the plan of subdivision/amalgamation/survey strata showing the dimensions,
        the area and other relevant information (refer to the Information sheet attached to the
        Form 1A).
     2. 8 copies of all supporting documents, technical reports etc for referral to other agencies.
     3. Copy of the current Certificate of Title(s).
     4. The signatures of title owner(s), or a letter of authority on behalf of the title owner(s).
     5. The correct application fee (see attached or visit www.wapc.wa.gov.au for current
        application charges).

If the subdivision proposed is within Rural Living, Special Rural or Rural zoned land, a plan of the
subdivision overlaid on an aerial photograph will help with the assessment process. Furthermore,
the preparation of plans and application documents can be complex and landowners may wish to
appoint a Town Planning Consultant or Surveyor to undertake this work on their behalf.

THE SUBDIVISION PROCESS

The subdivision application is lodged with the Department of Planning and Infrastructure (DPI)
where the following process occurs:

     1. DPI refers the application to all relevant government agencies for comment, such as
        Western Power, the Water Corporation and the Shire of Serpentine Jarrahdale. Agencies
        then have 42 days within which to provide comment to the DPI.
     2. Once all comments have been received, the DPI prepares a report on the proposal, which
        may be referred to the WAPC for consideration. The WAPC has 90 days, from the date of
        receipt of the application, to make a decision.
     3. Following the consideration of the Commission, the applicant and the local authority are
        notified of the decision including the conditions of approval or reasons for refusal. The
        applicant may request reconsideration of any decision made, including any conditions
        imposed on an approval (contact the DPI) or make a formal request for review to the State
        Administrative Tribunal.
     4. Once the application has been approved, the applicant/owner arranges for works to be
        completed to fulfill the conditions of approval, including servicing and surveying.
     5. The Diagram or Plan of Survey is submitted to the relevant local authority and servicing
        agencies for clearance of the conditions. Additional fees will be payable at this time.
     6. When all authorities have cleared the conditions of approval, the endorsed Diagram or
        Plan of Survey is submitted to the DPI for final approval, following which the endorsed
        plans are lodged with the Department of Land Information for the creation of new titles.
