Instructions for Obtaining a Title by Mechanic’s or Storage Lien
Conduct Record Search to Determine Vehicle Owner(s) and Lienholder(s)
Contact the Secretary of State, Motor Vehicle Records Division, Record Inquiry Section, in writing requesting a title search to determine the owner(s) and lienholder(s) of the vehicle. A $5 title search fee is required for each vehicle.
Sale of Vehicle
• If claim is $2,000 or less — The sale can take place unless the bill is redeemed within 90 days. After 60 days has lapsed without service payment, the claimant must place an ad in a newspaper of general publication for one day listing the last owner’s name(s), the year, make and vehicle identification number (VIN) of the vehicle, lien amount, and give 30 days notice prior to sale of the vehicle. The claimant also must send a certified letter with a copy of the 30-day notice to the owner(s) and lienholder(s) stating his/her intentions to enforce a mechanic’s lien (Chapter 770 ILCS 50/3). The vehicle must be disposed of at sale in compliance with Chapter 770 ILCS 50/4. • If claim is over $2,000 — The sale can take place unless the bill is redeemed within 30 days. If the owner’s address is known, the claimant must send a certified letter. If a lienholder is identified on the owner record received by the claimant, a certified letter also must be sent to the owner. These letters must identify the last owner’s name(s), the year, make and VIN of the vehicle, lien amount and give 30 days notice prior to the sale of the vehicle. If the owner’s address is unknown or if the certified mailing is returned as undeliverable, the claimant must place an ad in a newspaper of general publication once a week for three consecutive weeks, listing the last owner’s name(s), the year, make and VIN of the vehicle, lien amount and give 30 days notice prior to the sale of the vehicle. Also, in the case of an unknown owner’s address or undeliverable, an affidavit to that effect must be filed with the Clerk of the Circuit Court (Chapter 770 ILCS 45/1 et seq.; Chapter 770 ILCS 90/1 et seq.) The vehicle must be disposed of at sale in compliance with Chapter 770 ILCS 45/1 et seq. and Chapter 770 ILCS 90/1 et seq. • If claim is result of Self-Service Storage Facility Act — The sale can take place after the vehicle owner/occupant and lienholder are properly notified with an itemized statement of the facility owner’s claim showing the sum due at the time of the notice and the date when the sum became due, a description of the property, a notice of denial (if included in the rental agreement) and a demand for payment within 14 days. The notice must be delivered in person or sent by certified mail to the last known address. The notice must indicate that if the claim is not paid, the property will be placed for sale. After the 14 days, an ad must be published once a week for two consecutive weeks in a newspaper in the location of the facility listing the vehicle information, address of the facility, time, place, manner of the sale and name of occupant/owner. The sale shall take place no sooner than 15 days after the first publication (Chapter 770 ILCS 95/1 et seq. for further compliance).
Obtaining a Certificate of Title After Sale
The vehicle purchaser at sale must submit the following: • Application for Certificate of Title; • $65 title fee payable to Secretary of State; • Written verification that a title search was conducted by the Secretary of State’s Written Inquiry and Records Section; • Verification that a certified letter was mailed to the last owner(s) and lien holder(s) (The original and/or copy of the sent letter and signed return receipt or envelope marked “undeliverable” is acceptable.); • Attached affirmation properly completed by the seller (mechanic lienholder); • Appropriate tax form and sales tax payable to Illinois Department of Revenue; • Copy of the bill or invoice for services rendered, reflecting the total amount due and a detailed description of the services rendered; and • Copy of the newspaper advertisement.
